Krupski : At the present time we are respectfully requesting to modify this permit . The requested modification is to allow for the construction of a 6 ' x 10 ' duck blind along the shoreline of South Pond. As proposed the blind shall be installed 6"-1 ' below grade . We seek -ko construct the blind at this time since we are currently undertaking the replanting of the shoreline as approved under this permit . By constructing the blind now we will be able to plant around the blind instead of disturbing the newly planted area. at a later date As always should you or any member of the Board of Trustees have any comments or questions concerning this request please feel free to contact our office at any time . Phragmites and root mass shall be removed (excavated) and trucked to an upland site (greater than 100 ' from freshwater wetlands and greater than 300 ' from tidal wetlands ) for disposal. For disposal a pit shall be excavated, material shall be placed in pit, covered with a PVC liner and a 4 ' =6 ' layer of soil shall be placed on top of liner. In restoring pond, approximately 17,000 c.y. of soil shall be removed to create depths of 1 1/2'-161 . Pond shall be planted with rooted emergent vegetation. Existing road located within adjacent area shall be utilized during excavation then replanted and abandoned. Greenbrier and dead vegetation shall be removed from adjacent area (1001 ) and a wetlands transitional area shall be created. An area. of Phragmites located southwest of pond along Great Peconic Bay shall - be hand cut to assure that no seed material returns to pond. Approximately 1,000 c.y. of clean sand shall be placed in area located between pond and Great' Peconic Bay to strengthen shoreline from storm surge. The question of whether an action may be significant is not always easy to answer. Frequent- ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determine significance may have little or no formal knowledge of the environment or may not be technically expert in environmental analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting the question of significance. The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination process has been orderly, comprehensive in nature,yet flexible enough to allow introduction of information to fit a project or action. Full EAF Components: The full EAF is comprised of three parts: Part 1: Provides objective data and information about a given project and its site. By identifying basic project data, it assists a reviewer in the analysis that takes place in Parts 2 and 3. Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides guidance as to whether an impact is likely to be considered small to moderate or whether it is a potentially- large impact. The form also identifies whether an impact can be mitigated or reduced. Part 3: If any impact in Part 2 is identified as potentially-large, then Part 3 is used to evaluate whether or not the impact is actually important. " t o' As you already know, prior owners of Robins Island were granted patents by the State of New York to the underwater lands surrounding the Island and, thus , the general public does not have the right to pass and repass along the beaches along Robins Island, Mr. Bacon acquired these rights to the underwater lands when he purchased the Island. In an effort to avoid any confusion over this issue in the future , I respectfully request that the Board pass a resolution amending all of the permits it granted to date pertaining to Robins Island indicating that : "These permits do not grant or convey any right to the general public to trespass on Robins Island, nor to interfere with the riparian and littoral rights of the applicant , nor impair any rights , title or interest in real or personal property held or vested by the applicant .
