Re: Local Waterfront Revitalization Coastal Consistency Review "A Local Law in relation
to an Amendment to Chapter 280-244 Accessory Apartments"
The action referenced above has been reviewed to Chapter 268, Waterfront Consistency Review
of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP)
Policy Standards. Based upon the information available, it is my recommendation that the
proposed action is CONSISTENT with the LWRP Policy 1;
Policy 1:foster a pattern of development in the Town of Southold that enhances community
character,preserves open space, makes efficient use of infrastructure, makes beneficial use of a
coastal location, and minimizes adverse effects of development.
This amendment allows a more efficient use of infrastructure and may minimize adverse effects
of development by permitting accessory dwelling units on parcels that are already developed,
potentially reducing the pressure to develop new land for affordable dwellings over time.
Pursuant to Chapter 268, the Town Board shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

The Southold Town Board at their regular mectia 'field on March 10, 2026 adopted the
resolution referenced above. A certified copy/i " ' closed.
Please prepare an official LWRP and SEQiA report with regard to the proposed Local Law and
forward it to me at a suitable time in order to allow sufficient time for the Town Board to review
it before the public hearing. This proposed local law will also be transmitted to the Southold
Town Planning Department and to the Suffolk County Planning Department for their review.
The date and time for this public hearing is 6:00 P.M., Tuesday, April 21, 2026 respectfully.

THIS IS TO CERTIFY THAT THE FOLLOWING RESOLUTION NO. 2026-244 WAS
ADOPTED AT THE REGULAR MEETING OF THE SOUTHOLD TOWN BOARD ON
MARCH 10, 2026:
RESOLVED that there has been presented to the Town Board of the Town of Southold, Suffolk
County,New York, on the 100'day of March, 2026, a Local Law entitled "A Local Law in
relation to an Amendment to Chapter 280 Zoning, Accessory Apartments" and be it
further
RESOLVED that the Town Board of the Town of Southold will hold a public hearing on the
aforesaid Local Law at the Peconic Community Center Auditorium, 1170 Peconic Lane,
Peconic,New York on the 20 day of April, 2026 at 6 p.m. at which time all interested persons
will be given an opportunity to be heard.
The proposed Local Law entitled, "A Local Law in relation to an Amendment to Cha rter�

BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose
The Purpose of the amendment is to update the Southold Town Code with regard to Accessory
Apartments.
H. Amendment
The Southold Town Code is hereby amended by removing the struck through words and adding
the underlined words as follows:
280-4_
B. Definitions and usages. Unless otherwise expressly stated, the following terms shall, for the
purpose of this chapter,have the meanings as herein defined. Any word or term not noted below
shall be used with a meaning as defined in Webster's Third New International Dictionary of the
English Language,unabridged (or latest edition).
ACCES SORY rAPARTMENT
An apartment created in a 1 s -1,- isting-one-family dwelling unit or detached accessory
structure pursuant to § 280 13A.(i or § 80-13B ).
§280-13(A)(6)
One accessory apartment in m . ," : one-family dwelling, subject to the issuance of a rental
permit in accordance with § 0--1 3D and the following requirements

III. Severability
If any clause, sentence,paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. Effective Date
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.
