Trust, c/o Christopher Gaillard PROPERTY LOCATION: 556 Bell Hill Avenue,Fishers Island,NY SCTM: 1000-9-3-4 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type 1I category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject, non-conforming, irregular-shaped 30,182 square feet, 0.69 acre upland parcel located in the R40 Zoning District measures 321.25 feet along Bell Hill Avenue then runs west 102.50 feet along a right of way and driveway servicing two residentially developed lots to the west, then runs south 85.00 feet and continues 104.26 feet along the first neighboring home, then runs southeast 186.62 feet along the second residence to the west, back to the roadway. The subject parcel is developed with an existing single family residence with stone walkways and patios, a concrete patio, a second floor porch on the west side of the home accessed by external stairs, and an accessory garage building, as shown on the Site Plan prepared by Peter M. Parent, Licensed Professional Engineer, dated December 18,2025. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-124 and the Building Inspector's November 21, 2025 Notice of Disapproval based on an application for a permit to construct additions and alterations to an existing seasonal dwelling and convert the cottage into a year-round single-family dwelling; at: 1) less than the code required minimum front yard setback of 40 feet; located at: 556 Bell Hill Avenue, Fishers Island,NY. SCTM No. 1000-9.-3-4. RELIEF REQUESTED: The applicant requests a variance for alterations and additions including the addition of a proposed 2-story addition to the rear of the residence and the installation of an open air pergola,273 square feet,over an existing front concrete patio, along with conversion of the residence from a seasonal to a year-round home, with a newly established front yard setback of 9.25 feet where a minimum front yard setback of 40 feet is required. ADDITIONAL INFORMATION: The applicant provided unpaginated architectural plans including present,and proposed conditions and photographs labeled site plan, sky plane analysis, floor plans and elevations, prepared by Samuel William Fitzgerald,Registered Architect, dated December 5, 2025. Page 2, May 21,2026 #8101, Gaillard CS Revoc Trust SCTM No. 1000-9-3-4 The applicant's agent states that the home is known on Fishers Island as `Treetops' and that it has been in his family since the early 1970s and that it was originally constructed in the early 20t"Century as a barn/carriage house servicing an estate home which no longer exists. Furthermore, the applicant indicated that his family has been on Fishers Island for nearly a century and is the owner of the adjacent properties. The ZBA conducted a site inspection on May 9, 2026. Additionally, Southold Town Building Department Chief Building Inspector Michael Verity performed an inspection on March 19, 2026 and issued a memo to the Zoning Board of Appeals, received March 20, 2026, indicating: "No changes. Ok as submitted". The applicant's architect states that the barn/carriage house converted to a seasonal residence is sited almost entirely in the R40 Zoning District front yard setback and that they seek approval to renovate and expand the house in a compliant location at the rear of the structure. The expansion is necessary to allow for the creation of an interior stairwell to accommodate access to the second floor. As currently exists the second floor is accessed via a narrow spiral staircase or, more favorably used, an exterior stairwell to the rear second floor porch. The proposed addition and conversion from seasonal to year-round dwelling is not `formally' part of the application before the Board. However, the proposed addition of a 273 square foot open air pergola over an existing concrete patio at the front of the residence is part of this application. As presently sited, and covered by a valid Certificate of Occupancy, the existing home has a front yard setback of 12 feet where a minimum front yard setback of 40 feet is required. The proposed addition of the pergola, measuring 9 feet by 30 feet, will create a more non-conforming front yard setback of 9.25 feet. The applicant's architect also indicated that as part of the construction of the pergola, `fan' panels (sun louvers) will be added to the upper lattice to offer enhanced shade to the patio sitting area below. As part of the overall renovation of the residence, a new Suffolk County Board of Health approved Innovative and Alternative sanitary system will be installed. Improvements on the parcel are covered by the following Certificate of Occupancy: #Z6221 dated December 2, 1974 covering a private accessory garage building #Z40934 dated December 16, 2019 covering electrical upgrades #Z41530 dated October 11, 2020 covering `as built' additions #Z41531 dated October 31, 2020 covering a Pre-Certificate of Occupancy Multiple letters of support were received regarding this application. No member of the public or an immediate neighbor spoke in favor of or against this application during the hearing. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on May 7,2026 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law§267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The west end of Fishers Island is a residential community of larger lots with larger homes in a rural and irregular setting as a result of the rocky topography of the island. The existing home, with a current front yard setback of 12 feet, and the proposed open air pergola addition, establishing a new front yard setback of 9.5 feet,will not be discernable to passersby or those traversing Bell Hill Avenue.The existing structure has stood without issue with a non-compliant front yard setback since the introduction of Zoning in the Town of Southold. Furthermore, the home was once a barn/carriage house serving a larger estate house that is no longer standing and has `defined' the community for generations. The addition of a pergola along the roadway will not disrupt the community's character but rather enhance it as part of the proposed additions and alterations. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Any alteration to the residence will require some form of relief or another as a result of the initial, early 20"Century, pre-zoning construction, where the existing and legally present home has a 12-foot front yard setback with the majority of the residence located within the code defined front yard setback. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 76.9%relief from the code. However,the structure as it stands today and as legally recognized has a 70%relief from the code for the front yard setback, as recognized by the Pre-Certificate of Occupancy on file with the Town of Southold. While the additional 6.9% relief sought may seem excessive in principle, it represents just 2.75 feet additional `encroachment' into the code compliant front yard setback. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that'a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has not been self-created. The structure was built prior to the establishment and adoption of Zoning in New York State and the Town of Southold. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an open air pergola addition measuring 9 feet by 30 feet with a newly established non-conforming front yard setback of 9.25 feet where the code requires a minimum 40 foot front yard setback, as part of the proposed additions and alterations to convert a seasonal dwelling to a year-round residence, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Planamento, seconded by Member Steinbugler, and duly carried,to GRANT the variance as applied for, and shown on architectural plans including present and proposed conditions and photographs labeled site plan, sky plane analysis, floor plans and elevations, prepared by Samuel William Fitzgerald, Registered Architect,dated December 5, 2025. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant shall install an Innovative Alternative wastewater treatment septic system on the subject property, as shown on the site plan drawn and stamped by-Peter M. Parent, PE Sheet 1 dated 12/18/2025 and/or as approved by the Suffolk County Department of Health Services. 2. The proposed pergola is to remain open to the sky and unenclosed This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity, provided de minimis relief is requested within one year of the date of this decision. Any time after one year,the Board may require a new application.
