(631) 765-1809 Soot old 'down Clef k FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF MAY 21, 2026 ZBA Application No.: 8102SE Applicants/Owners: Narrow River Properties LLC Property Location: 28410 Main Road, Orient,NY SCTM No.: 1000-19-1-1.5 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further requirements under SEQRA. SUFFOLK COUNTY ADMR41STRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. DEPARTMENT OF LAND PRESERVATION: The application was referred to the Department of Land Preservation,which provided a memo of response dated May 5,2026 regarding this application. The memo noted that: 1 (a): The residential structures proposed on the Reserve Area are unrelated to agricultural production,thus altering the Easement Area's topography or locating drainage improvements related to these residential structures on the Easement Area is inconsistent with the Easement Terms, hence any ZBA approval should be conditioned on the applicant's containment of all improvements, including topographical alterations or support structures or drainage improvements, on the Reserve Area. 1 (b): The topographical alterations proposed in the Reserve Area could create significant slopes which may generate runoff that could have significant negative impacts on the Easement Area's agricultural viability and wetlands, thus harming the natural resources the Town invested to protect, which is particularly true where the landowner proposes to convert portions of the Easement Area near the Reserve Area to livestock pasture,which would compact soils. Hence any ZBA approval should be conditioned on a storinwater management plan that contains runoff generated by the accessory apartment, parking, and related recontouring to the Reserve Area to ensure the Easement Area remains viable agricultural land. Use or improvement of the "Proposed Driveway" (i.ec., the Utility right-of-way [ROW]) for access to the accessory apartment or its construction is inconsistent with the Easement term. Any ZBA approval should:(1)limit access to the accessory apartment/parking and any improvements necessary for such access to the Residential ROW from Narrow River Road, consistent with the Easement terms; (2) prohibit use or improvement of the Utility ROW for residential access; (3)require the address for the accessory apartment be located on Narrow River Road; (4) require the applicant to relabel the "20' R.O.W." (i.e., Residential ROW/Proposed Driveway) and"Proposed Driveway" (i.e., Utility ROW/Farm Road) on any related plans to correctly reflect these restrictions for all involved agencies and departments. REQUEST MADE BY APPLICANT: The Applicant-Owner requests a Special Exception under Zoning Code Section 280-13(B)(13)to establish an accessory apartment in an accessory structure. As the primary dwelling and the accessory apartment are being constructed simultaneously, permission is being sought to enable construction of the accessory apartment on a residential lot without an existing principal single-family dwelling. PROPERTY FACTS/DESCRIPTION: The subject property located at the southwest corner of Main Road and Narrow River Road in Orient has an area of 1,505,114 square feet(34.552 acres) comprised of two tax parcels, #1000-19-01-1.3, a parcel of218,730 square feet(5.021 acres)with development rights intact ("Reserve Area) and#1000-19-01-1.4, a parcel of 1,286,382 square feet(29.531 acres) with development rights sold("Easement Area"), both conforming and in the R-200 Residential Zoning District. The combined parcel has frontage on Main Road(NYS Route 25) in three segments of 315.35 feet, 609.66 feet, and 309.66 feet and frontage on Narrow River Road running southeast for 1044.17 feet and running southwest for 945.2 feet. The property line then runs northwest for 850.87 feet and west 190.00 adjacent to NYS Open Space,then runs northwest for 697.49 feet, adjacent to three residential parcels, back to Main Road. The Reserve Area parcel is a roughly trapezoidal in shape with a southwest boundary of 698.59 feet co- linear with the combined parcel's 850.87 feet southwestern boundary and three boundaries interior to the combined parcel: a northwest boundary of 382.61 feet, a northeast boundary of 510.64 feet, and a southeast boundary of 367.28 feet. The Reserve Area is developed with seven sheds, a one-story frame building, a greenhouse, and multiple areas enclosed with split rail and wire fencing equipped with gates. Two additional sheds straddle the boundary between the Reserve Area and the Easement Area. The Easement Area is developed with a frame building, two additional sheds, a paved patio area with pergola, and a dirt access road from Main Road. The Easement Area also contains a freshwater pond in the northeast corner and a narrow freshwater wetland extending approximately 530 feet northwest from about the center of the parcel's southeast frontage on Narrow River Road.All as shown on a preliminary site plan prepared by Kenneth M. Woychuk, L.L.S., last updated June 19, 2025 and noted to be based on a previous survey completed by Nathan Taft Corwin, and on a survey prepared by Ralph O. Heil LLS,of Aerial Land Surveying, D.P.C.,dated December 3, 2025. ADDITIONAL INFORMATION: The application also included a site plan comprising both the Reserve Area and the Easement Area prepared by Marshall Paetzel, Landscape Architecture, dated January 6, 2026; a survey comprising both the Reserve Area and the Easement Area prepared by Nathan Taft Corwin lI, Land Surveyor, dated January, 25, 2017; a site plan of the Reserve Area(noted as"DRI Land"or"Development Rights Intact" Land)prepared by Marshall Paetzel, Landscape Architecture, dated January 6, 2026; and architectural Page 3, May 21,2026 8102SE,Narrow River Properties LLC SCTM No. 1000-19-1-1.5 drawings of the combined accessory garage and accessory apartment titled"Accessory Structure with Apartment"prepared by Christopher G. Powers, R.A., dated January 8, 2026. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on May 7, 2026 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and the surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant. In considering this application, the Board has reviewed the code requirements set forth pursuant to Article III, Section 280-13(B)(13) to establish an Accessory Apartment in an Accessory Structure and finds that the applicant does comply with all of the requirements for the reasons noted below: 1. The owner confirms that the accessory apartment shall contain no less than 220 square feet and shall not exceed 750 square feet of livable floor area and shall have no more than two bedrooms and one bathroom with the entirety of the livable floor area of the accessory apartment located on one floor of the accessory structure. The architectural plans prepared by Christopher G. Powers, R.A., and dated January 8, 2026 propose an accessory apartment with one bedroom and one full bathroom entirely on the first floor of the accessory structure with a conforming 743 square feet of livable floor area. The Building Department provided a "Verification of Livable Floor Area" to the ZBA dated March 12, 2026 indicating the livable floor area to be approximately 687 square feet and conforming to Section 280-13B(13)(a) of the Town Code. 2. The dwelling unit complies with the definition of same in §280-4 of the code, except that the accessory apartment is proposed to be built simultaneously with the principal dwelling 3. The applicant herein owns the property and plans to reside in the principal dwelling as documented by the Application submitted to the Board and the applicant's representative's testimony at the May 7, 2026 public hearing. The applicant confirms that: occupancy of the residential accessory structure on the premises shall be subject to the issuance of an annual rental permit in accordance with 280-13D and the following requirements: one of the dwelling units shall be for the sole, exclusive occupancy of the owner or family member, as defined in Chapter 280-4. The other dwelling unit shall be leased for year-round occupancy evidenced by a written lease for a term of one or more years to a family member or a resident who is currently on the Southold Town Affordable Housing Registry and eligible for placement. The applicant's representative testified that the tenant of the accessory apartment will be Isabel Wilma Meltzer, the applicant's mother, as evidenced by a copy of the applicant's "Original Certificate of Live Birth"and a signed renewable two-year lease. 4. The owners' plans comply with the on-site parking requirements of three spaces, two for the principal dwelling and one for the accessory apartment,and provide for a total of at least three tenant parking spaces, as shown on the site plan for the Reserve Parcel ("Site Plan [DRI Land]") prepared by Marshall Paetzel, Registered Landscape Architect,and dated January 6,2026. 5. Only one accessory apartment will be on the subject property and no Bed and Breakfast facility, as authorized by Section 280-13(B)(14) hereof, shall be permitted in or on premises for which an accessory apartment is authorized or exists. This newly constructed accessory apartment shall be subject to a building permit, inspection by the Building Inspector, approval by the Suffolk County Department of Health Services of the water supply and sewage disposal system(s) and the issuance/renewal of an annual permit in accordance with Chapter 280-13D. 7. No special exception shall be granted unless the Zoning Board of Appeals, in addition to the considerations,determinations and findings required in Chapters 280-142 (General Standards)and 280-143 (Matters to be Considered) specifically finds and determines the following: 1. That the granting of the special exception will not adversely impact the privacy and use and enjoyment of any adjoining parcel. 2. That the granting of the special exception will not adversely impact the character of the neighborhood in which it is located. 3. That the cumulative effect of approving the present application along with previously approved applications will not have a cumulative adverse impact on the surrounding neighborhood. 4. That the cumulative effect of approving the present application along with previously approved applications will not have a cumulative adverse impact on the school district in which the property is located. 5. That sufficient off-street parking exists on the subject property to accommodate the proposed accessory apartment. 6. Whether adequate buffer yards and screening can and will be provided to protect adjacent properties from possible detrimental impacts of the proposed use. RESOLUTION OF THE BOARD: In considering the entire record and the applicable code requirements, motion was offered by Member Steinbugler, seconded by Member Acampora, and duly carried,to GRANT the Special Exception Permit as applied for. SUBJECT TO THE FOLLOWING CONDITIONS: 1. This Special Exception Permit requires an annual renewal by a Code Enforcement Officer. It is the applicant's responsibility to apply to the Building Department each year to renew the accessory apartment permit. Failure to do so may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein. 2. This Special Exception Permit cannot be transferred to new owners. 3. No Certificate of Occupancy shall be issued for the accessory apartment without a Certificate of Occupancy for a principal single-family residence on the subject property. 4. All improvements associated with the residential structures in the Reserve Area, including topographical alternations and/or support structures and/or drainage improvements, shall be contained on/in the Reserve Area and shall not encroach on the Easement Area. 5. The applicant shall establish and implement a stormwater management plan that contains runoff generated by the accessory apartment, parking, their construction, and all recontouring to the Reserve Area to ensure the Easement Area remains viable agricultural land. Access to the accessory apartment/parking and any improvements necessary for such access shall be limited to the Residential Right of Way (ROW) from Narrow River Road, consistent with the Easement terms. 7. Use or improvement of the Utility ROW(access from Main Road) for any residential access shall be prohibited. 8. The applicant shall establish the address for the accessory apartment to be located on Narrow River Road. 9. The applicant shall submit updated site plans for both the Reserve Area and the Easement Area relabeling the"20' R.O.W."from Narrow River Road to"Residential ROW/Proposed Driveway" and relabeling the"Proposed Driveway"for access from the Main Road to "Utility ROW/Farm Road."The relabeled appellations (i.e., "Residential ROW/Proposed Driveway"for the access from Narrow River Road and"Utility ROW/Farm Road"for access from the Main Road)shall be identified as such on any and all related plans to correctly reflect these restrictions for all involved agencies and departments. 10. Prior to obtaining a Certificate of Occupancy for the accessory apartment,the applicant shall submit to the Board an executed signed, notarized, and dated lease from the proposed family member/tenant. Before applying for a building permit, the applicant or agent must submit to the Board of Appeals for approval and filing, two sets of the final Site Plan Drawings conforming to the special exception conditions herein. The ZBA will forward one set of approved, stamped drawings to the Building Department. Failure to follow this procedure may result in the delay or denial of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision, may result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. In the event that this is a special permit subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. Any violations of the conditions, occupancy or other requirements described herein, may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein. The Committee reviewed the applicable Easement, dated May 22, 2002 (attached); accessory apartment plans dated January 8, 2026; Reserve Area site plan dated January 6, 2026; Easement Area site plan dated January 6, 2026; and surveys of the property dated January 25,2017, and December 3, 2025.The Committee is also currently reviewing the landowner's structure and use requests depicted on the Easement Area site plan, and has discussed the proposed uses at its February 3, 2026, March 17, 2026, and March 31, 2026 meetings. The Town purchased development rights on 29.53 acres of the property ("Easement Area"), leaving 5.02 acres with development rights intact("Reserve Area"). The Town's April 9, 2002 purchase resolution states the Easement Area was preserved "due to [its] agricultural value, in addition to [its] . . . proximity to wetlands." The Town's recorded Easement restricts use of the Easement Area to "exclusively . . . agricultural production as that term is presently defined in Chapter 25 [now Chapter 70] of the Town Code of the Town of Southold." Chapter 70 of the Town Code defines "Agricultural Production"as: The production for commercial purposes of crops, livestock and livestock products, but not land or portions thereof used for processing or retail merchandising of such crops, livestock or livestock products. Land used in agricultural production shall also include fences, 1 equipment storage buildings, livestock barns, irrigation systems and any other structures used exclusively for agricultural purposes. The Easement limits residential access to the Reserve Area (e.g., access to the accessory apartment)to the twenty-foot right-of-way running from Narrow River Road to the Reserve Area ("Residential ROW"). The Easement requires that the Residential ROW "be located a minimum of one hundred (1.00)'feet.from the wooded tidal wetland edge and as shown on the [March 29, 2002] survey." The Easement permits the landowner"to improve and maintain said right-of-way with pervious"material,and with such drainage as may be required by the applicable regulatory agencies." The Easement.also provides a twenty-foot ROW from the Reserve Area to the Main Road ("Utility ROW"),whose use is limited to the"installation,maintenance and repair of underground utilities" servicing the Reserve Area, provided the "utilities shall be buried at sufficient depth so as to not interfere with the continued agricultural use of the property." Plans for the proposed accessory apartment show (1) that residential construction on the Reserve Area, including the accessory apartment, results in topographical changes with potential to impact the Easement Area, and (2) a "Proposed Driveway" where the Utility ROW is located. Accordingly, the LPC provides the following comments: 1. Topographical Alterations &Drainage The residential structures proposed on the Reserve Area—including the accessory apartment and associated access and parking area—are unrelated to agricultural production.Thus, altering the Easement Area's topography or locating drainage improvements related to these residential structures on the Easement Area is inconsistent with the Easement terms. Any ZBA approval should be conditioned on the applicant's containment of all improvements, including topographical alterations or support structures and drainage improvements,related to the accessory apartment on the Reserve Area. Additionally, the Reserve Area site plan does not make clear how the topographical changes will be structured, but the proposed recontouring could create significant slopes (-11%- 14%, estimated using only rise over run). The Town purchased an interest in the Easement Area to protect the Easement Area's agricultural value (e.g., prime agricultural soils) and nearby wetlands. Runoff generated by the proposed topographical alterations could significantly negatively impact both the Easement Area's agricultural viability and wetlands, thus harming the natural resources the Town invested to protect. This is particularly true where the landowner proposes to convert portions of the Easement Area near the Reserve Area to livestock pasture, which would compact soils. Any ZBA approval should be conditioned on a stormwater management plan that contains runoff generated by the accessory apartment, parking, and related recontouring to the Reserve Area to ensure the Easement Area remains viable agricultural land. 2 2. "Proposed Driveway"/Residential Access Both the Reserve Area and Easement Area site plans label the Residential ROW as "20' R.O.W.",and the Easement Area site plan labels the Utility ROW as a"Proposed Driveway."The Easement limits residential access to the Residential ROW and prohibits use of the Utility ROW for residential access.There is currently an unimproved farm road where the"Proposed Driveway" is located, and the Easement allows relocation of but nonetheless limits use of this farm road to agricultural production. At the Committee's February 3, 2026 meeting, the landowner stated the farm road would be used exclusively for access related to agricultural production,and that the farm road would either remain as a dirt road or possibly improved with gravel. Use or improvement of the "Proposed Driveway" (i.e., the Utility ROW) for access to the accessory apartment or its construction is inconsistent with the Easement terms. Any ZBA approval should: (1) limit access to the accessory apartment/parking and any improvements necessary for such access to the Residential ROW from Narrow River Road, consistent with the Easement terms; (2) prohibit use or improvement of the Utility ROW for residential access; (3) require the address for the accessory apartment be located on Narrow River Road; and (4)require the applicant to relabel the "20' R.O.W." This Special Exception Permit cannot be transferred to new owners. 3. No Certificate of Occupancy shall be issued for the accessory apartment without a Certificate of Occupancy for a principal single-family residence on the subject property. 4. All improvements associated with the residential structures in the Reserve Area, including topographical alternations and/or support structures and/or drainage improvements, shall be contained on/in the Reserve Area and shall not encroach on the Easement Area. 5. The applicant shall establish and implement a stormwater management plan that contains runoff generated by the accessory apartment,parking, their construction, and all recontouring to the Reserve Area to ensure the Easement Area remains viable agricultural land. 6. Access to the accessory apartment/parking and any improvements necessary for such access shall be limited to the Residential Right of Way (ROW) from Narrow River Road, consistent with the Easement terms. 7. Use or improvement of the Utility ROW(access from Main Road) for any residential access - shall be prohibited. 8.
