Kelly, SCTM #1000-145.4-3 This application is for the as-built I 0'x1 8' floating deck against bulkhead, as-built 8'x1 O'x8' high storage shed, and as-built RV storage and parking and/or 28-foot-long office trailer. The proposed action has been reviewed to Chapter §268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the policies of the LWRP as follows: Policy 4. Minimize loss of life, structures, and natural resources from flooding and erosion. 4.1 Minimize losses of human life and structures from flooding and erosion hazards A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem. 6.2 Protect and restore Significant Coastal Fish and Wildlife Habitats. A. Protect Significant Coastal Fish and Wildlife Habitat values from uses or activities that would: 1. Destroy habitat values associated with the designated habitat through: a. direct physical alteration, disturbance, or pollution, or b. indirect effects of actions, which would result in a loss of habitat. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction The proposed action is inconsistent with Policy 4.1A, which encourages structures to be away from flooding hazards. The east half of the proposed parcel is within the FEMA AE high flood zone. The proposed action is inconsistent with Policy 6.2.A.1 because the Environmental Assessment Form (EAF) Mapper states that Brush's Creek is a designated Significant Coastal Fish and Wildlife Habitat. Development should be avoided near this wetland to maintain habitat values. The proposed action is inconsistent with Policy 6.3A which calls for compliance with the Town of Southold Board of Trustees laws and regulations because there are no wetland setbacks on the site plans submitted. The wetland setbacks must be properly labeled on a submitted site plan to determine if each structure meets the wetland setback requirements. Glenn Goldsmith My name is Francis James Kelly, and I own Brushes Creek Marina, a commercial marina business located at 1900 Peconic Bay Blvd., Laurel, New York. (Zoning exemptions for minor structures, such as sheds or decks, typically allow them to be constructed without a building permit, provided they meet certain size, height, and setback requirements.) Summary of events review.- On February 2, 2020 the board of trustees visited Marina and photographed this RV, but the town rejected it, stating that it falls under the jurisdiction of the building department. On March 12, 2026 Town of Southold attorneys stated that sheds, decks, and DMV matters are governed by code 275,"acknowledging a poor judgment call" by the town Attorneys involved - William Duffy & Scott Kreppein. On April 7, 2016 the ZBA determined the property met the hardship rule and MI rezoning requirements, including uses from building permit 6898 (line #6) and fourteen slips (SEE PERMIT#6898). Only a basic permit was needed for the change of use. Permit under NYS Codes requires a handicapped- accessible parking lot for public safety, but this was denied, resulting in discrimination and possible fines to my business operation O.S.H.A. still has an open violation.
