The proposed action has been reviewed to Chapter §268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the policies of the LWRP as follows: Policy 5: Protect and improve water quality and supply in the Town of Southold. 5,1 Prohibit direct or indirect discharges that would cause or contribute to contravention of water quality standards. C. Ensure effective treatment of sanitary sewage and industrial discharges by: 3. modifying existing sewage treatment facilities to provide improved nitrogen removal capacity Policy 6 Protect and restore the quality and function of the Town of Southold ecosystem. 6.2 Protect and restore Significant Coastal Fish and Wildlife Habitats. 6.3 Protect and restore tidal and freshwater wetlands A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction Policy 13. Promote appropriate use and development of energy and mineral resources. 13.4 Minimize adverse impacts from fuel storage facilities. C. Liquefied Natural Gas facilities must be safely sited, screened and operated. This proposed action is on a nonconforming lot with the wetland boundary of Orient Harbor where the pre-existing single family dwelling is closer than 100 ft from the wetland boundary. The proposed installation of an Innovative/Alternative Onsite Wastewater Treatment System (I/A OWTS) is consistent with Policy 5.1.C.3 which calls for the modification of existing sewage treatment facilities that improves nitrogen capacity removal and will reduce nutrient input to adjacent waters. The wetland boundary of the proposed action is Orient Harbor which is a designated Significant Coastal Fish and Wildlife Habitat. The proposed action is consistent with Policy 6.2 because all proposed alterations are located landward of Orient Harbor. The proposed action is consistent with Policy 6.3A because the building footprint is not being altered. The proposed I/A sanitary system complies with Town Code Chapter §275-3 which calls for a septic tank and sanitary leaching pool to be 75 ft and 100 ft from a wetland boundary. The proposed new propane tank is consistent with Policy 13.4.0 which calls for the minimization of adverse impacts from liquefied natural gas storage facilities and complies with Town Code Chapter 275-4A.1 below: (i) The demolition, removal, repair andlor upgrading of existing residential fuel tanks, fuel lines and fuel dispensers, and the installation or burial of a residential 2 propane tank, including necessary site work, and provided that such activity will not have an undue adverse impact on the wetlands and tidal waters of the Town. The proposed action has been reviewed to Chapter §268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. 3 Town of Southold b M G��r \V/[17210 LWRP CONSISTENCY ASSESSMENT FORM J U 7 9 7026 SOUTHOLD TOWN PLNNkNC�BOARDA. Yes F] No R Not Applicable This project reflects the Town's interest in"preserving and enhancing the natural and built environment and providing opportunities for a level of growth and expansion of the economic base that is compatible with the existing scale of development,availability of water,existing sensitive environment of the Town and its historic heritage."The project will preserve the existing landscape of the site and the surrounding waterbody/wetlands(Orient Harbor).The contractor will install silt fencing around the work area to prevent sediment laden runoff from leaving the Site during construction.Furthermore,the existing cesspool will be properly abandoned and removed in accordance with SCDHS requirements,and an Innovative and Alternative Onsite Wastewater Treatment System(I/A OWTS)and sanitary leaching field are proposed.The new sanitary system will be properly sized, meet the necessary groundwater separation distances,and will significantly reduce nitrogen levels compared to the existing system.The new sanitary system will better protect the natural environment and waterways abutting the property. The integrity of the residence will be preserved while adding a basement egress window and two window wells. The proposed improvements will not negatively impact the visual quality of this resource,as all proposed site utilities will be buried underground;other than the control panels for the[/A OWTS,which will be located along a southern wall of the dwelling and will not obstruct the view harbor.The scenic views of the neighbors will not be affected.The mature vegetation found onsite will be kept in tact to the greatest extent possible.
