Main Rd. &Youngs Ave.) Telephone: 631 765-1938 Southold, NY 11971 � LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD To: Glenn Goldsmith, President Town of Southold Board of Trustees Cc: Honorable Lori Hulse, Attorney From: Heather Lanza, AICP, Planning Director LWRP Coordinator Date: July 13, 2026 Re: LWRP Coastal Consistency Review 8100 Indian Neck LLC, SCTM #1000-86.-7-9 This application is to remove and replace in-place approximately 118 linear feet of existing concrete seawall and 15 linear foot return with vinyl bulkhead and return; backfill with up to 25 cubic yards of clean sandy fill trucked in from an approved upland source, to be replanted with native vegetation; and construct a 4'x5.5' cantilevered wood landing with 3'x±6' steps to beach in place of existing 3'x5' steps to beach. The proposed action has been reviewed to Chapter §268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the policies of the LWRP as follows: Policy 4. Minimize loss of life, structures, and natural resources from flooding and erosion.. 4.1 Minimize losses of human life and structures from flooding and erosion hazards. D. Use hard structural erosion protection measures for control of erosion only where: 2. Vegetative approaches to controlling erosion are not effective 6. Practical vegetative methods have been included in the project design and implementation. Policy 6. Protect and restore the quality and function of the Town of Southold's ecosystem. 6.3. Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction The proposed in-place replacement of seawall and bulkhead with sand fill and native vegetation is consistent with Policy 4.1 D(2) and 4.1 D(6) which states hard structural erosion protection measures can be found consistent if vegetative approaches to control erosion are not effective. In this case, a vegetative approach would not work because wave action would continue the erosion. The proposed backfill of sand complies with Town Code Chapter §275-11 B(l), only clean sand can be used for backfilling in eroded and excavated areas, as well as behind new and repaired bulkheads The proposed action has been reviewed to Chapter §268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. 2 Town of Southold LWRP CONSISTENCY ASSESSMENT FORM JUN 2 9 2026 A. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area(which includes all of Southold Town) If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be explained in detail, listing both supporting and non- supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken. A copy of the LWRP is available in the following places: online at the Town of Southold's website (southoldtown.northfork.net), the Board of Trustees Office, the Planning Department, all local libraries and the Town Clerk's office. Minimize loss of life, structures, and natural resources from flooding and erosion. See LWRP Section III-Policies Pages 8 through 16 for evaluation criteria ®Yes ❑ No ❑ Not Applicable The project seeks to replace an existing concrete seawall with a vinyl bulkhead in the same location to maintain the property's historical method of protection against erosion and flooding. The site has been improved with and supported and protected from flooding and erosion by a seawall since prior to 1978,and there is no viable non-structural alternative means of maintaining and protecting the upland portion of the property in its current location. Without replacement and maintenance of the bulkhead,the subject and adjacent properties would be exposed to severe erosion,flooding,and damage to the residential structures located thereon.Thus,consistent with Policy 4,the project will continue to effectively protect against the potential loss of the adjacent upland and residential structures without causing significant change to or adverse impacts on the adjacent beach,tidal waters,or adjoining properties.
