Main Rd. &Youngs Ave.) Southold, NY 11971 Telephone: 631 765-1938 LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD To; Glenn Goldsmith, President Town of Southold Board of Trustees Cc: Leslie Kanes-Weisman, ZBA Chairperson Members of the Zoning Board of Appeals Julie McGivney, Assistant Town Attorney Honorable Lori Hulse, Attorney From: Heather Lanza, AICP, Planning Director LWRP Coordinator Date: July 13, 2026 Re: LWRP Coastal Consistency Review 622 Church Lane LLC, SCTM #1000-99.-4-18 This application is to construct a two-story dwelling set on piles with a 2,018 sq. ft. ground level and a 4,291 sq. ft. second story level including an attached garage and a glass bridge that connects to existing 469 sq. ft. 1'/2 story cottage (cottage #2); existing 8'x22.3' storage area attached to cottage #2 to be removed and replaced with stairs leading to the bridge; construct a raised pool, patios and decks totaling 1,829 sq. ft.; install 800 sq. ft. of additional landings and walkways; install an oil & stone parking area and driveway; install an I/A OWTS sanitary system landward of dwelling; install nine storm-water drainage drywells to contain runoff, and a pool drywell; install pool enclosure fencing; existing 87.4 sq. ft. block shed and 51.8 sq. ft. frame shed to remain; convert 326 sq. ft cottage #1 to boat storage; 525 sq. ft. seasonal cottage #3 to remain,- concrete slab walkway from cottage #2 and concrete patio on north side of cottage #1 to be removed; cut and fill areas and general regrading to be performed; revegetation of disturbed areas and supplementing existing vegetation with 22 trees, 85 shrubs, native grasses, perennials and lawn areas with existing seaward paths, existing woodlands on 20% slopes to the north, south and east to remain undisturbed, and lawn areas to remain. The proposed action has been reviewed to Chapter §268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the policies of the LWRP as follows: Policy 1 Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. Policy 5 Protect and improve water quality and supply in the Town of Southold. 5.4 Limit the potential for adverse impacts of watershed development on water quality and quantity. A. Protect water quality by ensuring that proposed expansion or intensification of existing watershed development results in: 2. maintenance of natural characteristics of drainage systems, and 3. protection of areas that are particularly susceptible to erosion and sediment loss Policy 6. Protect and restore the quality and function of the Town of Southold's ecosystem. 6.3. Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction. C. Prevent the net loss of vegetated wetlands according to the following measures. Use the measure resulting in the least environmentally damaging practicable alternative. 1. Avoid placement of fill in or excavation of vegetated wetlands: b. Reduce scale or intensity of development to avoid excavation or fill. This proposed action is on a nonconforming waterfront lot with three pre-existing structures. Considering that the lot has a waterfront boundary at the north and a partial waterfront boundary to the east, all pre-existing structures are less than 100ft from the top of the bank leading to the wetland boundary of Mattituck Creek. Although, the proposed action is underneath the allowable 20% of lot coverage at 9%, it is inconsistent with Policy 1 because the building footprint of the single-family dwelling is expanded by 6.32% which increases the adverse effects of development. The proposed action of building connection from the current single-family dwelling to the newly constructed addition over the sloped bank is inconsistent with Policy 5.4.A.2 and 5.4.A.3 which calls for the maintenance of natural characteristics of drainage systems, and protection of areas that are particularly susceptible to erosion and sediment loss. 2 This proposed action would require clearing the land and altering the bank landscaping. Although, native vegetation is proposed to be planted in replacement in the same areas, the drainage system of the bank will be affected and erosion could increase in the future. Additionally, the proposed plant species, Winter King Hawthorne is not native to New York and should be replaced by a plant species that is. The proposed action of the new addition to the single-family dwelling is inconsistent with Policy 6.3.A because it does not comply with the regulatory requirements in the Town Code Chapter 275. On site plan, L-2.1, the "limit of Trustee jurisdiction" is not labeled correctly. The Trustees' jurisdiction starts at the top of the bank and then extends 100ft landward. When properly labeled, proposed additions are within the Trustees' jurisdiction and the residence, including the pool because it is attached to the house, does not meet the top of bank setback in Town Code Chapter 275-3(D)(1)(a)[1] Residence: 100 feet. Additionally, the tidal wetland boundary was delineated in 2015, which does not comply with Town Code Chapter 275-6A(8) which states an application shall be accompanied by a survey and topographical map, created no more than five years prior to the date of application. The proposed action is also inconsistent with Policy 6.3.C.1.b which calls for the reduction of development intensity to avoid the evacuation or fill of vegetative wetlands. Site plan, L-2.1 proposes that 1,200 cubic yards are to be excavated (cut) and 365 cubic yards are to be filled on the property. Reducing the scale of the proposed development will lower the environmental footprint. The proposed installation of an Innovative/Alternative Onsite Wastewater Treatment System (I/A OWTS) is consistent with Policy 5.1.C.3 which calls for the modification of existing sewage treatment facilities that improves nitrogen capacity removal. The proposed sewage systems is placed landward and will reduce nutrient input to adjacent waters. The proposed action has been reviewed to Chapter §268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. 3 L. ® ECELY-- PROJECT DESCRIPTION JUN 2 2 2026 Southold Town Property: 1625 Naugles Drive, Mattituck Board of Trustees Existing woodlands on 20%slopes located on north, south and east remain undisturbed, as shown on L-1.2 plan prepared by Hamilton Landscape Architecture, PLLC Last revised 6-14-26; walking path to existing native grasses landward of existing bulkhead and stone revetment at edge of Mattituck Creek(existing conditions approved in prior permits), The project is situated on a sloped wooded parcel of 129,800 square feet; 92,823 SF is the"Buildable Area". Only 9% of this parcel will be developed, and the balance of parcel remains undisturbed,the light orange line on L-2.1 plan shows the"limit of clearing and ground disturbance' The proposed house is located 60'from front property line, more than 100'setback to tidal wetlands of Mattituck Creek and lagoon.The house is set back from the top of bluff and top of bank to prevent any disturbance to undisturbed wooded slopes. The house will be set on piles to eliminate retaining walls and minimize disturbance to the existing topography of the land.
