Dear Mr. Wiggins:
The following action was taken by the Board of Town Trustees
during their regular meeting held on March 23, 1989 regarding the
above matter:
' WHEREAS, Peconic Associates on behalf of Paradise Point Association
applied to the Southold Town Trustees for a permit under the
provisions of the Wetland Ordinance of the Town of' Southold,
application dated November 16, 1988 and,
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and,
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on March 23, 1989 at which time all interested
persons were given an opportunity to be heard, and,
. WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE BE IT
RESOLVED that Peconic Associates ON BEHALF OF Paradise Point
Association BE AND HEREBY IS GRANTED PERMISSION UNDER THE WETLAND
ORDINANCE TO: Maintenance dredge 500 cu. yds. sand from 4 acres of ,
boat basin, place the spoil on 2 acres adjacent upland. All work to
be done in accordance with the NYSDEC approved plan.
This permit will expire two years from the date it is signed if
work has not commenced by said date. Fees must be paid and permit
issued within six months of the date of this notification. Two
inspections are required and the Trustees are to be notified upon
completion of said project.
Please return to the Building Department for a determination on
the need for any other permits which may be required for this project.

The Department of State has completed its evaluation of your Federal
Consistency Assessment Form and certification that the above proposed permit
activity complies with New York State's approved Coastal Management Program,
and will be conducted in a manner consistent with this program.
Pursuant to 15 CFR Section 930.63, and based upon the project information
submitted, the Department of State concurs with your consistency certification
subject to the following condition that dredging subsequent to the first event
in 1989 shall not take place between April 1 and September 30.of any other
calendar year in order to prevent adverse impacts on least terns nesting in the
area
This concurrence is without prejudice to, and does not obviate the need to
obtain all other applicable licenses, permits, and approvals required under
exi'sting State statutes.
A copy of this decision has been sent to the Corps 'of Engineers.

GENERAL CONDITIONS
By acceptance of this permit,the permittee agrees that the permit is contingent upon strict compli-
ance with the ECL,all applicable regulations and the conditions specified herein or attached hereto.
I T he pr•rmntee shall rile in the office of the appropriate regional permit administrator,or other office designated in the special conditions,a notice of intention to commence
work at least 48 hours in advance of the time of commencement and shall also notify him/her promptly in writing of the completion of-the work.
2 -T he permitted work shall be subject to inspection by an authorized representative of the Department of Environmental Conservation which may order the work suspended i(
the public interest so requires pursuant to ECL§71-0301 and SAPA§401(3).

c) newly discovered information or significant physical changes are discovered since the permit was issued.

by the Department, no later than 30 days(180 days for SPDES or Solid or Hazarduous Waste Management permits)prior to the expiration date.

of March 15 to July 15 each year.
2. Spoil shall be placed directly into the conveyance vehicle & then transported immediately into soil

3. There shall be no dredging within 20' of any vegetated tidal wetland.
4. All dredged material shall be placed a minimum of 50' landward of the tidal wetland boundary.
5. A line of haybales shall be staked end to end along the seaward edges of the spoil areas. These
haybales shall remain in place until all spoil is dry and/or graded.
6. The use of a dragline for dredging adjacent to the vegetated tidal wetland is strictly prohibited.
7. There shall be no disturbance to vegetated tidal wetlands as a result of the permitted activity.
8. All-dredging shall be conducted so as to leave a uniform bottom elevation free of mounds or holes..
V,9. Within 30 days of completion of dredging operation a dredged survey shall be submitted to the Marine
Regulatory Section of the Bureau of Marine Habitat Protection.
10. During the dredging operation, the permittee and his contractor shall make every effort to restrict
spillage of sediment during excavation and haulage. Dredging shall be accomplished with a clam -
shell- or other closed 'bucket" equipment.
11. All dredged material shall be disposed on an upland site and be suitably retained so as to not re-
enter any waterbody or tidal wetland area.

Maintenance Dredging
Dear Mr.®'Berger :
We have been advised that the permit for subject application
has been mailed (not yet received ) , and that it contains a
condition that no maintenance dredgling can be accomplished
until after July 15th because of an "active" osprey nest .
To verify this year ' s use of this nest we asked a noted
biologist to inspect same . His inspection report is
enclosed .
As it now can be proven that the issued permit condition was
based on erroneous information , it is requested that the
permit ' s condition be modified with the time restriction
removed .
It is unfortunate that the applicant ' s use of their marina
'has been denied for an application made in November of 1988
that was for maintenance dredging , which had been previously
issued and had expired, and that the osprey platform in
question was not only on the applic,ant ' s property , but had
been erected by the joint efforts of the applicant and Paul
Stoutenburgh .
Your early and immediate corrective action would be greatly
appreciated .

The Southold Town Conservation Advisory Council made the following recommendations
at its regular meeting held Tuesday, March 9, 1989:
RESOLVED to recommend to the Southold Town .Trustees approval with stipulations
Wetland Application No. 12-7-88-81-1 of Paradise Point Association to maintenance
dredge 500 c.y. of materail from mouth of basin off Southold Town Harbor with
spoil to be placed as shown on submitted plan. The Council approves provided
the spoil is not placed in spoil area II (other side of bulkhead) and that the applicant
limit any spartina damage to an absolute minimum.
Basin Road, Southold.
RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application
No. 12-88-38.1-1-22 of Crescent Beach Condo Association to construct a fixed dock
150' x 41, a 10' x 3' ramp to a 6' x 20' float. -
Foot of Maple Lane, East Marion.
RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application
No. 1-5-139-1-21 of Zahra Benz to bulid (replace) catwalk, ramp and floating dock.
575 Westview Drive, Mattituck.
RESOLVED to recommend to the Southold Town Trustees approval with stipulations
VJetland Application No. 12-4-88-90-1-16 of Thomas Prokop to construct a boat dock,
retaining wall and floating dock. The Council recommends approval provided that
the applicant removes the pipe located at the side of the dock leading into the water.
The Council suggests applicant reroute to a drywell.
Little Peconic Bay Lane, Southold.
RESOLVED to recommend to the Southold Town Trustees .approval with a stipulation
of Wetland Application No. 3-1-89-23-1-14.6 of Anthony and Rosemary Bolletino to
construct accessory swimming pool and tennis court. The Council approves but has
serious concerns about the placement of the pool and its proximity to the ground-
water. The Council suggests that perhaps the applicant should be required to
build the pool with the bottom at least V above groundwater.
Main Road, East Marion.
The Council made an inspection of 79-5-20.5 (Ray Kerister) to determine whether
the project was within the .Trustees jurisdiction as requested by the Southold Town
Planning Board. The Council advises that the parcel contains freshwater wetlands
and marsh areas and is within the Trustees jursidiction. _ .

Dear Sir:
Pursuant to 15 CFR 930.58,' the following data and information is necessary
to enable the Department of State to adequately assess the coastal zone effects
of this proposed project.
1 . You are required to submit to this Department a copy of the completed
federal agency application (see FCAF-F1b). Please comply.
2. Please submit photographs of the dredge spoil sites, the areas to be
dredged (mean low water) and the wetlands adjoining these sites. The
aerial photograph is good but it is necessary to have ground
photographs showing perspective and the relationship between the
various sites.
3. The location is within the "state designated tidal wetland" area.
Please indicate what measures will be adopted so that there is minimal
disturbance to water quality, fish and wildlife habitats and the
adjoining wetlands.
4. How is the spoil for area 2 going to be contained to prevent it from
washing back into the channel?
5. What measures will be adopted to minimize the future accumulation of
sand within .the canal?
Pursuant to 15 CFR 930.60(a), the review of your consistency certification
will begin after we receive and determine that the necessary data and
information is adequate to assess coastal zone effects.
Any additional information which you believe will facilitate our
consistency review of this project would be appreciated.
