The Building Inspector's April 2 , 2026 Notice of Disapproval is based on an application to construct an accessory pool house and an accessory swimming pool at 2625 Bay Shore Road, Greenport. The proposed action has been reviewed to Chapter §268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is nay recommendation that the proposed action is INCONSISTENT with the policies of the LWRP as follows: Policy 1. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem. 6.1 Protect and restore ecological quality throughout the Town of Southold. 9 %..f C. Reduce adverse impacts on ecological quality due to development. 1. Reduce adverse effects of existing development. The proposed action is on a waterfront parcel, located along Pipe's Cove within the Board of Trustees jurisdiction. Town Code Chapter §275-2D(a)[5] requires a swimming pool and related structures to be 60 feet from the wetland boundary. To meet the wetland boundary setbacks, Town Code Chapter §28o-15F allows that accessory buildings and structures to be located in the front yard, provided that such buildings and structures meet the front yard principal setback requirements as set forth by this Code and the side yard setback requirements for accessory buildings in Subsection B. The proposed action is inconsistent with Policy 1, which states that the proposed action must foster a pattern of development in the Town and enhance community character. The proposed action does not enhance community character in that it exceeds the maximum lot coverage requirement by 12% and that the surrounding parcels do not have pools in their front yard. The proposed action also inconsistent with Policy 6.1 C.1., which calls for the reduction of adverse effects of existing development. The proposed overdevelopment of this waterfront parcel increases impervious surface coverage which reduces natural drainage causing adverse impacts to ecological quality. The proposed action has been reviewed to Chapter §268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. REASONS FOR BOARD ACTION DESCRIBED BEL �8 : On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: (1) Applicant testified that the prior and prospective owners of the property, J. and R. Gazzola, have selected a specific house design, and that this house cannot be built on this lot without the requested variance. (2) The requested front yard variance is modest, entailing a reduction of 2 feet from the required 40 feet, and a rear yard reduction of 5 feet from the required 50 feet. Applicant submitted evidence showing that the proposed 38-foot front setback is consistent with the existing houses on the block. For these reasons, grant of the requested front yard variance will not produce an undesirable change in the character of the'neighborhood or detriment to nearby properties. (3) The requested rear yard variance entails a reduction of 5 feet from the required 50 feet. The Board believes that a lesser reduction —that is, a greater rear setback— is feasible by means of a minor change in design. (4) A property owner to the rear of the subject property expressed concern about drainage onto his property.
