No. #8117 This application is a request for a variance from Article III Section §280-15. The Building Inspector's March 6, 2026 Notice of Disapproval is based on an application to construct an inground pool swimming pool, hot tub and generator accessory to an existing single- family dwelling at 990 Grand Ave, Mattituck, NY. The proposed action has been reviewed to Chapter §268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the policies of the LWRP as follows: Policy 6 Protect and restore the quality and function of the Town of Southold ecosystem. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction The proposed action is on a nonconforming waterfront parcel with a pre-existing residence that is less than 100ft from the wetland boundary of Long Creek. The proposed action is consistent with Policy 6.3A because the proposed pool meets the 60ft wetland setback for a swimming pool and related structures from Town Code Town Code Chapter §275-3D(a)[5]. In addition to the Zoning Board of Appeals variance, please note the proposed action is within the jurisdiction of the Board of Trustees and will require an approval of a wetland permit.
