COSTELLO TRUST, SCTM# 1000-35.-4-28.3 This application is to request a Wetland Permit to remove existing ±8' diameter octagonal gazebo, existing davit and two ladders, and 3' wide brick walkway; remove ±98' of existing bulkhead and construct ±98' of new vinyl bulkhead in-kind and in-place; reinstall existing davit and ladders; construct 4' wide decking using a tropical hardwood along entire front of bulkhead; place natural stone (approximately 14 cubic yards) on remainder of property; and replace existing ±8' diameter octagonal gazebo in-place. The proposed action has been reviewed to Chapter §268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with conditions with the policies of the LWRP as follows: Policy 6: Protect and restore the quality and function of the Town of Southold's ecosystem 6.3. Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction. This proposed action is on a nonconforming waterfront parcel along the wetland boundary of the Fordam Canal. The proposed materials labeled with CCA listed on Sheet 3 are inconsistent with the Policy 6.3.A because they do not comply with Town Code Chapter §275-11 Construction and Operation Standards, that state that CCA is a prohibited lumber preservative as stated below: B(1)(0 In order to prevent the release of metals and other contaminants into the wetlands and waters of Southold, the use of lumber pretreated with any preservative, including, but not limited to, chromated copper arsenate (also known as "CCA'), penta products, alkaline copper quaternary (ACQ), or homemade wood preservatives is prohibited for use in sheathing and decking on structures in the wetlands, as well as on any part of a structure in low-tidal-flow wetland areas as determined by the Trustees. Any use of creosote is prohibited. Preservatives of any type, including, but not limited to, those listed above, cannot be applied to any bulkheads, retaining walls or revetments after installation. Encapsulated pilings or native nonchemically treated (untreated) lumber only should be used in sensitive areas. The proposed construction of the in-kind and in-place replacement of the existing bulkhead is consistent with Policy 4.1 D(2) which states that a bulkhead can be found consistent if vegetative approaches to control erosion are not effective. In this case, a vegetative approach would not work because wave action would continue the erosion. This replacement complies with the Town Code §275-11 Construction and Operation Standards below: B(1)(a) Only in-place replacement of existing functional bulkheads (as defined in §275-2) is permitted. In-kind replacement relates to the position and dimensions and does not necessarily require or allow for the use of the same materials. At its discretion, the Board may allow for a one-time projection of the replacement structure seaward of the original, only if such placement will not project the proposed structure seaward of adjacent, neighboring structures and if the proposed installation is in close proximity to the original structure. Any 2 subsequent repair or replacement following the first replacement requires the structure to be built on or landward of the original structure, To be deemed consistent, the proposed materials would need to be replaced with materials compliant with Town Code Chapter§275-11 Construction and Operation Standards and for the proposed natural stone gravel to act as a nonturf buffer must be loose gravel that allows surface runoff into the soil beneath pursuant to Town Code Chapter §275-2 Definitions. The proposed action has been reviewed to Chapter §268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. 3 s Town of Southold LWRP CONSISTENCY ASSESSMENT FORM JUL 2 8 706 A.
