HERRICK REVOCABLE TRUST, SCTM# 1000-9.-11-7.16 This application is to construct a 5,280 sq. ft. two-story dwelling with a stormwater drainage system for roof runoff; install an I/A OWTS system; construct a 20'x28' detached dry garage; install water and electric service; construct approximately 200' of retaining wall; construct a driveway; and to regrade and stabilize all disturbed areas. The proposed action has been reviewed to Chapter §268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the policies of the LWRP as follows: Policy 6 Protect and restore the quality and function of the Town of Southold ecosystem. Policy 6.1 Protect and restore the quality and function of the Town of Southold ecosystem. B. Protect and restore ecological quality by adhering to the following measures. through the Town of Southold 2. Retain and add indigenous plans to maintain and restore values of nature ecological communities 6.3 Protect and restore tidal and freshwater wetlands A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction The proposed action is inconsistent with Policy 6 because it does not protect the quality and function of the wetland ecosystem on the parcel. The proposed action is inconsistent with Policy 6.1 B(2) because the proposed construction is too close to the wetland and doesn't do enough to protect the ecological quality of the land adjacent to the wetlands. The proposed two-story dwelling is inconsistent with Policy 6.3A because it does not comply with Town Code Chapter §275-3(D)(1)(a)[2] that states the setback for a residence is 100ft from the wetland boundary. To be deemed consistent, the proposed home and all associated construction should be shifted back to the 100ft wetland setback to comply with Policy 6.1 B(2) and Policy 6.3A. The proposed action has been reviewed to Chapter §268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. 2 Town of Southold Q513 IsOdaF2) JUL 2 B 2026 LWRP CONSISTENCY ASSESSMENT FORM SOUTHOLD TOWN PLANNING BOARD A. INSTRUCTIONS 1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold.Local Waterfront Revitalization Program. A proposed action will be evaluated as to its silo-'ficant beneficial and adverse effects upon the coastal area(which includes all of Southold Town). 3. If any question in Section C on this form is answered "yes" or"no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be explained in detail, listing both supporting and non- supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken.
