This application is to request a Wetland Permit and a Coastal Erosion Permit to remove
the existing wood stairs with ramp to beach; install 70 linear feet of vinyl bulkhead with
two 10' long returns that will connect to existing bulkheading; installation of 3"x10" CCA
timber face-sheeting armor members on face of vinyl bulkhead spaced 3" between
sheets for entire length of bulkhead; remove, replace and realign the existing rip-rap
armor stone seaward of new bulkhead but with no further seaward projection than
existing; install 40 cubic yards of clean sand fill within the area landward of the bulkhead
and install an 8'x50' un-treated timber deck on top of fill; and to install 3'x10' aluminum
seasonal steps to beach with two (2) 10" diameter CCA piles at seaward end to secure
aluminum steps in place.
The proposed action has been reviewed to Chapter §268, Waterfront Consistency
Review of the Town of Southold Town Code and the Local Waterfront Revitalization
Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my
recommendation that the proposed action is INCONSISTENT with the policies of the
LWRP as follows:
Policy 4 Minimize loss of life, structures, and natural resources from flooding and
erosion,
4.1 Minimize losses of human life and structures from flooding and erosion hazards.

Policy 6: Protect and restore the quality and function of the Town of Southold's
ecosystem
6.3. Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction.
This proposed action is on a nonconforming lot with a pre-existing residence that is less
than 100ft from the wetland boundary of the Long Island Sound.
The proposed replacement of the existing rip-rap armor stone can be defined as a rip
rap revetment pursuant to Town Code Chapter §268-3 Definitions:
REVETMENT
A shoreline hardening structure landward of the wetland boundary typically
constructed of rock or stone. See "gabion."
The proposed new second bulkhead on the parcel is inconsistent with Policy 4.1.D.5.a
because there is already an existing bulkhead and rip-rap revetment on the property.
Additionally, the proposed CCA timber material does not comply with Town Code
Chapter §275-11 Construction and Operation Standards, as stated below:
B. Shoreline structures. The following standards are required for all operations
relating to shoreline structures on residential properties.
(1) Bulkheads, retaining walls, revetments and gabions.
(0 In order to prevent the release of metals and other contaminants into
the wetlands and waters of Southold, the use of lumber pretreated with
any preservative, including, but not limited to, chromated copper arsenate
(also known as "CCA'), penta products, alkaline copper quaternary
(ACQ), or homemade wood preservatives is prohibited for use in
sheathing and decking on structures in the wetlands, as well as on any

part of a structure in low-tidal-flow wetland areas as determined by the
Trustees. Any use of creosote is prohibited. Preservatives of any type,
including, but not limited to, those listed above, cannot be applied to any
bulkheads, retaining walls or revetments after installation. Encapsulated
pilings or native nonchemically treated (untreated) lumber only should be
used in sensitive areas.
The proposed deck addition is inconsistent with Policy 6.3.A, which states compliance
with Chapter 275 because the proposed structure brings the residence closer to the
wetland boundary, and makes the house location even more nonconforming.
The proposed in-kind replacement of the original bulkhead alone is consistent with
Policy 6.3.A and is compliant with Town Code Chapter §275-11(13)(1)(a) which states,
only in-place replacement of existing functional bulkheads (as defined in §275-2) is
permitted. In-kind replacement relates to the position and dimensions and does not
necessarily require or allow for the use of the same materials.
The proposed action has been reviewed to Chapter §268, Waterfront Consistency
Review of the Town of Southold Town Code and the Local Waterfront Revitalization
Program (LWRP) Policy Standards.

1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area{which includes all of Southold Town).
3. If any question in Section C on this form is answered "yes" or"no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each awww must be explained n detail listing both supportiuu and non-
sun orting faets. If an action cannot be certified as consistent with the LWRP policy standards and
conditions,it shall not be undertaken.
