Main Rd. &Youngs Ave.) Southold, NY 11971 Telephone: 631 765-1938 LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD To: Glenn Goldsmith, President Town of Southold Board of Trustees Cc: Honorable Lori Hulse, Attorney From: Heather Lanza, AICP, Planning Director LWRP Coordinator Date: August 10, 2026 Re: LWRP Coastal Consistency Review ALLISON TUPPER, SCTM #1000-87.-3-41 This application is to remove existing concrete bulkhead and returns, and replace with 96 linear foot long vinyl bulkhead with two 8 liner foot long vinyl returns in same location as existing; replace existing steps to water with new 5'x5' steps; and to establish and perpetually maintain a 10' wide vegetated non-turf buffer along the landward edge of the new bulkhead. The proposed action has been reviewed to Chapter §268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with conditions with the policies of the LWRP as follows: Policy 6: Protect and restore the quality and function of the Town of Southold's ecosystem 6.3. Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction. The proposed materials labeled with CCA listed on Sheet 3 are inconsistent with the Policy 6.3.A, which states compliance with the Board of Trustees'jurisdiction because they do not comply with Town Code Chapter §275-11 Construction and Operation Standards, that state that CCA is a prohibited lumber preservative as stated below: B(1)(0 In order to prevent the release of metals and other contaminants into the wetlands and waters of Southold, the use of lumber pretreated with any preservative, including, but not limited to, chromated copper arsenate (also known as "CCA'), penta products, alkaline copper quaternary (ACQ), or homemade wood preservatives is prohibited for use in sheathing and decking on structures in the wetlands, as well as on any part of a structure in low-tidal-flow wetland areas as determined by the Trustees. Any use of creosote is prohibited. Preservatives of any type, including, but not limited to, those listed above, cannot be applied to any bulkheads, retaining walls or revetments after installation. Encapsulated pilings or native nonchemically treated (untreated) lumber only should be used in sensitive areas. The proposed removal and replacement of the existing bulkhead is consistent with Policy 4.1 D(2) and 4.1 D(6) which states that a bulkhead can be found consistent if vegetative approaches to control erosion are not effective. In this case, a vegetative approach would not work because there is already a bulkhead there. In accordance with Policy 4.1 D(6), a 10 ft vegetated non turf buffer has been included in the project design; however, it is recommended to be expanded to a 15 ft vegetated non turf buffer to be effective and to be consistent with this policy because the entire parcel is located in the FEMAAE Flood Zone. To be deemed consistent, the proposed materials would need to be replaced with materials compliant with Town Code Chapter §275-11 Construction and Operation Standards. The proposed action has been reviewed to Chapter §268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. 2 Town of Southold LWRP CONSISTENCY ASSESSMENT FORM �1'1.6 A. INSTRUCTIONS -oaRo PLA� 1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency; *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area(which includes all of Southold Town), 3. If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be explained in detail, listing both supporting and non- supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken.
