Appeal 720 dated 11-5-64 approved garage in the front yard (25 front yard s : ecsived 5 `from side yard) AUG 1 '8.2026 (Please be sure to research before completing this question or call our off ce for assist- n9 Boaro o' Appeals Page 2, Area Variance Application Revised 6/2023 REASONS FOR APPEAL (Please be specific,additional sheets may be used with preparer's signature notarized): 1.An undesirable change will not be produced in the CHARACTER of the neighbor or a detriment to nearby properties if granted,because:The house is preexisting nonconforming with small additions and alterations made over the last 50 years. Every change proposed to the preexisting nonconforming house necessitated a variance. The previous variance(7975) approved a side yard setback for the"as built"deck(14.71),the sauna which sits on the deck. The deck is also an egress (door)for the below grade(basement)bedroom. The lot coverage of existing structures(including the approved below grade deck)is.6% over the 20% lot coverage (20.6%). However,lot coverage(the original applications requested(25.3%)was not granted, the.6 is the lot coverage for the existing structures. This might have been an oversight when the deck(with the sauna sitting on the deck)was granted the 14.7 side yard setback(appeal 7975)excluding the lot coverage variance needed to keep the structure. We ask that the.6 lot coverage deck,with the sauna,be granted. In addition to the deck/sauna,the applicant wishes to build a V2 bathroom at the entry of the house and outdoor shower by the pool. The only bathroom on the first floor is adjacent to the bedrooms. A'/Z bathroom on the main level is desirable for many reasons. The only bathroom on the main level is in the bedrooms. Bedrooms should be private. Also,from the pool, children(and adults)run through the house with wet feet, up the stairs,through the kitchen, into the bedrooms to access the main floor bathroom. Alternatively,wet feet go down the stairs to the lower level. A hazardous situation.Because the existing house and existing pool deck is above grade,the V2 bathroom and outdoor shower addition/modification to the existing house affects the lot coverage. This bathroom is accessible for the existing pool and jacuzzi located in the front of the house. Also proposed is a 4' extension to the walkway between the existing deck(front of house)and proposed outdoor shower(minimal walkway circulation). The bathroom addition(80 sf) and the proposed deck addition(84 sf),in total this addition increases the footprint of the house by 1.3% 16( 5 SF). (The deck at 14.7 from the property line from appeal 7975 is.6% lot coverage and the bathroom and outdoor shower is 1.3% lot coverage;the total rggu2sted lot covera a is 21.90/6) A very modest addition and minimal lot coverage. The buildable area landward of the CEH line is 23,007 sf on a lot that is in fact 37,291 sq.ft. The requested variance will not change the character of the neighborhood or detriment to nearby properties. The house is heavily vegetated. There is complete privacy, there is no view between neighbors or to the street,the lot coverage request would not be visually obvious from any property line. The lot coverage variance of 1.9% it is not visually noticeable. The house is constructed on two levels and hidden from view from any property lines. The proposed work is in front of the house and does not affect the bluff or violate any setbacks. The lot coverage increase requested is very modest,and a very small addition(80 sf)to the existing house. F � 2. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance,because: the bathroom addition is roposed betty en. the mud room(seasonal)and the house. The plumbing and other utilities are a. basement and designed within an opening of the existing structure because it does not interfere with existing window openings. The bathroom addition is tucked into the space betm6al 7 sunroom and the existing house.(between existing walls) 3.The amount of relief requested is not substantial because: only 1.9%over the pew®�o`dotof -Ap. �s coverage is proposed. The lot size is 37,291 SF 2 007 buildable). 1.9% over the 20% lot coverage is a minimal variance request. The request includes a 1/2 bathroom,however the balance of the structures are open (outdoor shower and stoops or platforms). 4.The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The requested alterations to the existing house are in the front yard. The agency technician observed the bluff face has a significant angle between the top of the bluff and the toe and exceeds the recommended maximum 1:3 ratio, but the bluff is stable and in good condition. Although the bluff face is sufficiently stabilized with an estimated 85% of vegetated cover, there are a few areas of concern that should be addressed to ensure the bluffs long-terra protection. It is recommended that the property owner consult with a licensed Professional Engineer that is qualified and experienced to remediate' and stabilize the bluff. In addition to stabilization of the bluff,runoff control measure are recommended to capture and covey runoff away from the bluff. SUF_FOLK COUNTY ADMaISTRATWE COD This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated October 10, 2024, stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. In addition,the agency commented that no stormwater runoff shall result from.the proposed development and site improvement and shall not be discharged into the adjoining body of water. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated December 18, 2025. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department,as well as the records available,it is recommended that the proposed action is INCONSISTENT with LWRP policy standards, (Policy#1) and therefore is INCONSISTENT with the LWRP. The structures were constructed without obtaining required permits, the proposed lot coverage exceeds the percentage permitted and does not minimize adverse effects of development in a coastal location. Furthermore, the 3.4 feet setback of the deck from the top of the bluff is not supported by LWRP Policies 1 and 4, indicating that it should not be placed seaward of the Coastal Erosion Hazard Area. The Board upholds the determination of INCONSISTENCY for the proposed lot coverage and as built accessory deck in the Coastal Erosion Hazard Area but determines that, with the conditions imposed herein, the as built seaward deck addition and deck and sauna in the side yard can be mitigated to make them conforming with the LWRP. AMENL)ED APPLICATION: During the hearing,the applicant was asked to reduce the degree of variance relief requested and bring the plan into more conformity with the code. The applicant submitted a revised Site Plan and Architectural Plans dated January 20, 2024,reducing the size of the proposed garage to 825 sq. ft. and lot coverage from 25.3% to 25%, resulting in a lot coverage still measuring well over the maximum code permitted 20%. ADDITIONAL ITIONAf INFO 'ION:The applicant will be required to apply to the Southold Town Board of Trustees for approval of a Wetland Permit. The subject property has the benefit of prior relief granted by the ZBA for a variance for a deck,mudroom and coat closet addition to the single-family dwelling with a bluff setback of 84.3 feet in ZBA#7277 dated May 23,2019 and in ZBA#7106 a variance was granted for additions and alterations to the single-family dwelling with a bluff setback of 57 feet.The applicant's agent submitted a survey by John Metzger dated October 16, 2012 and stamped received by the Building Department Town of Southold dated July 26,2017 which shows the existence of the accessory deck located at the top of the bluff and in the Coastal Erosion Hazard Area. However,no documents legalizing this deck were found. FINDINGS OF FACTI REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on January 9,2025 at which time written and oral evidence were presented. Potential adverse impacts for the non- conforming bluff setback of the attached seaward deck addition can be mitigated by the conditions imposed herein. Grant of the variances requested for the excessive lot coverage and accessory deck and pergola at the top of the bluff and in the Coastal Erosion Hazard Area will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. No previous approvals for comparable excessive lot coverage or accessory decks at the top of the bluff were submitted to suggest that these non- conformities are characteristic of the subject neighborhood. Structures located in the CEHA and excessive lot coverage are INCONSISTENT with LWRP Policies and pose a threat to the preservation of a naturally regulated feature such as the bluff and do not minimize the adverse effects of overdevelopment in a coastal location. 2. Town Lary 267-b 2 . The benefit sought by the applicant for the side yard setback and bluff setback for the attached seaward deck addition cannot be achieved by some method, feasible for the applicant to pursue, other than area variances. The deck in the side yard is in place and the required relief is de minimus. The subject dwelling has a non-conforming bluff setback so any additions on the seaward side of the dwelling will require variance relief. The benefit sought by the applicant for the excessive lot coverage and bluff setback for the accessory deck and pergola can be achieved by some method,feasible for the applicant to pursue, other than area variances. The applicant can further reduce lot coverage by removing'some deck area and,further reducing the size of the proposed three car garage in the conforming front yard. Additionally, the wood accessory deck and pergola can be replaced with permeable at grade pavers for sitting area along the top of the bluff. 3. Town 1&w 67-bQ)(b)( ). The variance granted herein for the side yard setback is de minimus in nature as it measures less than 1 inch (0.3 inches)from the code required setback. The variance granted herein for the bluff setback to the deck addition is mathematically substantial representing 20.5% relief from the code,but will be mitigated by the conditions imposed herein for the establishment of a non-turf buffer along the top of the Coastal Erosion Hazard Line and the approval of.the Southold Town Board of Trustees. 4. T wn Law "2674 b 4 .No evidence has been submitted to suggest that a variance in this residential community for the side yard setback to an attached deck with sauna and the bluff setback to an attached seaward deck addition will have an adverse impact on the physical or environmental conditions in the neighborhood.The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and the conditions of approval imposed herein. Evidence has been submitted to suggest that a variance in this residential community for an accessory deck and pergola at the top of the bluff and in the Coastal Erosion Hazard Zone and excessive lot coverage will have an adverse impact on the physical or environmental conditions in the neighborhood.Excessive lot coverage and structures along or in naturally regulated features, such as their being in the Coastal Erosion Hazard Area, contribute to erosion and hazardous conditions during severe storm events and are not consistent with the Town's LWRP policies. 5.
