This application is a request for a variance from the Chapter §280 Bulk Schedule. The
Building Inspector's February 20, 2026 Notice of Disapproval is based on an application
to legalize an "as built" roof over a carport to an existing single-family dwelling at 1350
Ole Jule Lane, Mattituck, NY.
The proposed action has been reviewed under Chapter §268, Waterfront Consistency
Review of the Town of Southold Town Code and the Local Waterfront Revitalization
Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my
recommendation that the proposed action is INCONSISTENT with the policies of the
LWRP as follows:
Policy 6: Protect and restore the quality and function of the Town of Southold's
ecosystem
6.3. Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold
Town Board of Trustees laws and regulations for all Andros Patent and
other lands under their jurisdiction
The proposed action is inconsistent with Policy 6.3.A because the garage roof
expansion was built without regulatory permits.
If all regulatory permits are obtained, the proposed action could be deemed consistent
under the LWRP policies below:
The proposed action is consistent with Policy 4.1.A which calls to locate development
and structures away from flooding and erosion hazards. The proposed roof expansion is
not located within the high-risk FEMAAE flood zone on the west side of the property.
Although the proposed action is on a lot with a nonconforming pre-existing residence, it
is consistent with Policy 6.3.A, which states that actions must comply with the Southold
Town Board of Trustees' laws and regulations. The proposed construction is attached
landward of the existing building footprint and complies with Town Code Chapter §275-
5(2)(c) which states construction of additions to the landward side of an existing
functional single-family dwelling, where such dwelling generally lies parallel to the
wetland boundary and provided that all new and existing runoff is captured on site. Such
addition must be less than or equal to 25% of the area (footprint) of the existing
structure.
In addition to the Zoning Board of Appeals variance, please note the proposed action is
within the jurisdiction of the Board of Trustees, and requires the approval of a wetland
permit.
The proposed action has been reviewed under Chapter §268, Waterfront Consistency
Review of the Town of Southold Town Code and the Local Waterfront Revitalization
Program (LWRP) Policy Standards.
