SCTM No. 1000-9-6-4. t . Page 2, August 20, 2026 #8118 Andrew Shannon SCTM No. 1000-9-6-4 RELIEF REQUESTED: The applicant requests variances to rebuild the existing southwest wing of the dwelling, increasing its footprint by 63 square feet; remove the existing rear (southeast) screened porch; construct a new screened porch on the southwest side, and add a new covered porch on the southwest side, resulting in gross floor area of 2446 square feet where the Town Code Article XXXVI Section 280-207A(1)(a)allows a maximum of 2100 square feet for lots under 10,000 square feet; and a front yard setback of 15.5 feet and lot coverage of 29.6% where Town Code Article XXIII Section 20-124 requires a minimum front yard setback of 35 feet and maximum lot coverage of 20%for lots measuring less than 20,000 square feet, all as shown on page 2 dated March 23,2026 of the architectural drawings prepared by Samuel William Fitzgerald, Registered Architect, titled, "Zoning Variance Application Proposed additions to existing non-conforming residence, Andrew & Katherine Shannon Residence," with coversheet dated March 2,2026. ADDITIONAL INFORMATION: The application included architectural drawings titled, "Zoning Variance Application Proposed additions to existing non-conforming residence, Andrew & Katherine Shannon Residence," prepared by Samuel William Fitzgerald, Registered Architect, with coversheet dated March 2, 2026 showing an exterior view of the existing and proposed dwelling; Sheet 2 dated March 23, 2026 showing site plans for full lot area and buildable lot area; Sheets 3 and 3a dated March 2, 2026 with aerial photographic views looking southeast and north and corresponding isometric renderings from the same perspectives for the existing and proposed dwelling; Sheet 4 dated March 2, 2026 with photos from four directions and a diagram indicating reference points for each; Sheet 5 dated March 2, 2926 with existing and proposed basement, first floor, and second floor plans; and sheet 6 dated March 2, 2026 showing existing and proposed north, west, and south elevations. The property has the benefit of four Certificates of Occupancy: No. 35027 dated June 27, 2011 pursuant to Building Permit No. 36272 dated March 29, 2001 for alterations to an existing one family dwelling; No. 35009 dated June 22, 2011 pursuant to Building Permit No. 36274 dated March 29, 2001 for alteration to an existing accessory garage; No. 30934 dated May 26, 2005 pursuant to Building Permit No. 31143 dated May 18, 2005 for deck addition to existing single family dwelling; and Pre-existing CO No. 26126 dated November 20, 1998 for a one family dwelling with accessory guest cottage. During the August 6, 2026 Public Hearing, the applicant was requested to provide examples of prior ZBA decisions granting relief for gross floor area and lot coverage in the neighborhood. On August 18, 2026 the applicant's representative provided two prior ZBA decisions in the neighborhood, No. 7938 from 2024 granting 10% relief for GFA for a parcel on Ark Hill Road and No. 139 from 1959 granting a front yard setback variance due to the steep topography of the parcel. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August 6, 2026 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law W7-W)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The house was built in the 1880s, the existing front yard setback is just 8.5 feet, the proposed project does not decrease this, and this existing setback is larger than several other structures in the neighborhood. The existing lot coverage is 27.5%and the existing GFA exceeds the permitted t Page 3, August 20, 2026 #8118 Andrew Shannon SCTM No. 1000-9-6-4 maximum by 102 square feet. While the proposed project grows the lot coverage to 29.6%and the GFA exceedance to 345 square feet, the house will still be similar in size and scale to other houses in the neighborhood. 2. Town Law V67-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing front yard setback, lot coverage, and gross floor area are all nonconforming, so any addition or,alteration would require variance relief. 3. Town Law V67-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 55.7% relief from the code for the front yard setback, 48% relief from the code for the lot coverage, and 16.5%relief from the code for the gross floor area. However, the existing front yard setback is 8.5 feet so the proposed 15.5 foot front yard setback to a covered, open entry porch does not increase the nonconformity, and two other dwellings and two accessory structures in the immediate neighborhood have front yard setbacks less than the subject dwelling; the existing lot coverage is 27.5% and the proposed increase is modest at 2.1 percentage points; and the existing nonconforming gross floor area is 2202 square feet and the increase of 244 square feet is largely due to a screened porch addition that replaces a smaller porch in the rear thereby increasing the structure's setback from the wetland. 4. Town Law V67-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law U67-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a rebuilt and modestly expanded southwest wing and new screened porch while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Steinbugler, seconded by Member Planamento, and duly carried, to GRANT the variances as applied for, and shown on the architectural drawings titled,"Zoning Variance Application Proposed additions to existing non-conforming residence, Andrew & Katherine Shannon Residence," prepared by Samuel William Fitzgerald, Registered Architect, dated March 2, 2026 and with sheet 2 dated March 23,2026. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The septic system on the subject property must be approved by the Suffolk County Department of Health Services. 2. The applicant shall apply to and obtain approval from the Town of Southold Board of Trustees for the additions. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals, failure to comply with the above conditions may render this decision null and void. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Page 4, August 20,2026 #8118 Andrew Shannon SCTM No. 1000-9-6-4 The Board reserves the right to substitute a similar desien that is de minimis in nature for an alteration that does not increase the degree of nonconformity, provided de minimis relief is requested within one year of the date of this decision. Any time after one year, the Board may require a new application.. IMPORTANT LIMITS ON THE APPROVALS) GRANTED HEREIN Please Read Carefully Any deviation from the survey, site plan and/or architectural drawings cited in this decision, or work exceeding the scope of the relief granted herein, will result in delays and/or a possible denial by the Building Department of a building permit and/or the issuance of a Stop Work Order, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)grantedherein as shown on the architectural drawings, siteplan and/orsurvey cited above, such as alterations, extensions, demolitions, or demolitions exceeding the scope of the relief granted herein, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. TIME LIMITS ON THIS APPROVAL: Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk, within three(3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms. IT IS THE PROPERTY OWNER'S RESPONSIBILITY TO ENSURE COMPLIANCE WITH THE CODE REQUIRED TIME FRAME DESCRIBED HEREIN. Failure to comply in a timely manner may result in the denial by the Building Department of a Certificate of Occupancy, nullify the approved variance relief, and require a new variance application with public hearing before the Board of Appeals. The applicant is seeking to: 1) rebuild the existing two-story west wing of the house, with a slight 63 sq. ft. increase to the existing building footprint(of which 38 sq. ft. is within the required front yard). 2) construct a new 236 sq. ft. screened porch, of which 63 sq. ft. is within the required front yard; 3) construct a new open covered porch of 36 sq. ft., within the required front yard. There will be no substantial visual difference from the pubic road between the existing and improved house. The new additions are modest and will be seamlessly integrated into the architecture of the existing house. The height, scale and overall massing of the house will not change. The additions will not be visible from either of the abutting neighbors to the east and west, and otherwise have no detrimental impact on other nearby properties. L.The benefit sought by the applicant CANNOT be achieved by some method feasible for tite applicant to pursue, other than an area variance, because: Any work to a portion of an existing structure with existing zoning non-conformity must go through the variance process. 3.The amount of relief requested is not substantial because: There will be no increase in front yard setback nonconformity as a result of this work. The actual increase to the building footprint within the required front yard will be modest (137 sq. ft.). The lot coverage and GFA relief being sought is also modest -- 2% lot coverage increase, and 244 sq. ft. floor area increase. 4.The variance will NOT have an adverse effect or impact on the physical or CM,ironrnental conditions in the neighborhood or district because: No adverse impact. This application calls for removing an existing screened porch that is close to the pond's edge, which should have a positive environmental impact. No new encroachment toward the pond is proposed. Otherwise, the proposed additions constitute a modest expansion of the building footprint, with no adverse environmental effect. No increase in traffic as a result of this work. i. Has the alleged difficulty been self created? { 1 Yes, or X No Why: The current house is existing non-conforming in every respect that would impact building expansion. It is not possible to add any lot coverage or floor area -- however modest--without seeking a zoning variance. Are there any Covenants or Restrictions concerning this land? However, I did find one GFA variance very close by and it happens to be one I did. Also attached is another variance that I think is relevant to the Shannon application but is not lot coverage or GFA. I reference this variance in the letter. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a nonconforming 24,250 square foot parcel located in the R-40 Zoning District. The northerly property line measures 156.71 feet, the easterly property line measures 156.37 feet, and is adjacent to Private Road(Ark Hill Road)which intercepts to Upper Shingle Hill Road to the east. The property line continues southeasterly 13.66 feet and 90.78 feet to the southwesterly point that measures 49.61 feet(pie shaped property). The westerly property line measures 134.93 feet and is adjacent to Lower Shingle Hill Road, and the northwesterly line measures 24.81 feet and 80.66 feet. Alias shown on the survey map prepared by Craig Bigger, LS and dated June 10, 2022. The existing single-family residence was destroyed by fire in June of 2021. BASIS OF APPLICATION: Request for Variances from Article XII,Section 280-18;Article XXXVI,Section 280- 207; Article XXIII, Section 280-124 and the Building Inspector's April 4, 2024, amended September 26, 2024, Notice of Disapproval based on an application for a permit to construct a new two story single family dwelling with a screened porch, terrace, covered porches and decks; 1) located less than the code required minimum secondary front yard setback of 25 feet; 2) located less than the code required minimum rear yard setback of 50 feet; 3) gross floor area exceeding permitted maximum square footage for lot containing up to 30,000 square feet in area;4)more than the code permitted maximum two stories;located at:358 Ark Hill,Fishers Island,NY. SCTM No. 1000-9-1-4. RELIEF REQUESTED: The applicant proposes to construct a new two-story single-family dwelling with screened porch, terrace, covered porches and deck additions and requests variances for the following: 1. Secondary front yard of 10.4 feet where a 25 feet setback is required. 2. A rear yard setback of 10 feet where 50 feet is required. 3. The.proposed construction has a calculated Gross Floor Area of 5,130 sq.ft., exceeding the permitted GFA of 3,790 sq.ft. by 1,340 sq. ft. 4. The elevations show the structure exceeds the permitted sky plane. Page 2,November 21,2024 #7938,Bungalow 12,LLC SCTM No. 1000-9-1-4 AMENDED APPLICATION: During the hearing, the applicant was asked to bring the plan into more conformity with the code. The applicant on September 5,2024, submitted plans showing the following changes as per Revised NOD dated September 26,2024: 1. A reduction of Gross Floor Area by approximately 1,000 sq.ft. 2. Increase in the setbacks of the secondary front yard(reduced the non-conformity). 3. The rear yard setback relief at 10 feet shall remain as originally cited. 4. The Notice of Disapproval currently lists the existing third floor requiring variance relief. An addition of a landing/lookout room attached to the third story exterior deck that sits in the stair tower. In addition to the aforementioned amendments, changes include the elimination of relief required for sky plane and the reduction of lot coverage. ADDITIONAL INFORMATION: The prior dwelling destroyed by fire existed on this nonconforming parcel with non-conforming secondary front and rear yards on this undersized lot. The applicants wish to build a new residence on this property. The original hearing was held on September 5, 2024, and the applicant was asked to amend the application to reduce the variance relief needed for this structure. Asper testimony by the applicant's architect at the November 7, 2024 hearing, the applicant amended the original plans, and the revised plans show a lower GFA that was accomplished by lowering both square footage and ceiling heights from the original application. Additionally, in this application there is a lookout room attached to the allowable third story exterior deck. This space is 126 square feet, and it remains open to below, and is basically a large landing in the stair tower that is used as access to the exterior roof deck. In spite of NYS building code not requiring it,the whole house will have a fire suppression system installed. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 5,2024,and again on November 7,2024 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The property had an existing residence which was destroyed by fire, and a proposed new dwelling was subsequently granted variance relief for reconstruction. During that time, the property was acquired by new owners, and a new residence is currently being proposed. The proposed residence is to be smaller than the original, with massing in compliance with new zoning regulations. Therefore, the proposed residence will not change the character of the neighborhood. 2. Town Law V67-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method feasible for the applicant to pursue, other than an area variance. Due to the constraints of the site, and its irregular shape, any proposed residence would need some sort of variance relief. The proposed residence,as amended,is far smaller than both the original house that was destroyed by fire, and the previously approved proposed new replacement dwelling, in addition to the new dwelling originally submitted with this application. This amended proposal brings the house into more conformity with the code, and due to the changes in the plans mitigates the relief sought from the code. 3. Town Law V67-b(3)(b)(3). The variances granted herein are mathematically substantial; 1. The secondary front yard setback of 10.4 feet represents a 58%relief from the code. 2. The rear yard setback of 10 feet represents 80%relief from the code. Page 3,November 21,2024 w #7938,Bungalow 12,LLC SCTM No. 1000-9-1-4 3. The Gross Floor Area proposed is 4,191 sq.ft.represents a 16%relief from the code. 4. The proposed third floor look out area represents a 100%relief from the code. However, the proposed residence for this site will be more code conforming than the previous residence lost in fire, and also the replacement dwelling that was previously approved for the former owners. The proposed residence will also have a new sanitary system, and a new code conforming sprinkler system. These two things will mitigate any environmental issues, and also fire issues for the residence. There is no increase in non-conformity with the front yard setbacks, and the proposed encroachments are typical for this neighborhood. All of the abutting properties will benefit from having the proposed residence pushed closer to the rear property line, away from the public rights of way. Finally, the proposed third floor is only a 126 square foot platform that is slightly larger than a code permitted landing. It is proposed to be open to below, inside a stair tower, and will serve as a lookout space that is used as access to the code permitted exterior roof deck. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and the conditions of this board. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new residence while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Box 1179 Southold, NY 11971 RE: #8118---Andrew & Katherine Shannon 1950 Equestrian Avenue Fishers Island, NY 06390 9-6-4 Dear Ms. Weisman, As a follow-up to the August 6th public hearing, the board asked that we provide examples of prior relief for lot coverage and GFA in the vicinity of the subject property. As mentioned in the hearing, the Shannon house and property fall well within the existing character and density of the neighborhood. When the house was built in the 1880's, the house and property conformed to today's code in lot coverage and GFA. However, close to 100 years after the house was built, a pond developed in the back yard that has reduced the buildable land and has now made the existing house non-conforming in lot coverage and GFA. I found no properties in the vicinity that were granted lot coverage relief. And that makes sense: most all of the lots in the neighborhood fall well under the maximum lot coverage. It is only this specific lot with the manmade pond that artificially reduces the lot size and makes conforming to lot coverage impossible. This problem is unique to this property.* I found one property in the vicinity that was granted GFA relief: 11/21/24 #7938 9- 1 -4 Bungalow 12, LLC 358 Ark Hill Road, Fishers Island Distance from Shannon's: 3/8 mi GFA variance granted, a 10% relief from the code. This was a lot that was way undersized for its zone, so somewhat analogous to the Shannon's buildable land problem. I found one variance approval that is not related to lot coverage or GFA but I believe is relevant to the Shannon's application: 3/13/59 #139 9-5-- 2 Zanghetti, Mario 265 Crescent Avenue, Fishers Island Distance from Shannon's: 1/3 mi. Front yard setback variance granted due to unique topographical circumstances This applicant was seeking front yard setback relief due to the very steep topography on the property. The board found that"strict application of the Ordinance would produce undue hardship because the hardship was unique and not shared by all properties in the immediate vicinity..." The variance "does observe the spirit of the Ordinance and would not change the character of the district..." In a very similar way, the hardship created by the manmade pond on the Shannon property is unique and not shared by any other properties. This is the only property in the neighborhood with significantly skewed lot coverage and GFA requirements based on artificially created physical conditions.* *There is one other property that this pond encroaches on—the Carney property abutting on the east-- but it is not a significant encroachment. While the pond on the Shannon property reduces the buildable land by 5,400 sq. ft., the pond on the Carney property covers only 200 sq. ft. and has no significant impact on lot coverage or GFA calculations. Even more self-evidently true than with the Zanghetti variance, there is no change to the character of the neighborhood as a result of this application. This house and the neighborhood existed and were fully formed and established decades before the pond was created. Thank you very much for your review of this application.
