The lot is less than 90' wide and 90' deep with pre-existing non-conforming front and rear setbacks. The project contemplates the construction of a modestly sized home with a conforming gross floor area of 2,044 SF. The proposed construction is conforming to the side yard setback and sky plane regulations in the Code. Due to the constrained size and depth of the parcel, the reconstruction of this reasonably sized home to accommodate their family's needs and the achieve 21s1 century living standards, necessitates relief from the 35-foot front and rear yard setback and 20% lot coverage requirements in Section 280-124 of the Town Code to permit a front yard setback of 18.9 feet, a rear yard setback of 29 feet and lot coverage of 22%. . It is noteworthy that the ZBA granted prior rear yard setback relief to permit the construction of the existing deck about 29' from the rear property line (See ZBA #3038) and the proposed rear yard construction consists primarily of a covered porch to replace the deck for access to the rear of the home. For the following reasons, the Applicant submits that variances from the requirements of Sections 280-124 is warranted. 1. An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because: As the Board has acknowledged in prior Determinations, the hamlet of New Suffolk is one of the oldest existing developed parts of the Town of Southold and contains many homes built prior to zoning that have less than compliant front and rear yardsetbacks. The Board has also noted that many of the residences in the community of New Suffolk are small lots similar to the instant lot and many homeowners have expanded the original small dwellings to meet the standards of today. There have been many instances where these modest expansions of small homes have triggered the need for setback and lot Received AUG 2 7 coverage relief and the ZBA has granted.such relief in recognition oft"g Board of Appeals constraints of limited lot area. In fact, the Board has found that excessive lot coverage is common in New Suffolk. The Applicant directs the Board's attention to the following prior Determination where setback and lot coverage relief was granted to nearby property owners under various facts and circumstances. ZBA # 5522 (2004) - Relief granted to allow 23.9% lot coverage to remain; ZBA # 6462 (2011) - Relief granted for 26% lot coverage and 24' rear yard setback ZBA # 7392 (2020) - Relief granted for 23.9% lot coverage and 22' front yard setback ZBA # 7830 (2023) - Relief granted for 27.18% lot coverage and 7'8" front yard setback (with reference to prior precedent for lot coverage relief) ZBA # 7929 (2024) - Relief granted for 24% lot coverage. As noted, the facts and circumstances underlying each of these Determinations are not entirely analogous to the instant matter but they establish that reduced setbacks and excessive lot coverage are consistent with the character of numerous homes in New Suffolk and as such, the Applicant submits that the granting of relief will not produce an undesirable change in the character of the neighborhood nor a detriment to nearby properties. 2. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: The Applicant is seeking the benefit of expanded and upgraded living space to meet the needs of 21st-century living. While they are proposing to construct a house that is conforming to GFA, sky plane and side yard setback regulations, the limited depth and lot area of the parcel necessitates front and rear setback and lot coverage relief. 3. The amount of relief requested is not substantial because: The Applicant submits that rear yard setback relief is not substantial since similar relief was previously granted to the Applicant's predecessor in title. While the magnitude of relief sought for the front yard relief may be mathematically substantial, it is not practically substantial since the house will be constructed substantially within the pre-existing non-conforming front yard setback and the majority of the relief required is for an open air front porch for access to the home. The lot coverage relief is only 10% which is not significant Page 2 of 3 Received AUG 2 7 2026 in comparison to the existing lot coverages of many nearby parcels in New Suffolk. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The Applicant will be updating the sanitary system and implementing best practices for stormwater management in accordance with Chapter 236. The granting of variance relief will not have an adverse impact on the physical conditions in the neighborhood and will permit the construction of a functional two-story home that is entirely consistent with the size and character of neighboring homes. In addition, as a Type II action, there is no perceivable environmental impact stemming from the proposed renovation. 5. Has the alleged difficulty been self-created? Based upon all testimony,documentation, personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. An original garage was built in the proposed front yard location prior to the enactment of zoning and existed without detriment to the neighborhood until it was demolished by the applicants' because it had been severely damaged by a fallen tree. The proposed accessory building is proposed in the same location as the one that had previously existed and which would maintain the character of this neighborhood. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance. The accessory building could be located in the rear yard. However the applicant testified that the rear yard is prone to frequent flooding due to its lower elevation and locating the accessory building in this flood prone area would not be feasible. 3. Town Law 267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 100% relief from the code. However, the substantiality is mitigated when considering that the applicant desires to construct the accessory building with similar dimensions and in the same location where an accessory building previously existed. 4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has not been self-created. The difficulty is created by the lower elevation of the rear yard, causing frequent flooding, and the existing accessory building being destroyed by a storm. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of constructing an accessory building in a front yard, while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community.
