(631) 765-1809 Southold Town Clerk FINDINGS,DELIBERATIONS AND DETERMINATION MEETING OF AUGUST 20,2026 ZBA FILE: #8117 NAME OF APPLICANT: David and Helen Leis PROPERTY LOCATION: 990 Grand Ave., Mattituck,NY SCTM No. 1000-107-8-44.1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated April 16, 2026 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. An added comment was erosion and sediment control measures should be required during and immediately after construction to ensure that stormwater runoff will not carry eroded and other deleterious materials into Long Creek and tidal wetlands associated with Mattituck Creek. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated August 3, 2026. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available, it is recommended that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP as follows: Policy 6 Protect and restore the quality and function of the Town of Southold ecosystem. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees and Laws and regulations for all Andros Patent and other lands under their jurisdiction. The proposed action is on a nonconforming waterfront parcel with a pre-existing residence that is less than 100 feet from the western boundary of Long Creek. The proposed action is consistent with Policy 6.3A because the proposed pool meets the 60-foot wetland setback for a swimming pool and related structures from Town Code Chapter Section 275-3D(a)[5]. Board of Trustee approval will be required for a wetland permit. Page 2, August 20, 2026 #8117, Leis SCTM No. 1000-107-8-44.1 The ZBA notes that while the LWRP determination called the subject parcel nonconforming,this 46,671.5 square foot parcel in the R-40 Residential District is conforming. PROPERTY FACTS/DESCRIPTION: Request for a variance on this conforming 46,671.50 square foot parcel located in the Residential R-40 Zoning District. The northerly property.line measures 101.29 feet then turns south eastly 154.21feet, the southerly property line measures 81.03 feet, 56.42 feet, 61.93 feet and 52.54 feet(251.92 feet in total) and is adjacent to Long Creek, then measures southwest 75.68 feet, then northwest 125.00 feet, then westerly 13.74 feet and northwest 245.98 feet and is adjacent to Grand Avenue. As noted from the previous measurements,this is an oddly shaped parcel. The parcel is improved with a two-story frame dwelling. A one-story stucco building measuring 70.5 feet x 20.2 feet is located north of the residence and has a historical use sewing patches for war uniforms. Located north of that building is a one-story garage. There is a concrete sports court located east of the garage with a stone retaining wall. There is an 8.1 foot x 12.1foot shed located in the southern area of the property as shown on the survey map prepared by Angelo J. Cecere,LS and dated August 24,2026.The Building Department is allowing the shed to be in the current location.No permit is required for the shed since it is under the 144 square foot threshold for a building permit. BASIS OF APPLICATION: Request for Variance Article I11, from Sections 280-15 and the Building Inspector's February 7,2026, REVISED March 6,2026 Notice of Disapproval based on an application for a permit to construct an inground swimming pool, hot tub, and generator accessory to an existing single-family dwelling; at: 1) pool, hot tub and generator located in other than the code required rear yard; located at: 990 Grand Ave., (Adj to Long Creek) Mattituck,NY. SCTM No. 1000-107-8-44.1. RELIEF REQUESTED: The applicant requests a variance to construct an inground swimming pool, hot tub and generator accessory to an existing single-family dwelling located at 990 Grand Avenue, Mattituck, NY. SCTM No 1000-107-8-44.1. The three(3)proposed accessories on this 46,671.50 square foot parcel located in the Residential R-40 Zoning District are not permitted pursuant to Article 111,Section 280-15,which states accessory buildings and structures shall be located in the required rear yard and in the case of a waterfront parcel, accessory building and structures may be located in the front yard provided principal front yard setbacks are met. The proposed pool is in the side yard. The proposed hot tub is in the side yard. The proposed generator is in the side yard. ADDITIONAL INFORMATION: The single-family dwelling, accessory garage and storage shed have a Pre-C of O that was issued on September 15, 1999.. The Southold Board of Trustees issued Permit No. 10939 on February 11, 2026 approving a 14 foot x 50 foot inground pool, a 7 foot x 7 foot hot tub with a 2 foot high, 60 foot long retaining wall with stone veneer; install 850 square foot nonpermeable patio pitched to gutter drain an piped to drywell; install a 4 foot x 8 foot DP drywell for pool,patio and a proposed f 12 foot x 7 foot outdoor shower and storage area with a load bearing top and inspection lid; install a ±12 foot x 2 foot outdoor BBQ and counter area; install a 4 foot x 8 foot generator and pool equipment area with sound deadening enclosure; install a±15 foot x 12 foot gravel gas fire pit area on permeable stone; install paver walkways; install 4 foot high pool enclosure fencing with gates, and all existing fencing to be brought to pool code; remove three (3)junipers, one crab-apple tree, existing cryptomeria and redbud; and to establish and perpetually maintain a 10 foot wide vegetated non-turf buffer area that will be planted with salt tolerant native non-fertilizer dependent vegetation to extend the width of the property along the creek;with the condition the fence be moved back 20 feet from concrete wall;and any tree removed to be replaced with a one to one replacement; and as depicted on the site plan prepared by AJC Land Surveying PLLC, received on March 13, 2026, and stamped approved on March 20, 2026. The application was closed subject to receipt of an updated survey. Survey was received and stamped in on August 26, 2026. FINDINGS OF FACT/REASONS FOR BOARD ACTION: Page 3, August 20, 2026 98117, Leis SCTM No. 1000-107-8-44.1 The Zoning Board of Appeals held a public hearing on this application on August 6, 2026 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law V67-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. This is a waterfront community and other residences along the creek have inground swimming pools. The house directly across the creek has a side yard pool. The configuration of the property is irregular and unique. The property is well screened from Grand Ave. and no letters of objection have been received. The approved Trustee's Permit is very specific as to what has been approved and what stipulations must be met to avoid detriment to the adjacent creek. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Due to the nature of the configuration of this property,there is no other location feasible for this applicant to site the pool, hot tub, and generator. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 100% relief from the code. However, there is no other feasible location for siting the pool, hot tub, and generator and the planned location is well-screened from Grand Avenue by mature evergreen plantings. 4. Town Law§267-b(3)(b)(4).No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an inground swimming pool,hot tub and generator while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Chairperson Weisman, seconded by Member Steinbugler, and duly carried,to GRANT the variance as applied for, and shown on the survey map/site plan prepared by Angelo J. Cecere, LS and dated August 24, 2026. SUBJECT TO THE FOLLOWING CONDITIONS: 1. Existing vegetative screening along Grand Avenue and additional vegetation per Trustees permit shall be- planted and maintained. 2. Pool pump equipment/mechanicals must be located a minimum of 20 feet from any property line or be contained in a sound-deadening shed-type enclosure with a lot line set back that is in conformance with the bulk schedule for accessory structures. 3. Erosion and sediment control measures are required during and immediately after construction to ensure that stormwater runoff will not carry eroded and other deleterious materials into Long Creek and tidal wetlands associated with Mattituck Creek. S. The applicant shall comply with conditions given by the Southold Board of Trustees. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the decree of nonconformity,provided de minimis relief is requested within one year of the date of this decision. Any time after one year, the Board may require a new application. IMPORTANT LIMITS ON THE APPROVAL(S) GRANTED HEREIN Please Read Carefully Any deviation from the survey, site plan and/or architectural drawings cited in this decision, or work exceeding the scope of the relief granted herein, will result in delays and/or a possible denial by the Building Department of a building permit and/or the issuance of a Stop Work Order, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, demolitions, or demolitions exceeding the scope of the relief granted herein, are not authorized under this application when involving nonconformities under the zoning code.. This action does not authorize or condone any current or future use, setback or other feature of the subjectproperty that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. TIME LIMITS ON THIS APPROVAL: Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured,and/or a subdivision map has not been filed with the Suffolk County Clerk,within three(3) years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms. IT IS THE PROPERTY OWNER'S RESPONSIBILITY TO ENSURE COMPLIANCE WITH THE CODE REQUIRED TIME FRAME DESCRIBED HEREIN. Failure to comply in a timely manner may result in the denial by the Building Department of a Certificate of Occupancy, nullify the approved variance relief, and require a new variance application with public hearing before the Board of Appeals.
