In the event that such approval is necessary, the holder of this permit shall not commence operations here- under until such approval has been obtained in writing. The failure to obtain such other approval when required shall subject this permit to immediate revocation by the Trustees upon receipt by the Trustees of written notice from such other governmental or municipal authorities of its refusal or �/ disapproval. The decision whether to issue a permit will be based on an evaluation of the probable impact including cumulative impacts of the activity on the' public interest. That decision will reflect the national concern for both protection and utilization of important resources. The benefit- which reasonably may be expected to accrue from the activity must be balanced against its reasonably foreseeable detriments. All factors which may be relevant to the activity will be. considered including the cumulative effects thereof; among those are conservation, economics, aesthetics , general environmental concerns, wetlands, cultural values , fish and wildlife values, flood hazards, flood plain values, land use, navigation, shoreline erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food production and, in general, the needs and welfare of the people. ALL COMMENTS REGARDING THE PERMIT APPLICATION MUST BE PREPARED IN WRITING AND MAILED TO REACH THIS OFFICE BEFORE THE EXPIRATION DATE OF THIS NOTICE, otherwise it will be presumed that there are no objections to the activity. Any person may request, my writing to the district engineer, before this public notic..- expires, that a public hearing be held to collect information necessary to consider this application. Requests for public hearings shall state, with particularity, the reasons why a public hearing should be held. Pursuant to Section 307(c) of the Coastal Zone Management Act of 1972 as amended (16 U.S.C. 1456(c)) , for activities under consideration that are located within the coastal zone of a state which has a federally approved coastal zone management program, the applicant has certified in the permit application that the activity complies with and will be conducted in a manner that is consistent with the approved state coastal zone management program. DESCR-IP-TION --OF.-WORK The applicant, Port of Egypt Enterprises, Inc. requests Department of the Army authorization to dredge with 10 years maintenance with upland disposal and place riprap in Budds Pond, Shelter Island Sound at Southold, Suffolk County, New York for the purpose of providing continued access to an existing marina facility and to prevent erosion of the applicant's upland property. The applicant proposes to dredge with 10 years maintenance a 200 foot by 300 foot basin and the surrounding shoreline seaward of mean low water to 4 feet below the plane of mean low water with the resultant 1000 cubic yards of dredged material placed on the applicant's upland property where it will be suitably retained to prevent its reentry into the waterway. NEGATIVE DECLARATION NOTICE OF NO SIGNIFICANT EFFECT ON THE ENVIRONMENT Dated: May 29, 1985 Pursuant to Article 8 of the Environmental Conservation Law State Environmental Quality Review and 6NYCRR Part 617, Section 617. 10 and Chapter 44 of the Code of the Town of Southold, notice is hereby given that the Southold Town Trustees, as lead agency for the action described below, has determined that the project, which is unlisted will not have a significant effect on the environment. DESCRIPTION OF ACTION: Application of Port of Egypt Ent. /C&L Realty Inc. submitted by William H. Lieblein & George A. Cottral to stabilize the banks of the marina using rip-rap to be placed against the banks of the marina to prevent wave action from eroding away the bank. Project is located East of Bay Home Road on Budd' s Pond, Southold. The project has been determined not to have a significant effect on the environment for the following reasons: An environmental assessment has been submitted which indicated that no significant adverse effect to the ..environm-ent-'. are likely to occur should the project be implemented as planned. Because there has been a response from the Southold Town Conservation Advisory Council indicating that this project would not have a significant effect to the environment. Because there has been no response in the allotted time from the New York State Department of Environmental Conservation and the Southold Town Building department, it is assumed that there are no objections nor comments from those agencies.
