This District has received an application for a Department of the Army =
permit pursuant to Section 10 of the River and Harbor Act of'1899
(33 U.S.C. 403); Section 404 of the Federal Water Pollution Control
Act (86 Stat. 816, P.L., 92-500); Section 103 of the Marine Protection;
Research and Sanctuaries Act of 1972 (86 Stat. 1052; P.L. 92-532) as
appropriate; as described below:
APPLICANT: Port of Egypt Enterprises, Inc.

Southold, New York 11971
WORK: Proposed & Existing Floating Timber Piers
WATERWAY: Budds Pond, Shelter Island Sound
LOCATION: Southold, Suffolk County, New York
A detailed description and plans of the proposed and existing work are
inclosed to assist in your review of .the application.
The .decision whether to issue a permit will be based .on an evaulation
of the probable .impact of the proposed and completed activity on the
public interest. That decision will reflect the national concern for
both protection and utilization of important resources. The benefit
which reasonably may be expected to accrue from the proposed and com-
pleted work must be balanced against it reasonably foreseeable deter-
iments. All factors which may be relevant to the proposed and com-
pleted work will be considered; among those are conservation, eco-
nomics, aesthetics, general environmental concerns, historic values,
fish and wildlife values, flood damage prevention, land use, naviga-
tion, recreation, water supply, water quality, energy needs safety,
food production and, in general, the needs and welfare of the people.

A preliminary review of the application indicates that an Environmental
Impact Statement will not be prepared. A review of the latest publish-
ed version of the National Register of Historic Places and of the pre-
sence or absence of registered properties or properties listed in
the latest published version of the Register as being eligible for
inclusion, therein, has been made. Presently unknown archeological,.
scientific, prehistorical or historical data may be lost or destroyed .
by work that was accomplished prior to obtaining the required permit. .
The following government authorization(s) has(have) been obtained -or
will be obtained prior .to the issuance of a Department .of the Army
permit:
1. Tidal Wetlands Permit from the New York State Department of. Envi
ronmental Conservation.
2. Water Quality Certification from the New York State Department of
Environmental Conservation.
Any criticisms or protests regarding the proposed and completed work
should be PREPARED IN WRITING AND MAILED TO REACH THIS OFFICE prior to
9 April 1978 otherwise it will be presumed that there are no ob-
jections.
It is requested that you communicate the foregoing information con-
cerning the proposed and completed work to any persons known by you
to be interested and who did not receive a copy of this notice.

DESCRIPTION OF WORK
The applicant requests approval to maintain approximately 120 ft.
of floating timber pier and to install an additional 300 ft. of
floating .timber pier in the configuraiton and location shown on the
attached plans.
The proposed and existing structures consist of a main floating pier
5 ft. wide with approximately. twenty 20 ft. x 4 ft. finger floats
connected to the adjoining upland by two 12 ft. access ramps. It
should be noted that the proposed and existing finger piers located
in the southeast portion of the applicant's marina facility are
approximately 10 ft. from the edge of the navigation channel in
Budds Pond.
It should be noted that the existing floating pier arrangement was
built without prior Department of the Army authorization, The New
York District Corps of Engineers having reviewed the matter, has'.
declined at this time to initiate legal proceedings for the under-
taking of the unauthorized work. The decision, whether or not to
grant. approval, will be based on an evaluation of the probable
impact on the public interest of either allowing the work to remain
as constructed, or requiring its modification or removal. Public
comments in response to this notice should be directed toward these
alternatives.
The purpose of the work is to provide additional mooring space for
private pleasure boats at the applicant's marina.,

Dear Sirs,
Please find enclosed our application form A-2 and associated
documents.
Earlier this year I spoke to the Board concerning our plans
for floating docks and subsequently received the application forms
now being submitted. Prior to submitting this application, we
spoke to the N.Y.S. Dept. of Environmental Conservation personnel
to get a feel for the chances of receiving their approval Dor the
proposed work. Their initial reaction was favorable and a request
for approval of the proposed work was submitted to that agency.
The hearing is scheduled for June 17, 1977.
At the time I spoke to your Board and to the D.E.C. , I indi-
cated that we had moved some of our preexisting floating docks
from their former location along a bulkhead on the eastern edge
of our marina to the proposed location. This was to enable us to,
determine how the end result would look. We Also felt that it
would enable your board and personnel from D.E.C. to get a feel
for the impact of our proposed project on the area.
Shortly after submitting the request to D.E.C., we became in-
volved with the spring rush to get our fleet ready for the season
as well as repairing ice damage. This was followed by a very good
weakfish season which kept us busy. 7 days a week. As often happens,
procrastination occured and we put off filling in the enclosed ap-
plication and it was buried in our pending file.
During this same period we began receiving requests for dock
space. As a stop gap measure we began to allow people to moor their
boats to the repositioned floats. . We now find ourselves in the em-
barrassing position of having placed the cart before the horse.
That is, we are requesting a permit to install floating docks and
we already have 25% of the docks in place.
We therefore ask the indulgence of the Board to allow the docks
to remain occupied pending approval of the permit requested.
In addition to the forms requested we have enclosed an aerial
photo (postcard) taken in 1969 .with the proposed docks inked in.
