Strang, on behalf of PORT OF EGYPT, applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated January 13, 1995 and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on March 30, 1995, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 37-18 of. the Southold Town Code, which will be listed on a separate page, and, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, i. . The,decision whether'to issue a permit will be based on an evaluation of the probable impact, including cumulative impacts, of the proposed activity on the public interest. That decision will reflect the national concern for both protection-.and utilization of important resources. The benefits which reasonably may be expected to accrue.from the.proposal must be balanced against its reasonably foreseeable detriments. All factors which,may be relevant to the proposal will be considered including the cumulative effects thereof; among those are conservation, economics, aesthetics, general . environmental concerns, wetlands,historical properties, fish and wildlife values, floodplain values, land., use,navigation,shoreline erosion and accretion,recreation,water supply and conservation,water quality, energy needs, safety,food and fiber production,mineral needs, consideration of property,ownership and,. in general, the needs and welfare of the people. The Corps.of Engineers is soliciting comments from.the public; Federal, state, and local agencies and officials; Indian Tribes; and other interested parties in order to consider and evaluate the impacts of this proposed activity. Seebode Enclosures Regulatory Branch CENAN-OP-RE PUBLIC NOTICE NO. 97-13510-L2 WORK DESCRIPTION ` The applicant, Port of Egypt Marine, Inc., has requested Department of the Army authorization to replace existing .bulkheads and, rip-rap; install a boat lift and dredge material from Port of Egypt Marina in Budds Pond; Little Peconic Bay'at the Town of Southold, Suffolk County, New York with ten'years maintenance and subsequent upland disposal.' „ The work would involve replacement of approximately 1500 linear feet.of existing bulkhead and rip-rap with pan I-beam concrete bulkhead, and installation of a I-beam travel lift. A 35 foot by 50.foot washdown-pad with a two ring collection.system and a 4-inch diameter overflow pipe would be installed landward of the travel lift. .The applicant also proposes to dredge, with ten years maintenance, material from the marina to a depth of 5 feet below mean water, removing approximately.1.00 cubic yards-of material.. A portion of the initially dredged material would, be used as backfill behind the new bulkhead with remaining material from initial and subsequent dredging activities dewatered on site with return flow, allowed to reenter .the waterway as necessary prior to.final disposal on the north side of State Route 25. January 9, 1995 Reasons Supporting This Determination: This project involves the construction of a swimming pool at an existing marina. A swimming pool is a permitted use in this Marine II zone (M-II), thus the proposed action is consistent with zoning. An Environmental Assessment Form has been submitted and reviewed, and it was determined that no significant adverse effects to the environment were likely to occur should the project be implemented as planned. There has not been any correspondence from the New York State Department of Environmental Conservation in the allotted time. Therefore, it is assumed that there are no comments or objections from that agency. The applicant will have to comply with the requirements of the Suffolk County Sanitary Code (SCSC) and all relevant standards of water supply and sewage disposal systems. Design and flow specification, subsurface soil conditions and site plan details will have to be approved by the Suffolk County Department of Health Services (SCDHS).
