Town Law Section 267--b(3) (b) (I)No undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties, if the variance is granted. The property is located in Business (B)Zoning Use District and the existing building is proposed to remain. The existing- setback of the structure is set back from the side yard at 19.7 when 25 is required. The location of the existing structure is sufficient to provide conforming buffers. The preservation of the existing structure will maintain the character of the commercial district and the nearby adjoining farmland. The existing property will be greatly improved and additional existing buildings will be removed. 2. Town Law Section 267-b(3) (b) (2)The benefit sought by the applicant can not be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing building is structurally sound and would require limited alterations. The existing building could not be altered to conform to the side yard setback without great expense, such that the building would need to be demolished. Further the location of the building provides for greater parking and vehicle circulation. The east side of the existing building is proposed as the landscape buffer. 3 . Town Law Section 267-b(3) (b) (3)The area variance is not substantial The application of the balancing test weighs in favor of the grant of the variance. The variance is not substantial and will preserve an existing building. Moreover, the proposed site plan has been reviewed by Planning staff, in pre-- submission review, and the site plan is well designed. 4. Town Law Section 267-b(3) (b) (4)The variance will have no adverse effect or impact on the physical or environmental conditions in the neighborhood or district. The existing building and uses on the property have been continuous throughout the years. There is no adverse environmental condition or constraints which would cause adverse impacts on the neighborhood or district. Gas stations are heavily regulated and monitored. by New York State and County. The use of the building as a general store/retail with bathrooms have less impacts then the multiple uses which have occurred on the property. 5. Town Law Section 2 6 7-b(3) (b) (5)The alleged difficulty was not self-created. The existing building was constructed with different zoning setback requirements and the building has a Co. The applicant proposes to preserve the building. 6. Town Law Section 267-b The variance requested is the minimum variance practicable given the personal benefits anticipated by the applicant. The non--conforming setbacks for the existing structure is the minimal variance practicable given the alternatives, the demolition of an existing functional building.
