been reviewed at the Trustees meeting held on February 28, 1989.
Your request has been approved by resolution, adopted at this
meeting, for a period of one year. Your permit will expire on
February 28, 1990.
This letter is an amendment to the original permit and as such,
shall be attached thereto.

The validity of this permit is or may be subject to the approval of other governmental or municipal
.authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the
event that such approval is necessary, the holder of this permit shall not commence operations here-
under until such approval has been obtained in writing. The failure to obtain such other approval when
required shall subject this permit to immediate revocation by the Trustees upon receipt by the
Trustees, of written notice from such other governmental or municipal authorities of its refusal or
disapproval.
The applicant does by the acceptance of this permit, assume all responsibility for operations under-
taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons
and property resulting from such operations. By such acceptance, the applicant also agrees to indemni-
fy and save harmless the Town, and its officers, agents and employees from any and all claims arising
from operations under this permit and any and all acts or omissions of applicant, his agent and
employees.
The applicant and the owner and occupants of the premises upon which the operations authorized by
this permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and
its officers and employees to enter upon the premises where such operations are being conducted to
make such inspections as the Town may deem necessary to insure that such operations are being con-
ducted in conformity with this permit.
This operation will not substantially:
A. Adversely affect the wetlands of the town.
B. Cause damage from erosion, turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town.
D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege-
tation or the natural habitat thereof.
E. Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town.
G. Change the course of any channel or the natural movement or flow of any waters.
H. Weaken or undermine the lateral support of other lands in the vicinity.
I. Otherwise adversely affect the health, safety and general welfare of the people of the town.

Dear Mr. Frank Kujawski ,
As you are aware the sandspit that sticks out on
the north west end of the sandbar in Budd 's Pond is now about
twenty feet from the dock in front of Port of Egypt ' s fish-
market. The gap is narrowing visibly every day and when the
1989 boating season begins the opening will be impassable
for any boat . As of now only small boats can get though.
I feel it is the responsibility of the county or
the town to keep the channel open and urge you to try to have
some action taken.
In the meanwhile I found ojt from Henry Smith that
the permit we received from the Town Trustees to dig the point
back in 1987 has not yet expired. I hereby request that that
permit be extended for a year. If it appears that no action
will be taken by government I will get together with Albertson
Marine to use a floating crane or backhoe to open the channel
enough for this year. Your favorable response to this request
would be appreciated.

I have been in contact with John Guldi of the Suffolk County
D.P.W. concerning the dredging project of the Jockey Creek Spur at
the entrance to the Town boat launching ramp at the end of Pine Neck
Road. Mr. Guldi has indicated that he will add this spur to the list
for County dredging.
The Board of Trustees will not at this time file an application
for dredging of above mentioned area.

Dear Mr. Guldi:
The above mentioned project was inadvertently omitted from our
list of priority dredging projects for 1989. The Southold Town boat
launching ramp at this site is not operable because the channel is
closed. I believe that this is the same project for which you have
information on file but has not been previously listed as a priority.
Would you please add this spur to the Town Priority list for
County dredging.

regarding your request to dredge and remove the spit off of
the island and to place the spoil back on the island as far
back as possible.
RESOLVED that the Southold Town Trustees APPROVE AN EMERGENCY
PERMIT TO WILLIAM H. LIEBLEIN, PRESIDENT, PORT OF EGYPT ENTERPRISES,
INC. to remove the spit off the end of the island in front of his
property and to place the resultant spoil back up on the island as
far back as possible so that it does not wash back into the waters.

Gentlemen,
We would like to request an extension on the dredging
Permit No. 200 . As you probably know we are doing the dredging
ourselves with our own crane. Due to mechanical breakdown
we were unable to complete our project . The breakdowns
took a total of six months to repair and set us back on
our time table to complete all of the dredging we had intended
to do.
We are hoping to get back to the project early this
spring. If we do not fini.sh in the spring we would hope
to finish this fall .
We are asking for an extension on Wetland Permit No.
200 granted by the Town Trustees according to information
furnished in application No. 236 filed by Port of Egypt
Enterprises , Inc. and C & L Realty Inc. on December 26 ,
1985 . We would appreciate an extension until December 26 ,
1987 .

PROPERTY LOCATED ON MAIN ROAD, SOUTHOLD.

TRUSTEE SMITH: Frank will you take number two? Port of Egypt.
TRUSTEE KUJAWSKI: Do we have to read the notice? Can we dispense
with the reading of the notice? .(No response.) The second hearing
is in the matter of the application of the Port of Egypt, Ent. / &
C & L Realty Co. for maintanance dredging and filling on property
located on Main Road, Southold. This is in the basin area. This is
a maintenance dredging. Is there any one wishing to speak for this
project? (No response. ) Against this project? (No response. )
Can I say something about this project?
TRUSTEE SMITH: Sure.
TRUSTEE KUJAWSKI: The spoil area is the area that, I believe, we .
felt there was a violation of the Wetlands .
TRUSTEE SMITH: This is across the street.
TRUSTEE KUJAWSKI: It seems to me that we are aiding and abetting.
TRUSTEE SMITH: It seems to me that we drew a line on the encroachment
of that, last month I had the Building Dept. put the "Here now
it' s finished. " They are going to put this on an area that has been
previously filled. I don't have any problem with this.
TRUSTEE KUJAWSKI: Well, I 'm looking for the DEC Permit. The DEC
permit for this has alot of restrictions on this project. As a matter
of fact, restrictions A thru J, which I don' t have and I don 't know
if they were sent on to us but I notice it is on the back of their
permit. But, I would like to, especially if we are going to move
to approve this tonight, I would like our conditions to coincide
with the DEC ' s and they are 1. That the applicant place hay bails

between the dredge spoil and the tidal wetlands. These hay bails
will remain in place while the dredged material is being deposited
and until the dredged spoil is stabilized with the adjacent vegetation.
2. That after the placement of the dredged spoil the permitee shall
stabilize with vegetation planted, probably with a rye grass, on
a seaward slope. In other words, they don't want run off just
bringing all the spoil down into the spartina,. it has to be
stabilized with something. ' I don't know .if rye grass will take there?
Maybe it will, after a certain amount of time. See what the problem
is here, . we got one aspect, we sent a letter to Vic Lessard (Admin.
of the Building Dept. ) saying "Check this out" , he comes back and
says "Yes". it is a violation, it' s been going on for ten years. Now
we are saying, yes go ahead.

on the premises in question and whether any prior licenses or permits have been issued to erect

were ever revoked or suspended by a governmental agency.

(4 ) Disclaimer: Purchasers acknowledge and agree that the
use and occupancy of the premises. contemplated' by this Agreement is x
on an as is basis. Seller makes no warranties or representations,
expressed .or implied, about the premises except as specifically set
forth in the contract of sale. Seller has entered into this Agree-
ment in reliance upon these limitations of Seller's liabilities and
would not have entered into this Agreement, without such limita-

(5 ) Liability: Purchasers assume all risks of and responsi-
bility and liability for all losses, damages , and personal injuries j
which may be incurred by Purchasers or any other persons during :t
Purchasers ' use and occupancy of the premises , regardless of
whether they are caused by Purchasers ' use and occupancy of the
premises. Purchasers ' expressly and unequivocally agree to indem'

(7 ) Ins_urance: Purchasers agree to. secure hazard and liabil
ity insurance covering the premises to protect . against any loss or
damage occurring, or liability incurred , during Purchasers ' use and
occupancy of same. Prior to delivery of possession , Purchasers
shall provide satisfactory evidence of such insurance to Seller's
..attorney. Such evidence shall include, but is not limited to, a
copy of the insurance policy issued and a premium paid receipt.
Policy .alTiounts .shall be .in the following amounts and covering the
following types of losses:
(a) Liability $1,000,000
(b) Fire
( i ) two-story motel . 60, 000
( ii ) fish market 30,000
( iii )' scallop ,shop 10,000
( 8 ) Surrender of Possession: ' In .the event that the closing
of title does not take place by May 31 , 1984 , through no fault of
Seller, then Purchasers shall pay $500. 00 per month to Seller'.'. com-
.mencing on June 1 , 1984. In no event , however, shall Purchasers '
use and occupancy of the premises at any time be considered a ten-
ancy in any form. Purchasers agree to vacate the premises immedi-
ately following .demand of Seller in the event of a breach by Pur-
chasers of any of the terms and conditions of this Agreement.
Purchasers further agree that, failing said voluntary vacation ,
Purchasers may be dispossessed on three days ' notice by summary
proceedings.
( 9) Maintenance and Compliance: During Purchasers ' use and
occupancy of the premises, Purchasers shall keep the premises in
good condition and repair at Purchasers ' sole expense and shall
comply with all governmental ordinances and regulations concerning
the premises.
(10 ) Assignability: Neither this -Agreement , nor any right or
