It was built incorrectly by the contractor at 18'6"and with the surrounding average adjacent grade it is 18'10.5"to slab.The exterior staircase and deck over the one story shed on the back of this accessory building will not be visable from the street. 2.The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance,because: The originally planned interior staircase was never built,since it would have taken up too much space and prevent us from storing our 15.5'LOA-7'1"beam Marshall Cat,multiple bycycles,wood for furniture making, kayaks,and other belongings on the 1 st floor. We have been using an extension ladder to access the 2nd floor storage area.As we age we no longer feel safe using an extension ladder for this purpose.Burleigh is 74 and Carol is 66.The house has no attic and only a 17'by 17'basement where HVAC and other mechanical equipment reside.Our son and his wife and our older daughter live in small apartments in NYC.Our youger daughter lives in Cambridge,MA,also in a small apt.They all store some of their belongings in the 2nd floor storage area of this accessory building. 3. The amount of relief requested is not substantial because: The exterior staircase and deck on top of the existing shed will not been seen from the street. If the contractor had correctly built this accessory builing at 18'to adjacent grade as he should have,the setback would have been 10'instead of 15'. 4. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: Given existing plantings and a 6'fence on the front east and west sides of this existing accessory building,the exterior staircase and deck will not been seen from the street.The neighbor immediately to the east has a 6'fence on the west side of their property,which will substantially block their view of the exterior staircase and deck.This neighbor has written a letter in support of this variance request. 5.Has the alleged difficulty been self created? {VJ} Yes,or { ) No Why:The original drawings call for an 18'to grade building. The contractor built it incorrectly.When building the dormer,he asked me to help interpret the drawings for him. I figured something was wrong with our friend and neighbor who was the contractor.Our garage was the last project he did.Shortly afterwards his ex-wife took him to the doctor and he was found to have early dementia.
