The owner requests to construct a second floor over the existing garage to be used for clean dry storage. The garage was constructed in 1987 with a variance allowed 5' from the side yard. The garage was constructed 6.3 from the property line. The House was recently renovated,and the garage needs to be renovated(1987)and the proposed roof line of the garage will match the architectural roof line of the newly renovated house. The ZBA condition was 1. "The accessory garage/storage is not for habitable quarters and be accessory to the residential use of the premises and not operated for gain." The conditions remain unless permitted by future zoning codes or ZBA approval such as an accessory apartment in the future)2.No closer than 50' to the front 3.At least 5' feet from the northerly side property line and 4.The garage doors face the rear(if feasible)5.No plumbingf acility. The zoning code now allows a''/Z bathroom. The owner would like to run rough plumbing in the walls(for future)but keep the garage dry(no water or sanitary at this time) The proposed garage renovation with a second floor will be ready for the future needs of the family(such as an accessory Wartment or other permitted use). The family is not ready for the accessory apartment at this time,but the structure will be constructed so it could meet the ceiling heights for an accessory apartment in the future. The garage will be dry with only the rough plumbing. It will not have water or sanitary connection at this time. The owners need clean dry storage. A standard exterior staircase is proposed to provide easy access to the second- floor storage,easily accessible stairs,and a code compliance staircase in the future. The renovations of the garage will match the exterior architectural improvements to the house. The owners request for dry storage will avoid major exterior changes to the garage if, in the future,the interior is improved. The proposed design is for economic efficiency and planning for the next phase of their life. 2.The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue,other than an area variance,because: The garage was constructed in 1987 at 5' from the properly line. The garage is 52 feet from the front propegy line, maintaining the existing setbacks. At 52' from the road,the garage meets principal setbacks. 3.The amount of relief requested is not substantial because:A 6' setback from the property line is a standard setback in this neighborhood. The lots are narrow and predate the zoning ordinance. The lot area is 50,340 SF,however onlL 30,363 sf is"buildable". A 6' side yard setback for this parcel is a reasonable request. Other variances for reduced setbacks have been granted for both accessory and principal structures. A waiver has been issued by the 'Southold Town Board of Trustees August 27 , 1987 from the requirements of a Wetland Permit of the Town of Southold as noted in its September 1 , 1987 letter. 5. Information has been furnished by appellants to the Board to indicate that the area chosen for this accessory structure is not an environmental area. 6. Article III , Section 100-32 of the Zoning Code permits accessory buildings only in the rear yard area. 7. The rear yard area of the appellants ' property consists mainly of meadow grasses and wet areas , and is not a feasible location to place the requested accessory structure. The Board is in agreement with the appellants under the circumstances. 8. It is the opinion of the Board .that: (a) the relief requested is not substantial ; (b) the project as proposed is .not out of character with the general neighbor- hood; (c) the circumstances of the property are unique and lend to the difficulties created herein; (d) the circumstances are not personal in nature; (e) the variance will not in turn be adverse to the safety , health, comfort, convenience or order of the town; (f) there will not be an increase in density created by this variance; (g) there -is no other method feasible for appellant to pursue other than a variance; (h) that in view of all the above factors , the interests of justice will be served by granting the variance requested and as noted below. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated August 30,2022 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a.non-conforming 21,006 sq. ft. parcel located in an R-40 Zoning District. The property has a 103.81 feet of road frontage along Haywaters Drive, then turns west 245.31 feet towards Mud Creek,then has 101.49 feet of frontage along Mud Creek before returning east for 251.88 feet back to Haywaters Drive. The property is improved with a two-story frame residence, an existing accessory garage with sunroom,and a frame shed;all as shown on survey prepared by Nathan Taft Corwin,Ill,L.S.last revised August 3,2022. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-123 and the Building Inspector's July 6, 2022 Notice of Disapproval based, on an application for a permit to construct additions and alterations to an existing accessory garage at; 1) a non conforming building containing a non-conforming use shall not be enlarged, reconstructed, structurally altered or moved, unless such building is changed to a conforming use; located at: 590 Haywaters Drive,Cutchogue,NY. SCTM No. 104-5-22. RELIEF REQUESTED: The applicant requests a variance to alter the as built frame garage by removing the existing pitched roof and installing a flat roof,and replacing the attached sunroom with a screened porch,thereby continuing a nonconformity, since the building may not be enlarged or structurally altered according to Section 280-123 of the Town Code. However,reducing the height of the roof,creates less nonconformity with the Town Code. AMENDED APPLICATION: During the hearing,the applicant was asked to amend the architectural plans to add a solid visual screen to the proposed roof top deck to block views between the subject property and the adjacent property to the north. The applicant,on January 9,2023,submitted Architectural Plans prepared by William S.Ryall, Jr, Architect, depicting a solid wood privacy screen at 7 ft. 7 in. high from the proposed roof deck floor along the northerly edge of the proposed deck. Received Page 2,January 19,2023 SEP 8 2026 #7722,Eckstrom-Saavedra SCTM No. 1000-104-5-22 Zoning Board of Appeals ADDITIONAL INFORMATION: In both oral and written testimony from the applicant's agent, the project was described as removing the existing pitched roof on the garage, and replacing it with a flat roof to take advantage of the views of the creek. There was discussion of privacy with the adjacent neighbors to the north, and the applicant subsequently submitted revised plans showing a privacy screen on the north side of the garage roof. The neighbors spoke against the project as per the privacy issues brought up in the hearing. In discussions during the hearing, it was agreed upon that a privacy screen between the properties would be an acceptable solution to this issue. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on January 5,2023 at which time written and oral evidence were presented. Based upon all testimony,documentation, personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 5267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Replacing the existing pitched roof of the accessory garage with a flat roof will reduce the elevation and will result in less mass which will reduce the visual impact of the existing accessory garage 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method,feasible for the applicant to pursue,other than an area variance. 'Due to the fact that the as built structure is non-conforming, any change proposed for the structure,even_within the allowable setbacks,would require an area variance. 3. Town Law$267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 100%relief from the code because the code states that any change to the non-conforming building is not allowed unless it is changed to a conforming use. However, the applicant is proposing to bring the accessory building into more compliance with the code by replacing an existing first floor attached enclosed sunroom with a proposed screened porch which is more conforming to the, code. Moreover, removing the existing sloped roof, and replacing it with a flat roof,containing a deck with a privacy screen would lower the profile of the existing structure and thereby lessen the visual impact. . 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 ofthe Town's Storm Water Management Code and conditions of this Board. In addition,the proposed deck will provide an outdoor riecreational space that avoid adverse impacts to the extensive wetlands on the rear(seaward side)of the dwelling. 5. Town Law Q267-b(3)(b)(5). The difficulty has been self-created. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated February 28, 2019 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation .dated July 17, 2019. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available, it is recommended that that the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP. The coordinator indicated concerns with flooding and erosion hazards of structures located within the FEMA Flood Zone AE El. 6 (Policy 4.1), and the quality and function of the Town's Ecosystem (Policy 6). In his report he copied a narrative from the Coastal Fish & Wildlife Habitat Assessment Form of 2002 which described the Cutchogue Harbor and Wetlands, and concluded with an impact assessment. The LWRP coordinator recommended that the Board require the installation of I/A OWTS to meet LWRP policy and support the functions and values of the wetland ecosystem. The Board finds that the application, as amended to include the installation of an Advanced IA Sanitary Systems approved by the Suffolk County Department of Health Services is CONSISTENT as recommended, and shall therefore be CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The subject property is a 24,561 sq. ft. parcel located in an R-40 Zoning District, with an upland area of 18,624 sq. ft. The parcel has a road frontage of approximately. 155.58 feet along Skunk Lane,then running 150.00 feet southwest to the rear property line,then 141.89 ft to the side yard,returning 204.10 feet back to Skunk Lane (also known as Bay Avenue). The property is improved with a single-family dwelling as shown on the survey prepared by Nathan Taft Corwin,III,L.S. Received Page 2,August 1,2019 #7290,HC NoFo,LLC SEP 8 2026 SCTM No 1000-104-5-3.3 Zoning Board of Appeals BASIS OF APPLICATION: Request for Variances under Article XXIII, Section 280-124 and the Building Inspector's December 26,2018 Notice of Disapproval based on an application for a permit to demolish an existing dwelling and construct a new single family dwelling and an accessory garage; 1) proposed single family dwelling measuring less than the code required minimum rear yard setback of 50 feet; 2) proposed accessory garage is located in other than the code required rear yard; at: 6370 Skunk Lane, Cutchogue,NY. SCTM#1000-104-5-3.3. RELIEF REQUESTED: The applicant requests variances to locate a single-family dwelling 20 feet from the rear yard property line, where a 50-foot setback is required by code, and to allow an accessory building(garage) to be located in the side yard instead of the code required rear yard. AMENDED APPLICATION: During the hearing, the applicant was asked to bring the plan into more conformity with the code. The applicant on July 11, 2019 submitted a plan increasing the rear yard setback of the proposed two car accessory garage located in a side yard to 20 feet, which is the setback proposed for the new Single-family dwelling, thereby bringing the plan into more conformity with the Town Code. The site plan prepared by Isaac Clay Coffey was date stamped received July 11, 2019 to show the amended location of the accessory garage and the proposed I/A Onsite Wastewater Treatment System. ADDITIONAL INFORMATION: As per testimony from the architect,the property is currently awaiting approval from the Suffolk County Department of Health Services for an UA sanitary system. The architect was questioned about making the setback of the proposed garage the same as the proposed residence. The architect was amenable to this change. The existing dwelling structure was built in 1959 and the certificate of occupancy for a seasonal dwelling was issued in 1960. In December of 1969, a certificate of occupancy,was issued for an accessory storage building. The residence altered and expanded to be converted to a full-time residence in 1972 with Certificate of Occupancy#Z- 4635. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on July 3, 2019 at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The surrounding neighborhood is comprised of small to large waterfront properties and houses. Most of the neighboring properties have been renovated and enlarged in recent times,and this project will not change the character of the neighborhood. 2. Town Law V67-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance.The property has a usable upland area that is approximately half the size of the lot. It is because of this,that the house needs to be sited towards the rear of the property,which would not allow an accessory garage in the required rear yard. Also, a new UA sanitary system is proposed for this property, which also limits the area where the residence can be placed. There is no way to situate this residence, and accessory garage on the subject property without the need for an area variance. 3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing approximately 60% relief from the code for the rear yard setback and 100% relief for the proposed accessory garage in a side yard. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and the conditions set forth in this decision. The applicant is proposing an UA sanitary system, which will mitigate the environmental effects of nitrogen loading in the adjacent creek and would bring this property into compliance with LWRP recommendations. The proposed residence has a proposed finished floor height of 10 ft above sea level,where a 6 ft height is required further mitigating the impact of the residence on the property. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a full-time residence with accessory garage while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community.
