A. INSTRUCTIONS PLANNING BOARD
1. All applicants for permits* including Town of Southold agencies, shall complete this or
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area(which includes all of Southold Town)
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail, listing both supporting and non-
supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.
A copy of the LWRP is available in the following places: online at the Town of Southold's website
(southoldtown.northfork.net), the Board of Trustees Office, the Planning Department, all local
libraries and the Town Clerk's office.

POLICY 6
Although floating dock structures are common along the shorelines of Town Creek to the
immediate south,the subject property is located near the northerly end of the most northeast arm
of Town Creek, where the water shallows and vegetated tidal wetlands are abundant to the north
of the project site. Therefore,the proposed"kayak dock" is intended to provide a fixed point of
elevated structural access over the existing vegetated wetland to allow for dockage and use of
small watercraft, such as a kayaks, canoes, and dinghies in water that is too shallow at low tide to
accommodate a floating dock and larger boats. Without such a fixed point of structural access,
small watercraft would need to be dragged through the vegetated wetland, creating the potential
for the loss of wetlands vegetation along the shoreline. Many similar fixed docks/walkways
have been approved by the Board of Trustees throughout Richmond Creek where similarly
shallow waters are common, and although never constructed, the Trustees have twice previously
approved substantially similar dock structures for the subject property in 2006 (Wetlands Permit
6369) and 2015 (Wetlands Permit 8695). And consistent with these prior approvals,to mitigate
any potential impacts of the project on the adjacent tidal wetland area and Town waters,the
proposed dock structure is again designed with the,minimal scope necessary to reach at least 12
inches of water depth at mean low tide; would be elevated and constructed with open-grate
decking to allow sunlight to penetrate both through and beneath the dock to ensure the continued
viability of vegetation below it; would be located at least 15 feet from the laterally extended
southerly property line; and would encroach upon less than one-fourth the width of the
waterway. The proposed dock would thus not adversely impact public navigation or recreational
use of Town Creek; cause a"fragmentation of ecological communities;"result in the physical
loss, degradation, or functional loss of ecological components; or otherwise adversely impact the
wetlands or tidal waters of the Town, consistent both with the construction and operation
standards for docks set forth by Town Code Section 275-11(C)(2) and Policy 6 of the LWRP.

Due to the property's location at the most northerly end of Town Creek and the surrounding shallow water depths and wetland
vegetation,there is little to no potential for navigational or pedestrian traffic passing the site.Nonetheless,the structure would be set
back at least 15 feet from the laterally extended southerly lot line,consistent with Town Code Section 275-11(C)(2)(a)(5),and it would
encroach upon less than one-fourth the width of the waterway,consistent with Town Code Section 275-11(C)(2)(b)(2),both to ensure
there will be no impacts to public navigation or recreational use of Town Creek,consistent with Policy 9.
