LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
1. All applicants for permits* including Town of Southold agericies, shall complete this CCAF for
proposed actions that dre subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its si nig ficant
beneficial and adverse effects upon the coastal area(which includes all of Southold Town)
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail, listing both supporting and non-
supportine facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.

The proposed project, which seeks to raise, relocate, renovate, and add a master bedroom addition to an
existing dwelling,was previously approved by the Board of Trustees on March 16,2022(Wetlands Permit
No. 10094), an approval that was extended in 2024 and 2025. Due to delays with securing approval from
the Suffolk County Department of Health Services, however, work has not yet commenced, and the
wetlands permit is scheduled to permanently expire on March 16, 2026, necessitating submission of the
current application for approval of the identical scope of work.
Specifically,the existing dwelling,whose construction pre-dates the adoption of Town zoning code in 1957,
is in need of structural repairs, upgrade of mechanical systems, and replacement of deteriorating siding,
roofing,windows,and insulation.But as a result of its design and additionally incorporated environmental
mitigation measures described below,the project will further the goals of Chapter 275 (and LW"Policies
4. 5, and 6) by increasing the dwelling's protection from potential flood and erosion damage; and by
protecting and improving water quality and the quality and function of thessurrounding Orient Harbor tidal
wetland ecosystem.
1. All proposed construction will remain located outside the Coastal Erosion Hazard Area;
2. Lot coverage will remain below the code-compliant 20 percent.
3. The relocated dwelling will be elevated to a FEMA-compliant base flood elevation, thus
substantially increasing the dwelling's protection from potential flood and erosion damage and
providing a benefit to adjacent properties through reduction of potential damage that could be
caused to nearby structures as a result of damage that might otherwise be caused to the subject
dwelling during a significant storm event;
4. The existing wetland setback to the bulkhead adjacent to Orient Harbor will be maintained and in
fact increased by one foot as a result of the relocation of the existing dwelling structure, and the
proposed addition will be located on the landward side of the relocated dwelling;
5. To ensure that the project does not increase the potential for stormwater runoff and would instead
result in a potential reduction in runoff reaching Orient Harbor through improved site drainage, a
stormwater drainage system is designed to capture and recharge roof runoff from the finished
dwelling structure;
6. As a means of providing a potentially substantial increase in the protection and improvement of
water quality, the existing conventional septic system will be removed and replaced with a low-
nitrogen,UA sanitary system designed to significantly reduce nitrogen loading into the groundwater
and thus ultimately the surface waters of Orient Harbor; and
7. A project limiting fence would be installed to contain site disturbance and potential surface runoff
during construction.

'513 A DETIRMINATION. The,Zoning Board of Appeals has visited the property, under consideration in this
application and determines that this review falls under the Type II category of the•State'-s List of Actions, without_
further.steps under SEQRA. .
SUFFO_LK COUNTY,ADMINISTRATIVE CODE: This application was referred as required under the Suffolk
County Administrative Code Sections A 14-14 to23,and the Suffolk County.Departmdnt.of Planning issued its reply
dated October 13,202.1 stating that this application is considered a matter for local determination as there appears to
be no significant county-wide or inter-community impact.
LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency
review of the Town of Southold Town Code 'and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. The LWRP Coordinator issued a recommendation dated January 19, 2022. Based upon the information
provided on the LWRP Consistency Assessment Form submitted to this department;as well as the records available,
it is recommended that the proposed action is CONSISTENT with LWRP policy standards and therefore is
CONSISTENT with the LWRP.
PROPERTY FACTS/DESCRIPTION: The subject property is a non=conforming 10,449.29 square foot waterfront
parcel.located in an R-40 Zoning District. The parcel is irregularly shaped and measures 85 feet along Orient Harbor.
The parcel runs 91.58 feet on the North side and 131.20 feet on the East side: 'The Southeast-corner of the,pareel-
touches•VilIage'Lane(AKA Maiii Street). The parcel then runs 128.95 feet on the South side before turning 35.17
feet on the Southeast side,and then turning for 42.12 feet on the South side. The parcel is accessed via private right
of way known as Bay Lane which is located on the.Western side of the parcel. The parcel is improved with a two-
story frame dwelling,with a covered porch, an accessory frame garage, and a,concrete/stone seawall. All is shown
on a survey by.Kenneth M. Woychuck, L.L.S.dated August 1,2017.

RELIEF REQUESTED: The applicant requests a variance to make alterations and additions which include relocation
and elevation of the single-family dwelling resulting in a rear yard setback of 3.8 feet where a minimum rear yard
setback of 35 feet is required by Town Code. According to the applicant's representative, in order to make the
i dwelling FEMA and New York State compliant,the dwelling will be raised approximately three feet.
ADDITIONAL INFORMATION: An existing accessory garage located .6 feet from the rear property line will be
demolished. The applicant has the benefit of a Certificate of Appropriateness, dated November 19,2020, issued by
I the Town's Historic Preservation Commission. The applicant's representative indicated that an Innovation Advanced
Septic System is proposed.

FINDINGS.OF FACT/REASONS FOR BOARD ACTION:
The Zoning Board of Appeals held a public hearing on this application on February 3,2022 at which time written
and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property
and surrounding neighborhood,and other evidence, the Zoning Board finds the following facts to be true and
relevant and makes the following findings:
1. Town Law U67-b(31(b)(1). Grant of the variance will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. The neighborhood consists pf older single-family dwellings
located on a private, gravel, single-lane road that runs along Orient Harbor. Most,of the lots are irregularly shaped
and many homes have historic landmark designation and pre-existing non-conforming setbacks. the applicant-has
obtained a Certificate of Appropriateness from the--Historic Preservation Commission for the proposed construction
and renovation which includes elevating and relocating the existmg,two;story. dwelling.slightly toahe-south which '
Will remove a non-conforming:33 foot side yard setback., and adding a.ohe-story"master bedroom addition located
so as to preserve the water view of the neighbor to the East of the applicant's rear yard: The proposed construction
will conform to the town of Southold's maximum lot coverage requirements..
2. Town.Law 4267-b(3)(b)(2). The benefit sought by the-applicant cannot be.achieved by some method, feasible
for the applicant-to pursue,other than an area variance. The lot is oddly shaped and is improved.with a home that is
pre-existing non-conforming. Any design scheme which includes preserving and/or adding to the shape of the
existing home will require the benefit of an area variance,
3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 90%relief
from the code.However,the proposed setback is more conforming than the setback of the existing accessory,garage
which is being demolished, and the application is LWRP Consistent.
4. Town--L-aw$267-b(3)(b ML-No evidence has been submitted to suggest that a-variance.in.this residential
community will have an adverse impact on the physical or environmental conditions in the neighborhood. The
applicant must comply with Chapter 236 of the Town's Storm Water Management Code, The old septic
system will be abandoned and a new IA wastewater treatment sanitary system is proposed which.will improve the
environment.
5. Town Law,4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the
Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the
limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase.
6.Town Law&267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of a FEMA compliant dwelling with additions while preserving and protecting the
character of the neighborhood and the health,safety and welfare of the community.

I. Prior to receiving a building permit,the owner(s)of the subject property cited herein must sign a statement
acknowledging:
a.That the applicant(s)have read this determination and understand the limits of the variance relief granted

b. That the applicant(s)will immediately contact the Building Department if a demolition,as defined by
Section 280-4 of the Town Code, occurs during construction,or any construction undertaken in any other
way Iexceeds the scope of the approvals granted herein,or the issued building permit;
c. That the applicants are aware that the Zoning Board of Appeals retains jurisdiction until the issuance of
the Certificate of Occupancy and has.the right;.after a public hearing,to modify, suspend or revoke such
approvals or any term or condition thereof or:to impose thereon one or more new conditions, pursuant to
Article XXV, Section 280-141 of the Town'Code: ..
2. The applicant shall-install an Innovative Advanced(I/A),Sa itary System approved by the Suffolk County
Department of Health..
This approval shall not be deemed effective until th'e required conditions have been met.At the discretion of the

cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving
nonconformities under the zoning code. This action does not authorize or condone any current or future use,setback

features as are expressly addressed in this action: In the event that this is an approval subject to conditions, the
