All aspects of the project shall be constructed and maintained substantially in accordance with the approved site plan including the architectural drawings. 2. No retail sales or access by the general public permitted. 3. This site is designed and approved for wine production and storage, not as a public tasting room, with a designated area for office and meetings for staff and wine professionals only. 4. All exterior lighting on the property, including lighting on the former residential building, shall comply with the provisions of Chapter 172 of the Town Code, and the lighting plan pages of the approved site plan. Any future exterior light fixtures not shown on the approved site plan must be reviewed for compliance and approved by the Planning Board prior to installation. 5. Proposed signs must be submitted to the Planning Board for review and approval prior to receiving a permit. The Planning Board did not review or approve any signs during the site plan review. 6. All trees and landscaping are required to be maintained by the property owner as shown on the approved site plan. Should a tree die or otherwise be destroyed, it must be replaced with the same species and size as shown on the approved site plan within 6 months. Any change in tree or landscaping species must be approved in writing by the Planning Board. Please also note the following requirements in the Southold Town Code relating to Site Plans: 1. Any new lighting fixtures beyond those approved as part of the Lighting Plan must conform to the Code and may require Planning Board approval depending on their number, size, intensity and location. Fixtures shall be shielded so the light source is not visible from adjacent properties and roadways and shall focus and direct the light in such a manner as to contain the light and glare within property boundaries and conform to §172 of the Town Code. 2. Proposed storm water run-off containment systems must be inspected by the Town Engineer at the time of installation. Please call the Southold Town Engineer prior to beginning this work. 3. Approved Site Plans are valid for eighteen months from the date of approval, within which time all proposed work must be completed, unless the Planning Board grants an extension. Prior to the issuance of a Certificate of Occupancy, the Planning Board must inspect the site to ensure it is in conformity with the Approved Site Plan, and issue a Final Site Inspection approval letter. Should the site be found not in conformance with the Approved Site Plan, no Certificate of Occupancy may be issued unless the Planning Board approves the changes to the plan. The Town of Southold Planning Board as lead agency has determined that the proposed action described below will not have a significant adverse impact on the environment. Name of Action: Sepenoski Standard Subdivision SCTM#: 1000-31.-1-5.9 Location: 7395 NYS Route 25, East Marion, NY SEQR Status: Type I ( ) Unlisted (X) Description of Action: This proposal is for a clustered four-lot standard subdivision of 7.92 acres, where Lot 1 is 0.73 acres, Lot 2 is 0.5 acres, Lot 3 is 5.9 acres inclusive of a 0.4-acre residential development area, and a 0.6-acre agricultural development area, and 4.9 acres of open space, and Lot 4 is 0.74 acres in the R-80 Zoning District. Reasons Supporting This Determination: A Short Environmental Assessment Form has been submitted and reviewed and it was determined that no significant adverse effects to the environment were likely to occur should the project be implemented as planned. 1. Impact on Land — Low Adverse Impacts The parcel is currently being used as farmland and is located within the R-40 Zoning District. The parcel is also located in the Agricultural Exemption District. On the parcel is a seasonal farm stand and multiple frame structures used for agriculture. The proposed subdivision will create four new parcels, with Lot 3 containing the farm. Lot 3 will include the conversion of 0.4 acres from agricultural use to residential use, and Lot 4 will be a 0.74-acre residential flag lot in the R-40 Zoning District. Low adverse impacts are anticipated if the standards and conditions for all required permits and approvals are followed and implemented. 2. Impact on Geological Features — No Adverse Impacts No significant geologic features are located on the parcel. 3. Impact on Surface Water— No Adverse Impacts No wetlands are located on or around the parcel. 4. Impact on Groundwater— Low Adverse Impacts The parcel is located within Suffolk County Department of Health Services (SCDHS) Groundwater Management Zone IV. Any residences will be required by the SCDHS to have Innovative/Alternative Onsite Wastewater Treatment Systems (I/A OWTS) installed. An I/A OWTS will have an improved nitrogen removal capacity and will reduce nutrient input to adjacent waters. 5. Impact on Flooding — No Adverse Impacts The parcel is not located within a FEMA flood zone, 100-year floodplain, or 500- year floodplain. 6. Impact on Air— No Adverse Impacts There are no expected changes in air quality. 7. Impact on Plants and Animals — No Adverse Impacts The New York State Environmental Assessment Form (EAF) Mapper states that the Northern Long-Eared Bat may occur onsite. However, due to the existing disturbance on the parcel from agriculture, no adverse impacts are expected. 8. Impact on Agricultural Resources — Low to Moderate Adverse Impacts The parcel is located within the Agricultural Exemption District. The future development of the lots with residences will result in the loss of a small amount of prime soils onsite, however the impact overall will be small. Future residents on all of the lots must abide by Southold Town regulations to protect agricultural operations and practices through §280-97 Right to Farm regulations. Page 2 of 4 9. Impact on Aesthetic Resources — Low Adverse Impacts The area most visible to NYS Route 25, which is part of the NYS designated North Fork Trail Scenic Byway, will remain as protected farmland. There will be no significant adverse impact to aesthetic resources. 10.Impact on Historic and Archaeological Resources — No Adverse Impacts According to the NYS Cultural Resources Information System, the parcel is located within the East Marion Main Road Historic District, and the large barn structure on the parcel is a listed historic building known as "Brown's Farm." The structure is not proposed to be removed in the subdivision, and the construction of a single-family home is a permitted use in a NYS Historic Preservation District pursuant to Town Code §280-193. 11.Impact on Open Space and Recreation — No Adverse Impacts The parcel is in private ownership and it is proposed that 60% of the parcel be farmland and open space. The site does not currently offer public open space or recreational opportunities. 12.Impact on Critical Environmental Areas — No Adverse Impacts There are no Critical Environmental Areas on the property. 13.Impact on Transportation — No Adverse Impacts A new driveway is proposed along Rocky Point Road to serve Lots 3 and 4. No other additional access points are proposed on any other subdivided parcels. Transportation generation from three additional lots will be negligible. 14.Impact on Energy — None to Low Adverse Impacts No major change in the use of either the quantity or type of energy will occur. New construction will be required to meet Energy Star standards, and all lighting fixtures are required to be compliant with Town Code §72 Lighting. 15.Impact on Noise, Odor, and Light— No Adverse Impacts There are no expected significant changes for noise, odor and light quality. 16.Impact on Human Health — No Adverse Impacts There are no expected changes in human health. 17.Consistency with Community Plans — Consistent The proposed subdivision is consistent with the Town of Southold Comprehensive Plan, Chapter 9 Agriculture via: Goal 1: Retain and Advance the Industry of Agriculture Objective 1.3: Continue to protect farmland from conversion to a non-agricultural use. Page 3 of 4 The proposed locations of the subdivided lots are positioned in a way to discourage the fragmentation of the available farmland between all proposed lots. On August 19, 2026, a Town of Southold LWRP Coastal Consistency Review was conducted for the proposed subdivision, and it was found "consistent" with the Town of Southold LWRP. 18.Consistency with Community Character— Consistent The proposed lots are consistent with the surrounding community character, which consists of residential and agricultural uses in the R-80 Zoning District. Following the transfer Lot 1 would equal 1.83 acres, and Lot 2 would equal 7.21 acres in the R-80 Zoning District; and WHEREAS, at their work session on November 4, 2024, the Southold Town Planning Board found the Resubdivision application complete; and WHEREAS, on November 5, 2024 the Southold Town Planning Board approved the waiver of certain provisions of the Southold Town Code §240 Subdivision of Land pursuant to §240-56 Waivers of certain provisions; a. Article V: Sketch Plat Review; b. §240-10 (A): Existing Resources Site Analysis Plan (ERSAP); c. §240-10 (B): Yield Plan; Narrow River, Armstrong & Rivera Resubdivision September 15, 2026 d. §240-10 (C). Primary & Secondary Conservation Area Plan; e. Article VI.- Preliminary Plat Review, WHEREAS, on December 2, 2024 a Public Hearing was held and closed on the Final Plat with no comment; and WHEREAS, on February 10, 2025, the Southold Town Planning Board determined this application is EXEMPT from review by the Local Waterfront Revitalization Program as no new development potential will come as a result of this Resubdivision; and WHEREAS, on February 10, 2025, the Southold Town Planning Board, pursuant to State Environmental Quality Review Act (SEQRA) 6 NYCRR, Part 617, determined that the proposed action is a Type II Action under SEQRA according to 617.5(c)(16) "granting of individual setback and lot line variances and adjustments;' and WHEREAS, on February 10, 2025, the Southold Town Planning Board granted Conditional Final Plat Approval upon the map entitled "Subdivision Jeremy Armstrong, Lot Line Modification" prepared by Young Associates, last revised September 3, 2024, subject to the following conditions: (1) submission of a copy of Suffolk County Department of Health Services (SCDHS) approval; and (2) setting of property boundary marker monuments to mark the new corners of each property with verification to the Planning Department; and WHEREAS, on August 7, 2025, the applicant requested an extension of the Conditional Final Plat Approval; and WHEREAS, on November 5, 2025, the Southold Town Planning Board granted an extension of the Conditional Final Plat Approval from August 11, 2025 to August 11, 2026; and WHEREAS, on April 24, 2026, the applicant notified the Planning Department that the property boundary marker monuments have been placed; and WHEREAS, on May 14, 2026, the applicant submitted a copy of the Suffolk County Department of Health Services (SCDHS) approval; and WHEREAS, on June 10, 2026, Planning Department staff reviewed the materials submitted for Final Plat Approval and identified inconsistencies between the proposed Final Plat and the existing recorded Covenants and Restrictions; WHEREAS, on July 21, 2026, the applicant submitted a further revised map for review addressing requirements from the recorded Covenants and Restrictions; and Page 2 of 3 Narrow River, Armstrong & Rivera Resubdivision September 15, 2026 WHEREAS, on August 5, 2026, the Town Engineer provided comments on the revised map identifying corrections required to address Chapter 236, Stormwater Management, requirements, and WHEREAS, on August 5, 2026, the applicant submitted a further revised map addressing the comments provided by the Town Engineer; and WHEREAS, on August 6, 2026, the revised map was referred to the Town Engineer for review and sign-off; and WHEREAS, on August 7, 2026, the Town Engineer determined that the revised plan was compliant with the requirements of Chapter 236, Stormwater Management, of the Southold Town Code; and WHEREAS, on September 2, 2026, the applicant submitted a copy of the Suffolk County Department of Health Services (SCDHS) approval; and WHEREAS, all conditions of the Conditional Final Plat Approval have been satisfied; be it therefore RESOLVED, that the Southold Town Planning Board grants Final Plat Approval upon the map entitled "Subdivision Jeremy Armstrong, Lot Line Modification" prepared by Young Associates, last revised August 13, 2026.
