All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area(which includes all of Southold Town). 3. If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be explained in detail, listin1l both supporting and non- supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken. Since the weather has turned, I will only be able to do the native plants planting in the spring of 2026. Please let me know if you have any questions. I will make sure that not native vegetation will be harmed during the removal of the retaining wall and fill material. My goal is to carefully start the removal of the fill first in order to not harm any surrounding native flora, and once the original grade has been reached, carefully remove the wall. The timeline should be to start the fill removal within the next 15 days and hopefully be done by the end of September, if not mid October. Once that has been accomplished, I will in proceed to plant some native flora species as recommended in the approved plans by the NYSDEC, such as cotton bush, native ferns and native grass. This should be the second half of the restoration, hopefully will be done by November 1st. If you have any other recommendations regarding the native species, I will be very happy to hear them. As we discussed in the field, the retaining wall and fill material surrounding your house were installed without the required approvals, to the detriment of the wetlands and marine environment surrounding Laurel Lake, and must be removed. The area should be restored to its original natural grade and condition by removing the illegally built retaining wall and removal of all fill. During the removal and restoration process, care must be taken to ensure that no existing native vegetation is disturbed. Preserving the native plants is essential for the stability and ecological integrity of the area. Today on field inspections we noticed from the adjacent property that the homeowners had installed a retaining wall along the entire seaward side of the home, brought in enough fill and topsoil to level out the rear yard to the point where the existing catwalk over the wetland was no longer required and grass was planted. Liz- Please send the bay constables for clearing, and covering wetlands, retaining wall and fill without a permit ideally all separate violations.
