Main.Rd. &Youngs Ave.) Southold, NY 11971 Telephone: 631 765-1938 OWN, LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD To: Tenn Goldsmith, President Town of Southold Board of Trustees Cc: Honorable Lori Hulse, Attorney From: Heather Lanza, AICP, Planning Director LWRP coordinator Gate: September 14, 2025 Re: LWRP coastal Consistency Review ROBERT PATTERSON, c/o DIANA PATTERSON, SCTM #1000-5.-1-10 This application is to demolish existing dwelling, accessory structures, and abandon existing septic system; construct a new two-story dwelling (3,605 sq. ft. footprint) with 950 sq. ft. of seaward decking and covered porches with steps, an 18.0'x19' partially covered raised terrace, a 7.0'x10.0' side bbq area with steps, a 6'x20.5' side covered porch with steps, two 51x16' balconies, a 5'x5' outdoor shower, a ±0' wide basement stair egress; install an VA OWTS sanitary system; install a stormwater drainage system; regrade, loam, seed and stabilize disturbed areas, relocated existing underground eleclteleldata services; install new a/c units and generator, and modify existing driveway. The proposed action has been reviewed under chapter §268, Waterfront consistency Review of the Town of Southold Town code and the Local Waterfront Revitalization Program (LWRP) Policy standards. Based upon the information provided on the LWRP consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the policies of the LWRP as follows: Policy 4. Minimize loss of life, structures, and natural resources from flooding and erosion 4.1 Minimize losses of human life and structures from flooding and erosion hazards A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. Policy 5. Protect and improve water quality and supply in the Town of Southold. 5.1 Prohibit direct or indirect discharges that would cause or contribute to contravention of water quality standards. C. Ensure effective treatment of sanitary sewage and industrial discharges by: 3. modifying existing sewage treatment facilities to provide improved nitrogen removal capacity. Policy 6. Protect and restore the quality and function of the Town of Southold's ecosystem 6.3. Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction This proposed action is on a lot with the Fishers Island Sound in the backyard and freshwater wetlands on the east and west sides of the property. The proposed action is consistent with Policy 4.1.A, which encourages structures to be away from flooding and erosion hazards. There are high-risk flooding hazards on the parcel within the FEMAAE flood zone (West) and the FEMA VE flood zone (North and East). There is also a Coastal Erosion Hazard Area on the coast of the Long Island Sound. The proposed residence is not located in any of these hazardous zones, minimizing the loss of life and structures. The proposed installation of an I/A OWTS is consistent with Policy 5.1.C.3, which calls for the replacement of existing sewage treatment facilities with one that improves nitrogen removal capacity. The proposed Innovative/Alternative Onsite Wastewater Treatment System (I/A OWTS) will reduce nitrogen inputs into adjacent waters. The proposed action is consistent with Policy 6.3.A, which states that actions must comply with the Southold Town Board of Trustees' laws and regulations. Moving the building footprint back from the wetland boundaries will allow the proposed residence to meet the wetland setbacks from Town Code Chapter §275-3(D)(1)(a)[1] Residence: 100 feet. The proposed leaching pools and I/A OWTS system also meet their wetland setbacks from Town Code Chapter §275-3(D)(1)(a), which are 100 ft. for the leaching pool and 75 ft. for the septic system. The proposed action has been reviewed under Chapter §268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. 2
