This application is to replace in-place and in-kind 12'x'l0' wood deck on seaward side of
dwelling with steps.
The proposed action has been reviewed under chapter §268, Waterfront Consistency
Review of the Town of Southold Town code and the Local Waterfront Revitalization
Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP consistency Assessment Form
submitted to this department, as well as the records available to me, it is my
recommendation that the proposed action is CONSISTENT with the policies of the
LWRP as follows:
Policy 4. Minimize loss of life, structures, and natural resources from flooding and
erosion
4.1 Minimize losses of human life and structures from flooding and erosion hazards
A. Minimize ,potential loss and damage by locating development ment and structures
away from flooding and erosion hazards
Policy 6. Protect and restore the quality and function of the Town of Southold's
ecosystem.
6.3. Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town
Board of Trustees laws and regulations for all Andros Patent and other lands
under their jurisdiction.
The proposed action is on a nonconforming lot with an existing nonconforming
residence along the wetland boundary of Hashamomuck Pond.
Policy 6.3.A states that actions must comply with the Southold Town Board of Trustees'
laws and regulations. The proposed in-place and in-kind replacement of the deck is
consistent with Town Code Chapter §275 and can be classified as an administrative
permit under Chapter §275-5(B)(2)(1) Decks.
The proposed action has been reviewed under Chapter §268, Waterfront Consistency
Review of the Town of Southold Town Code and the Local Waterfront Revitalization
Program (LWRP) Policy Standards.
