PATTERSON, SCTM #1000-9.-3-6 This application is to reconstruct an existing pier consisting of a landward 6' wide by ±34 linear foot long pile supported pier to an 8' wide by ±50 linear foot long pier to a hinged ramp to a new 12'x14' floating dock with ladder secured by four restraint piles; four (4) existing tie-off piles; pier to include rails on both sides, and water/electric utilities; and to maintain the existing ±265 linear feet of stone armor shore protection, resetting stone that have been displaced as necessary. The proposed action has been reviewed under Chapter §268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the policies of the LWRP as follows: Policy 4. Minimize loss of life, structures, and natural resources from flooding and erosion 4.1 Minimize losses of human life and structures from flooding and erosion hazards. D. Use hard structural erosion protection measures for control of erosion only where: 2. Vegetative approaches to controlling erosion are not effective Policy 6. Protect and restore the quality and function of the Town of Southold's ecosystem. 6.3. Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction The proposed stone material used for erosion control could be defined as a riprap pursuant to Town Code Chapter §275-2 Definitions: RIPRAP A layer, facing or protective mound of rubble or stones randomly placed to prevent erosion, scour, or sloughing of a structure or embankment; also the stone used for this purpose The maintenance of resetting displaced stone in the riprap revetment is consistent with Policy 4.1.D.2, which calls for using hard structural erosion protection measures for erosion when vegetative approaches are not effective. The wetland boundary of the parcel is located in the high-risk AE FEMA flood zone. In this case, a vegetative approach would not work because of the already existing riprap revetment. The proposed pier could be defined as a dock pursuant to Town Code Chapter §275-2 Definitions: DOCK Any permanent or seasonal structure, except a building, located or proposed to be located on lands abutting or comprised of freshwater or tidal wetlands or connected to a bulkhead or the upland and extending over the water's surface, designed to secure vessels and provide access from the shore to a body of water. For the purpose of this chapter, this term shall also include the associated structures necessary to cross wetlands and adjacent natural areas. The term "dock"includes the terms "wharves," "piers," "fixed docks," "docks,"or "floats." Additionally, the proposed access ramp could be defined as part of the residential dock pursuant to Town Code Chapter §275-2 Definitions: RESIDENTIAL DOCK Any fixed dock and/or floating dock designed or constructed as a continuous unit to provide access to the surface waters from a lot that is zoned for residential use. The term "dock"shall include all associated structures such as ramps and mooring piles. The proposed action is consistent with Policy 6.3.A, which states that actions must comply with the Southold Town Board of Trustees' laws and regulations. 2 The length of the proposed reconstructed dock complies with Town Code Chapter §275- 11 C(2)(b)[2], which states that no dock length shall exceed 1/4 the total width of the water body, including the dimensions of the vessel attached. The proposed action is located in the Hay Harbor off of Fishers Island and meets this requirement. Pursuant to Town Code Chapter §275-11 C(2)(c)[1] which states the regulations for residential docks, the proposed action meets the following regulations: [a] Only one mooring or dock may be permitted per residential lot. [c] In determining the permitted length of a proposed residential dock, the Trustees shall seek to maintain lengths consistent with the other docks (i.e., pier line) in the waterway which meet the requirements of this chapter. The proposed action includes the reconstruction of the dock on the parcel and is behind the pier line of the dock on the adjacent property. Let it be noted, to be compliant with the regulations for the Town Code Chapter §275- 11 C(2)(c)[1] Residential docks, a need must be demonstrated for the following: [b]If any part of a residential dock structure includes a float or floating dock, the float or floating dock portion shall be designed so that, with the exception of the pilings: [i] It is no larger than six feet wide and 20 feet long except on Fishers Island if the need is demonstrated; or of equal square footage as determined by the Trustees; [d]Pilings shall not project more than three feet above the surface of a dock or catwalk unless a need for greater height is demonstrated. [g] Only one handrail is permitted on a residential dock unless the need for two is demonstrated. Rails shall not be higher than three feet above the surface of the dock and posts shall not be placed closer than six feet on center or larger than four inches by four inches in dimension. The end of the proposed residential dock contains a floating dock that is 12 ft. x 14 ft. located on Fishers Island. The proposed action dock includes piles that are 4 ft. above the dock surface and a handrail on each side. The proposed action has been reviewed under Chapter §268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. 3 Town of Southold EQ FFMI IMID LWRP CONSISTENCY ASSESSMENT FORM AUG 218 h026 SOUTHOLD`fOWN PLANNING BOARD A. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area which includes all of Southold Town . 3. If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be explained in detail, listing both supp jj and non- supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and conditions,it shall not be undertaken.
