Main Rd. &Youngs Ave.) Southold, NY 11971 Telephone: 631 765 1938 cou .CCC LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD To: Glenn Goldsmith, President Town of Southold Board of Trustees Cc: Honorable Lori Hulse, Attorney From: Heather Lanza, AICP, Planning Director LWRP Coordinator Date: September 14, 2026 Re: LWRP Coastal Consistency Review NORTH FORK REALTY HOLDINGS, LLC, SCTM #1000-57.-1-8 This application is to construct a two-story dwelling with a 1,793 sq. ft. first floor and a 1 ,704 sq. ft. second floor including an 88 sq. ft. front portico with steps, a 4.6'x4.6' side entry with steps, 3'x16'x10.8' and 3'x10.4'x7.7' seaward entry stoops with steps to a raised (21" above grade) 482 sq. ft. porcelain pool patio with a 12'x33' pool with 1' wide coping surround and a 1' wide catch basin along south and east sides of pool; install a raised 550 sq. ft. porcelain patio with a 9'x10' raised hot tub; install 4' high pool enclosure fencing with gates, a pool drywell and pool equipment area; construct a 440 sq. ft. 1 '/2 story detached garage; install a buried propane tank, landward walkways, grass paver areas and a gravel driveway; install gutters to leaders to drywells to contain roof runoff; install an I/A sanitary system landward of dwelling; all excavation to be used for backfill and excess removed from site; and to establish and perpetually maintain a 15' wide non-turf buffer along the landward edge of the bulkhead. The proposed action has been reviewed under Chapter §268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the policies of the LWRP as follows: Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction The proposed action is on a nonconforming waterfront parcel within the wetland boundary of a canal. The proposed action is inconsistent with Policy 6.3.A, which states that actions must comply with the Southold Town Board of Trustees' laws and regulations. The proposed location of the single-family dwelling does not comply with the wetland setbacks set in Town Code Chapter §275-5D(a)[1] Residence: 100 feet. The proposed locations of the I/A OWTS system and the proposed pool are consistent with Policy 6.3.A and comply with their wetland setbacks of 75 ft. and 60 ft. in Town Code Chapter Town Code Chapter §275-5D(a). The proposed pool setback is compliant with Town Code Chapter §275-11A(4)(f), which states fences shall not be permitted within 20 feet of any wetland boundary. The proposed 15 ft. nonturf buffer is consistent with Policy 6.3.D, which calls to provide adequate buffers between wetlands and adjacent or nearby uses. This nonturf buffer will mitigate and avoid adverse effects from development. The proposed action has been reviewed under Chapter §268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. 2 Town of Southold LWRP CONSISTENCY ASSESSMENT FORM "31EP 0 3 2026 SOUTHOLD TOWN A.
