SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated May 4, 2026 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated August 19, 2026. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available, it is recommended that the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP for the following reasons: Policy 6. Protect and restore the quality and function of the Town of Southold's ecosystem 6.3 Protect and restore tidal and freshwater wetlands A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands tinder their jurisdiction. The proposed action is inconsistent with Policy 6.3 because the garage roof expansion was built without regulatory pen-nits. The proposed action is located on a waterfront parcel along James Creek. The proposed action can be deemed CONSISTENT with the LWRP policies when all regulatory permits are obtained. PROPERTY FACTS/DESCRIPTION:The subject property is a conforming 90,152 square foot(2.07-acre) lot in the R-80 Zoning District fronting partially on the curve of Ole Jule Lane. The rear of the property is situated on James Creek and includes a fixed pier and floating dock that extends into the creek.There are tidal wetlands on the western portion of the property. The lot is developed with a single-family residence with attached roofed over car port and a garage with shed.The lot measures 186.37 feet along the westerly property line fronting on James Creek; 534.17 feet along the northerly property line adjacent to a residentially developed lot; 156.00 feet along the easterly property line; and 570.00 feet along the southerly'property line as shown on a survey stamped and signed by Angelo Joseph Cecere, Licensed Land Surveyor last updated April 30,2025. f Page 2 File No. 8125 Marie-Elena Lynch-Dobert SCTM# 1000-122-4-1 BASIS OF APPLICATION: Request for Variance from Article III Sections 280-14 and the Buildings Inspector's February 20, 2026 Notice of Disapproval based on an application for a permit to legalize an "as built" roofed over carport attached to an existing single-family dwelling at less than the code required minimum side yard setback of 20 feet located at 1350 Ole Jule Lane, Mattituck,NY(adjacent to James Creek), SCTM No. 1000-122-4-1. RELIEF REQUESTED: The applicant requests a variance to legalize an as-built roofed over carport attached to a single-family dwelling with a side yard setback of 9.1 feet where the code requires a minimum side yard setback of 20 feet on this conforming 90,152 square foot lot. ADDITIONAL INFORMATION: An adjacent neighbor submitted a letter indicating no objection to the subject application. At the public hearing the property owner testified that the detached garage on the subject property is used for storage and presents practical difficulties for using it to store their cars. Existing improvements on the property are covered by the following Certificates of Occupancy: No. Z13791 dated August 22, 1985 for a new one-family dwelling, No. Z-28467 dated May 29, 2002 for an accessory building as applied for, No. Z-24796 dated Dec. 2, 1996 for a greenhouse addition to existing one family dwelling as applied for, and No. Z-24797 dated Dec. 12, 1996 for an accessory storage shed in front yard of a waterfront dwelling as applied for. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 3,2026 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject carport has existed on the applicant's property since 2007; cannot be seen from the street; and is located on a portion of the property that is not close to the neighbor's house or improvements on the adjacent property. 2. Town Law $267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The "as built" carport is located in an appropriate location for this type of amenity relative to the existing dwelling and the driveway. However, the northerly corner of the carport encroaches into the required side yard setback and therefore, the structure cannot legally remain in place, without variance relief. 3. Town Law U67-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 54.5%relief from the code. However,the carport is well integrated into the design of the existing house and has no visible impact on the road or adjacent properties or adverse environmental impact on James Creek since it is located on the landward side of the dwelling.Additionally,most of the carport has a greater side yard setback than the northerly corner of the structure. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood.The carport is located on the opposite side of the dwelling from the tidal wetlands on the property,was constructed almost twenty years ago over the impervious surface of the driveway, and has caused no measurable impact to the environmental conditions on the property or neighborhood. Moreover,the applicant must comply with Chapter 236 of the Town's Storm Water Management Code and obtain approvals from the Town of Southold Board of Trustees. 1 Page 3 File No. 8125 Marie-Elena Lynch-Dobert SCTM# 1000-122-4-1 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law V67-b. Grant of the variance relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an "as built" roofed over carport attached to their dwelling while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman, seconded by Member Lehnert, and duly carried, to: GRANT the variance as applied for, and shown on the survey prepared by, stamped, and signed by Angelo Joseph Cecere, Licensed Land Surveyor last updated April 30, 2025. SUBJECT TO THE FOLLOWING CONDITION: 1. The applicant shall obtain approval for the"as built"carport from the Southold Town Board of Trustees. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity, provided de minimis relief is requested within one year of the date of this decision Any time after one year, the Board may require a new application. IMPORTANT LIMITS ON THE APPROVAL(S) GRANTED HEREIN Please Read Carefully Any deviation from the survey, site plan and/or architectural drawings cited in this decision, or work exceeding the scope of the relief granted herein, will result in delays and/or a possible denial by the Building Department of a buildingpermit and/or the issuance of a Stop Work Order,and may require a new application andpublic hearing before the Zoning Board of Appeals. If all regulatory permits are obtained, the proposed action could be deemed consistent under the LWRP policies below: The proposed action is consistent with Policy 4.1.A which calls to locate development and structures away from flooding and erosion hazards. The proposed roof expansion is not located within the high-risk.FEMAAE flood zone on the west side of the property. Although the proposed action is on a lot with a nonconforming pre-existing residence, it is consistent with Policy 6.3.A, which states that actions must comply with the Southold Town Board of Trustees' laws and regulations. The proposed construction is attached landward of the existing building footprint and complies with Town Code Chapter §275- 5(2)(c) which states construction of additions to the landward side of an existing functional single-family dwelling, where such dwelling generally lies parallel to the wetland boundary and provided that all new and existing runoff is captured on site. Such addition must be less than or equal to 25% of the area (footprint) of the existing structure. In addition to the Zoning Board of Appeals variance, please note the proposed action is within the jurisdiction of the Board of Trustees, and requires the approval of a wetland permit. INTRODUCTION Zoning Board of appeals Marie Elena Lynch-Dobert (the "Applicant"), herein applies for the legalization of an existing, as-built garage roof extension located at 1350 Ole Jule Lane,Mattituck,NY(SCTM No. 1000-122-4-1) (the "Premises"). The proposed development requires relief from the side yard setbacks for the existing dwelling. II. STATEMENT OF FACTS The subject 90,152 sq ft/2.07 acre lot is located in the Residential R-80 District and fronts partially on the curve of Ole Jule Lane; the rear of the property is situated on James Creek and includes a fixed pier and floating dock that extends into the creek. The tidal wetlands on the western portion of the property were last flagged on January 28,2025. The property was transferred into the Applicant's name,as wife with rights of survivorship, with her husband Ronald S. Dobert, on March 12, 2029; the deed is attached as Exhibit A. Mr. Dobert constructed the primary dwelling in 1983 and subsequently added a greenhouse, frame shed, and carport(attached to shed)to the property, all with the required permits. The Certificates of Occupancy are attached herein as Exhibit B. However, the carport that is the subject of this application was not part of any of these previous approvals and the Applicant,realizing the oversight, applied accordingly to the Building Department in order to rectify any outstanding issues with subject property. The Notice of Disapproval, dated February 20, 2026 was received for the existing roof-over carport attached to` the primary dwelling (attached herein as Exhibit C). The sunroom and generator that were part of the initial application to the Building Department do not require approval from this Board but will be part of the Applicant's future application to the Board of Trustees. III. NATURE OF RELIEF REOUESTED The Applicant requests variance relief from the yard setbacks contained in the Town of Southold Code §280-14 as follows: a. Existing "as built" roofed:over carport to the existing single-family dwelling, located 9.1 feet from the side yard boundary line, where 20 ft is required. IV. STANDARDS FOR THE GRANT OF AREA VARIANCES Pursuant to Town Law Section 267-b,the Zoning Board of Appeals is required to take into consideration the following factors when weighing the benefit to the applicant if the variance is granted against the detriment to the health, safety, and welfare of the neighborhood and community: a) Whether the grant of the variance will cause an undesirable change in the character of the neighborhood or will create a detriment to nearby properties; Applicant:Marie Elena Lynch-Dobert Received Premises: 1350 Ole Jule Lane, Mattituck b) Whether the benefits sought by the applicant can be achiev^U409ethod feasible for the applicant to pursue'other than an area variance; Appeal, Zoning Board of c) Whether the requested area variance is substantial; d) Whether the grant of the,variance will have an adverse effect or impact upon the physical or environmental conditions in the neighborhood or in the affected area of the Town; I � e) Whether the difficulty causing the applicant to request an area variance was self-created which consideration shall be relevant to the determination of the Board but shall not necessarily preclude the grant of the variance. These variance standards are addressed as follows: a) There is no undesirable change in the Character of the Neighborhood and detriment to nearby properties (Town Law &267-b (3)(b)(1)). The subject improvement has existed on the property, albeit without the proper approvals, since at least 2007. The roof-over carport has not caused any measurable detriment to the - surrounding properties or to the character of the neighborhood. Although it extends into the side yard setbacks for the main dwelling,it is located in a portion of the property that is not close to the neighbor's house or improvements on the adjacent property(930 Ole Jule Lane,Mattituck, SCTM No. 1000-114.00-12.00-013.007) (see attached NearMap aerial from April 9. 2025 as Exhibit D). The roof-over carport attached to the existing dwelling is in the appropriate location for such an amenity;the driveway leads up to the.garage on the side of the dwelling and the carport is located directly adjacent to it and shields the entrance to the garage. This is visible in the photos included as Exhibit E. c) The area variances requested are not substantial(Town Law &267-b (3)(b)(3)). Although this application is for the legalization of an existing improvement, constructed without approval, and it is located over 50% within the side yard setbacks, the structure itself, when taken in the context of the property and the surrounding uses, is not substantial. It does not offend or encroach on any of the neighboring residential uses and operates merely as an extension of the existing dwelling. d) There is no adverse impact on the physical and environmental conditions to the neighborhood/town ((Town Law 4 267-b (3)(b)(4)). The to-be-legalized improvement is located on the opposite side of the dwelling(as shown in Exhibit D)from the tidal wetlands located on the property and,in the almost 20 years that it has existed, has not caused any measurable impact to the environmental conditions both on the property or in the neighborhood generally. The carport was constructed.over an previously ' disturbed impervious surface (i.e. the existing driveway),and matches the material used for the main dwelling. e) This is a self-created difficulty ((Town Law 4 267-b (3)(b)(5)). Although the difficulty is self-created, in that the existing improvement was constructed on the subject property without a permit, this factor should not be determinative and preclude the granting of an area variance.
