FINDINGS,DELIBERATIONS AND DETERMINATION MEETING OF SEPTEMBER 17,2026 ZBA FILE: #8126 NAME OF APPLICANT: Martin Finnegan and Dylan Hahn PROPERTY LOCATION: 14065 Main Road and 1710 Pike Street, Mattituck NY 11952 SCTM: 1000-140-3-27 & 1000-140-3-19.1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. SOUTHOLD TOWN PLANNING BOARD: The application was referred to the Town of Southold Planning Board for commentary and provided a written reply on September 2, 2026, indicating: 1. The proposed lot line modification between two existing parcels,where approximately 18,931 square feet of land will be transferred from SCTM 1000-140-3-27 to SCTM 1000-140-3-19.1 where Lot #1 (19.1) will increase in size to 37,912 square feet and Lot#2(27)will decrease in size to 17,662 square feet,where both parcels will remain non-conforming (under 40,000 square feet of area) to the requirements of the zone in which they are located. Lot 42 is also currently non-conforming with respect to lot width,with approximately 66.29 feet where 150 feet is required, and will remain non-conforming after the action. Furthermore, the proposed Lot#2 will be substantially similar to that of the parcel immediately to the west. The proposed lot line modification does not include additional development,an increase in density,or an intensification of the existing uses. The requested relief is therefore associated with accommodating a revised configuration of two existing undersized parcels, reducing the degree of lot area non-conformity for proposed Lot#1 while increasing the degree of lot area non-conformity for proposed Lot#2. 2. The Planning Board finds that the proposed lot line adjustment is generally consistent with the goals and objectives of the Town of Southold Comprehensive Plan, particularly those relating to land use,zoning,and preservation of community character. 3. Given that the proposal does not include additional development or an increase in density or intensity of use, the Planning Board recognizes that the proposed lot line modification involves a tradeoff between the dimensional conditions of the two existing parcels and considers the resulting configuration reasonable. Page 2, September 17, 2026 #8126, Finnegan/Hahn SCTM No. 1000-140.-3-27 & 19.1 Any approval should be carefully conditioned to reflect these site-specific circumstances and to avoid establishing a broader precedent for the creation of undersized lots or the expansion of existing non-conformities. PROPERTY FACTS/DESCRIPTION: Surveys provided include the current and proposed conditions for both lots subject of this application;presently, the lots measure: Lot #1 (SCTM: 1000-140-03-19.1) is currently a 18,981 square feet, 0.43 acre, non-conforming parcel located in the R-40 Zoning District and measures, 153.43 feet along Pike Street,then runs south 124.10 feet along a residentially developed lot to the east, then runs west 151.23 feet along a residentially developed lot (also subject of this application)to the south,then returns 125.29 feet back to the roadway. The subject parcel is improved with a 2-story frame house with an attached garage,an asphalt driveway,walkways,rear brick terrace and a roof over screen porch. Lot#2 (SCTM: 1000-140-3-27) is currently a 36,593 square feet, 0.84 acre, non-conforming parcel located in both the RO and R40 Zoning District (majority is RO Zoned) and measures 67.1 feet along Main Road (S.R. 25), then runs north 401.67 feet along a residentially developed lot to the east, then runs west 140.21 feet along a residentially developed parcel to the north (subject of this application), then returns 134.73 feet along a residentially developed parcel to the west,runs east 74.31 feet along a residentially developed parcel to the south and continues,south 266.46 feet along the same residentially developed parcel back to the roadway. The parcel is developed with a 2-story wood frame residence with covered wrap-around front porch, a side deck,concrete patio, gravel patio,brick walkways and gravel driveway all as shown on the survey prepared by Nathan Corwin Taft, III, Licensed Land Survey April 28, 2025. Should relief be granted the lots will measure: Lot#1 (SCTM: 1000-140-03-19.1) is proposed to be 37,912, 0.87 acre, non-conforming parcel located in both the R-40 and RO Zoning Districts(majority of the parcel lies in the R40 Zoning District)and measures 153.43 feet along Pike Street,then runs south 124.10 feet along a residentially developed lot to the east,then runs west 11.02 feet and continues south 135.94 feet along two residentially developed lot to the east, then runs west 140.80 feet(along the residentially developed lot to the south, subject of this application) and continues north 260.02 feet back, along a residentially developed lot to the west, to the roadway. Improvements on this parcel will remain the same as prior to the action. Lot #2 (SCTM: 1000-140-3-27) is proposed to be 17,662 square feet, 0.40-acre, non-conforming parcel located entirely in the RO Zoning District and measures, 67.1 feet along Main Road(S.R. 25), then runs north 265.73 feet along a residentially developed lot to the east,then runs west 65.49 feet along a residentially developed parcel to the north(subject of this application),then returns 266.46 feet along a residentially developed parcel to the west back to the roadway. Improvements on this parcel will remain the same as prior to the action, all as shown on the survey prepared by Nathan Corwin Taft, III, Licensed Land Surveyor, dated April 28, 2025. BASIS OF APPLICATION: Request for Variances from Article IV, Section 280-18, Article VIII Section 280-39 and the Building Inspector's March 16,2026 Notice of Disapproval based on an application for a permit for a lot line change; at: 1) proposed Lot 1 (lot 19.1) having less than the permitted lot area of 40,000 sq. ft.; 2) proposed Lot 2 (lot 27) having less than the permitted lot area of 40,000 sq. ft., 3) Lot#2 (lot 27) having less than lot width of 150 feet; located at: 14065 Main Road and 1710 Pike Street, Mattituck, NY. SCTM Nos. 1000-140-3-27 & 1000-140- 3-19.1. RELIEF REQUESTED: The applicant requests three variances to transfer approximately 18,931 square feet of area from Lot#2,to Lot#1 where Lot#1, after the proposed transfer will be a non-conforming lot area of 37, 912 square feet, 0.87 acre,where 40,000 square feet of area is required by the split zone of R40 and RO Zoning designation and where Lot#2, after the proposed transfer, will be a non-conforming 17,662 square feet, 0.40 acre parcel located in the RO Zoning District where a minimum lot size of 40,000 square feet is required. Additionally, after the transfer, the non-conforming and existing front yard width of Lot#2,along Main Road(S.R. 25),will remain 67.1 feet as per Page 4, September 17, 2026 48126, Finnegan/Hahn SCTM No. 1000-140.-3-27& 19.1 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Due to the pre-existing non-conformities of both parcels, there is no way that their common lot line can be relocated without variance relief for the resulting lot area of each parcel and the lot width of the parcel to be reduced, known as Lot#2. 3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial, 55.8% relief from the code for the creation of the proposed Lot#2 area and 55.84% relief from the code for the pre-existing lot width of Lot #2. The variance granted herein for the proposed Lot #1, area is 5.2% and is not substantial. However, the applicant submits that the lot area to be transferred between the two parcels, 18,931 square feet, will result in a substantially more conforming parcel,Lot#1. Additionally, Lot#2,as reduced in lot area will essentially mirror the neighboring parcel to the west; furthermore,there is no change to the pre-existing, non-conforming width of Lot 42. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of the relocation of lot area between parcels to allow Lot#1 to contain 37,912 square feet and Lot# 2 to contain 17,662 square feet of lot area with a pre-existing non-conforming lot width of 66.29 feet while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Planamento, seconded by Member Acampora, and duly carried, to GRANT the variances as applied for,and shown on the survey prepared by Nathan Corwin Taft,III, Licensed Land Surveyor, dated April 28, 2025. SUBJECT TO THE FOLLOWING CONDITIONS: 1. This action must be approved by the Town of Southold Planning Board 2. The applicant is to file Covenants and Restrictions, acceptable to the Town of Southold Town Attorney, indicating that the owner of the newly expanded Lot#1 (SCTM: 1000-140-3-19.1, 1710 Pike Street), will not seek the benefit of the newly created split zoned parcel and will, in perpetuity, honor the limitations of the R40 Zoning District,which is the majority of the lot. 3. The applicant must register the two subject lots with Suffolk County and the Town of Southold. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appealsfailure to comply with the above conditions may render.this decision null and void. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity, provided de minimis relief is requested within one year of the date of this decision Any time after one year,the Board may require a new application. Any deviation from the variance(s)granted herein as shown on the architectural drawings,site plan and/or survey cited above,such as alterations, extensions, demolitions, or demolitions exceeding the scope of the relief granted herein, are not authorized under this application when involving nonconformides under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses,setbacks and other features as are expressly addressed in this action. TIME LIMITS ON THIS APPROVAL: Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three(3)years from the date such variance was granted. Area Variance / Relief from §280-18 and §280-39: The applicant is requesting relief from § 280-18 and § 280-39 of the Town Code. Section 280-18 requires that buildings and premises within the R-40 Zoning District conform to the applicable requirements of the Town's Bulk Schedule, while § 280-39 establishes the applicable bulk and dimensional requirements for the Residential Office (RO) Zoning District. The proposal involves a lot line modification between two existing parcels. Specifically, approximately 18,931 sq. ft. of land will be transferred from SCTM #1000-140.-3-27 to SCTM #1000-140.-3-19.1. As a result, Proposed Lot 1 (SCTM #1000-140.-3-19.1) will increase from approximately 18,981 sq. ft. (0.436 acres) to 37,912 sq. ft., while Proposed Lot 2 (SCTM #1000-140.-3-27) will decrease from approximately 36,593 sq. ft. (0.840 acres) to 17,662 sq. ft. Both parcels are currently nonconforming with respect to the minimum 40,000- square-foot lot area requirement. The proposed lot line modification will reduce the degree of lot area nonconformity for Proposed Lot 1, while increasing the Page 11 degree of lot area nonconformity for Proposed Lot 2. Proposed Lot 2 is also currently nonconforming with respect to lot width, with a width of approximately 66.29 feet, where 150 feet is required, and will remain nonconforming with respect to lot width following the proposed modification. Proposed Lot 1 will contain approximately 37,912 sq. ft., where a minimum lot area of 40,000 sq. ft. is required. The resulting parcel will be almost entirely located within the R-40 Zoning District. Proposed Lot 2 will contain approximately 17,662 sq. ft., where a minimum lot area of 40,000 sq. ft. is required, and will have a lot width of approximately 66.29 feet, where 150 feet is required. The Planning Board notes that Proposed Lot 2 is a pre-existing nonconforming parcel with respect to lot area and lot width. While the proposed modification will increase the degree of its lot area nonconformity, it will not create its existing lot width deficiency. The resulting configuration of Proposed Lot 2 will also be substantially similar to that of the parcel immediately to the west. The proposed lot line modification does not include additional development, an increase in density, or an intensification of the existing uses. Lot coverage for Proposed Lot 1 will decrease from approximately 13.9% to 6.9%, while lot coverage for Proposed Lot 2 will increase from approximately 3.8% to 7.8%. Both resulting parcels will remain below the 20% maximum lot coverage permitted in the applicable R-40 and RO Zoning Districts. The increased lot area and reduced lot coverage of Proposed Lot 1 may provide additional capacity for future improvements, which would remain subject to any applicable Town review and approval. The requested relief is therefore associated with accommodating a revised configuration of two existing undersized parcels, reducing the degree of lot area nonconformity for Proposed Lot 1 while increasing the degree of lot area nonconformity for Proposed Lot 2. 2. Comprehensive Plan Consistency The Planning Board finds that the proposed lot line adjustment is generally consistent with the goals and objectives of the Town of Southold Comprehensive Plan, particularly those relating to land use, zoning, and preservation of community character. The Comprehensive Plan recognizes the importance of ensuring that land uses are appropriate to the scale and intensity of their surroundings, while balancing the built and natural environment and maintaining the unique character of Southold's communities. In this instance, the proposed lot line adjustment does not introduce a new use, increase residential density, or include additional development as part of the current application. Recommendation Given that the proposal does not include additional development or an increase in density or intensity of use, the Planning Board recognizes that the proposed lot line modification involves a tradeoff between the dimensional conditions of the two existing parcels and considers the resulting configuration reasonable given the existing conditions and development pattern of the properties. Any approval should be carefully conditioned to reflect these site-specific circumstances and to avoid establishing a broader precedent for the creation of undersized lots or the expansion of existing nonconformities. Based on the foregoing, the Planning Board offers no objection to the requested relief, subject to the Zoning Board of Appeals' determination that the required findings for area variances can be met. As depicted on the attached Lot Line Modification, the existing Finnegan Parcel (SCTM# 1000-140-3-19.1) presently consists of 18,981 SF in the R-40 Zoning District and is improved with a single family residence with attached garage that cover 2,637 SF or 13.9% of the parcel. The lot depth is currently nonconforming at 125 feet. The Hahn Parcel (SCTM# 1000-140-3-27) presently consists of 36,593 SF "L-shaped" parcel that is split zoned R-40 and RO. It is improved with a residence with a covered front porch that cover 1,385 SF or 3.8% of the parcel. The lot width is currently 66.29 feet. Both parcels are nonconforming as to lot area. Variance relief is required to allow the Hahn Parcel to maintain its pre-existing non-conforming Lot Width and become more nonconforming as to Lot Area. The Finnegan parcel will become substantially more conforming as to Lot Area and will become entirely conforming as to Lot Depth. The granting or relief will place the Proposed Lot 1 almost entirely in the R-40 Zoning District and Proposed Lot 2 entirely within the RO Zoning District.
