(631) 765-1809 Sao uth?12dnT=Clerk FINDINGS,DELIBERATIONS AND DETERMINATION MEETING OF SEPTEMBER 17,2026 ZBA File No. 8131 NAME OF APPLICANT: Freda Gift Trust PROPERTY LOCATION: 7715 Indian Neck Lane, Peconic,NY SCTM No. 1000-86-6-26.2 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated May 22, 2026 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated August 19, 2026. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available, it is recommended that the proposed action is CONSISTENT with LWRP policy standards as noted below and therefore is CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The subject property is a conforming 150,902.38 square foot somewhat flag- shaped waterfront parcel in the R-80 Residential District with western boundary of 225.00 feet along Indian Neck Lane, a southerly boundary of three segments along Indian Neck Lane of 274.10 feet, 342.79 feet, and 209.91 feet; a northwest boundary of 98.09 feet along Parkers Landing Road; a northerly boundary of eleven segments fronting Richmond Creek of lengths 51.32 feet, 97.83 feet,21.72 feet,22.36 feet, 52.09 feet, 139.29 feet,213.49 feet, 159.96 feet, 82.65 feet, 96.40 feet, and 67.71 feet; an easterly boundary of two segments along Richmond Creek of 50.96 feet, 120.60 feet and 31.13 feet; an easterly boundary of 172.47 feet adjacent to the neighboring residential property to the east, and a 305.00 foot southerly boundary adjacent to the residential parcel to the south. The property is developed with a two story frame dwelling with attached garage, a screened porch and shed (noted by site inspection to be an outdoor shower) in the rear, a frame shed in the side yard, and wood steps, a wood dock, a wood ramp leading to a floating wood dock in Richmond Creek, all as shown on the survey prepared by Michael K. Wicks, L.L.S., last updated February 10, 2026. Page 2, September 17, 2026 48131 Freda Gift Trust SCTM No. 1000-86-6-26.2 BASIS OF APPLICATION: Request for a Variance from Article I11, Section 280-14 and the Building Inspector's April 21, 2026 Notice of Disapproval based on an application for a permit to construct additions and alterations to an existing single-family dwelling at: 1) less than the code required minimum rear yard setback of 75 feet; located at: 7715 Indian Neck Lane, Peconic,NY. (adj. to Richmond Creek) SCTM No. 1000-86-6-26.2. RELIEF REQUESTED: The applicant requests a variance to expand a screened porch in the rear of the dwelling on the seaward,northeast side resulting is a rear yard setback of 70.7 feet where the code requires a minimum rear yard setback of 75 feet, as shown on page SD-1 of the architectural plans titled, "Freda Residence," prepared by Anthony M. Portillo, R.A., dated April 6, 2026. The project also proposes interior modifications to the dwelling and the addition of an inground swimming pool and deck, which do not require variance relief. ADDITIONAL INFORMATION: The application included architectural drawings titled, "Freda Residence," pages SD-1, Proposed Site Plan; SD-2, Existing Partial Floor Plan — Demolition; SD-3, Existing West, North, and South Elevations — Demolition; SD-4, Proposed Partial Floor Plan; and SD-5, South, North and West Elevations — Proposed; prepared by Anthony M. Portillo, R.A., dated April 6, 2026. The application included three examples of prior rear yard setback relief granted by the ZBA on or near Indian Neck Lane: No. 6329 dated December 22, 2009 granting a rear yard setback of 73 feet, 10 inches where the code required a minimum of 75 feet; No. 6140 dated July 24,2008 granting a bulkhead setback of 50 feet,2 inches for a porch where the code required a minimum of 75 feet; No. 3390 dated October 15, 1985 granting a rear yard setback of 46 feet where the code required a minimum of 50 feet. The application included a Certificate of Compliance from the Town of Southold Board of Trustees dated December 19, 2007 certifying that the first and second story additions with addition of gutters, drywells, and new sanitary system conform with Trustees Wetland Permit No. 6498 dated December 13, 2006. Existing improvements on the property are covered by the following Certificates of Occupancy: No. 32980 dated April 15, 2008 pursuant to Building Permit No. 33213 dated July 3, 2007 for additions and alterations to an existing singe family dwelling; No.24736 dated November 14, 1996 pursuant to Building Permit No.22848 dated June 22, 1995 for accessory storage barn; No.24692 dated October 24, 1996 pursuant to Building Permit No. 19744 dated March 27, 1991 for one family dwelling with attached garage and deck, updating CO 20860 dated July 14, 1992; No. 20860 dated July 14, 1992 pursuant to Building Permit No. 19744 dated March 27, 1991 for one family dwelling with attached garage and deck. One letter opposing the application was received from the neighbor to the south noting the proximity of the proposed addition to their bedrooms, however the work closest to their home is the addition of the inground swimming pool and deck, which are not the subject of this application as they do not require variance relief. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 3,2026 at which time written and oral evidence were presented. Based upon all testimony,documentation, personal inspection of the property Page 3, September 17, 2026 #8131 Freda Gift Trust SCTM No. 1000-86-6-26.2 and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law M7-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The screened porch addition will not be visible from Indian Neck Lane or from the parcel to the south due to a fence between the two parcels. There will be some visibility from Richmond Creek, however prior variances have been granted in the neighborhood for lesser rear yard setbacks. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance. The porch cannot be expanded to the south due to the footprint of the existing dwelling and expansion to the north would create an awkward configuration while incurring similar setback noncompliance. 3. Town Law &267-b(3)(b)(3). The variance granted herein is not mathematically substantial, representing 5.7% relief from the code. Further, the expansion of the screened porch in the rear will not be visible to the neighbors to the west (across the street) and will be minimally noticeable to the neighbors to the south due to vegetation and fencing along the mutual property line. Visibility to boaters on Richmond Creek will also be minimal as only the porch depth is increasing and it does not extend beyond the rear wall of the dwelling. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law U67-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an expanded screened porch while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered by Member Steinbugler,seconded by Member Lehnert,and duly carried, to: GRANT the variance as applied for, and shown on the architectural plans titled, "Freda Residence," prepared by Anthony M. Portillo,R.A.,pages SD-2-5 dated April 6,2026,and SD-1 dated 7/24/26 depicting a proposed 10-foot- wide non-turf buffer SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant shall apply for and receive approval from the Town of Southold Board of Trustees. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity, provided de minimis relief is requested within one year of the date of this decision Any time after one year, the Board may require a new application. Any deviation from the variance(s)granted herein as shown on the architectural drawings,site plan and/or survey cited above,such as alterations, extensions, demolitions, or demolitions exceeding the scope of the relief granted herein, are not authorized under this application when involving nonconformides under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code,other than such uses,setbacks and other features as are expressly addressed in this action. TIME LIMITS ON THIS APPROVAL: Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three(3)years from the date such variance was granted. The Board of Appeals may,upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms. IT IS THE PROPERTY OWNER'S RESPONSIBILITY TO ENSURE COMPLIANCE WITH THE CODE REQUIRED TIME FRAME DESCRIBED HEREIN. Failure to comply in a timely manner may result in the denial by the Building Department of a Certificate of Occupancy, nullify the approved variance relief, and require a new variance application with public hearing before the Board of Appeals. PROPERTY FACTS/DESCRIPTION: The subject property is a 2.542 acre lot measuring 87.86 feet along Little Peconic Bay on the southeast, 1,293.36 feet along the southwest boundary, 24..83 feet along Indian Neck Road to the northwest, and 1,267.74 feet along the northeast boundary. The lot is improved with a single family house, a garage/cottage, a frame shed, and a tennis court, as shown by a survey prepared by Nathan Corwin, L.S. dated August 25, 2008. BASIS OF APPLICATION: Request for Variances from Code Sections 280-14 and 280-116, based on an application for a building permit for an addition and alterations to a dwelling and the Building Inspector's July 22, 2009 Notice of Disapproval stating that the new construction is not permitted because the setbacks are proposed at: (a) less than the code-required minimum of 75 feet from a bulkhead, (b) less than the code-required minimum of 20 feet on a single side (c) less than the code-required minimum of 45 feet for combined side yards, (d) less than the code-required minimum of 75 feet from the rear property line. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: RELIEF REQUESTED: The applicant requests variances for a 41 foot setback from the bulkhead, a 10 foot 10 inch single side yard setback, a 39 foot total side yard setback, and a 73 foot 10 inch setback from the (waterside) rear property line. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted, and personal inspections, the Board makes the following findings: 1. Town Law Sect. 267-b(3)(b)(3)(1). An undesirable change will not be produced in the character of the neighborhood or a detriment to nearby properties. The proposed addition to the west and north will not significantly change the floor plan, roof line, or exterior appearance of the existing house. The residence and the adjoining residence to the east were both constructed prior to the adoption of Section 280-116, which mandates a 75 foot rear yard setback from the bulkhead. The side of the residence facing the waterfront will remain at 72.6 feet from the beach front, and 42.9 from the bulkhead. 2. Town Law Sect.267-b(3)(b)(2). The benefit of expanding the residence cannot be achieved by some method feasible for the applicant to pursue other than an area variance. Expanding to the north or east would not be consistent with the applicant's desire to maintain key elements of the existing structure. Expansion to the east is also constrained by the location of the existing septic system. 3. Town Law Sect. 267-b(3)(b)(3). The amount of relief requested is not substantial. The construction on the seaward side of approximately five feet will only extend the existing nonconforming setback to the west. Evidence has been presented that the reduction of west side setback will not significantly affect the use of the western neighbor's property. The conforming eastern side setback will not be changed. 4. Town Law Sect. 267-b(3)(b)(4).-No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 5. Town Law Sect. 267-b 3 b 5 . The difficulty has been self-created in so far as it is a result of the applicant,s decision to expand the first floor living space of an 886 square foot house on a 2.5 acre lot having a width of 87.86 feet by 1,367 square feet. Ehlers, licensed land surveyor. BASIS OF APPLICATION: Zoning Code Sections 280-15 and 280-116B, based on the Building Inspector's amended February 6, 2008 and amended June 17, 2008 Notices of Disapproval concerning proposed new construction. The reasons stated in the disapproval of the building permit application are: (1) the proposed new dwelling construction will be less than 75 feet from the bulkhead, (2) the proposed swimming pool will be in a side yard instead of a code-required rear yard; and (3) New York Town Law, Section'280-a to determine the need, if any, for base improvements and clearance within the right-of-way easement giving access to this property from Indian Neck Lane. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on June 26, 2008, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: Page 2-July 24, 2008 C. and R.Riccio#6140 CTM 98-6-1 (and 86-7-3.1) 1 1 VARIANCE RELIEF REQUESTED: The applicants request variances for: (1) the proposed new dwelling construction with porch at 50'2" instead of 75 feet from the bulkhead; (2) the proposed swimming pool will be in a side yard instead of a code-required rear yard, and (3) in addition, the applicants by May 6, 2008 letter addressed to the Board of Appeals prepared by their attorney, Patricia C. Moore, requested that consideration under New York Town Law, Section 280-A be included in this application. This is related to relief under New York Town Law, Section 280-A for safe fire access, since the applicants' lot does not front directly on a Town Street, and relates to base improvements and vehicle clearance over the same traveled, existing right-of-way that the applicants have used to access their property under easements or deeds under title. LWRP DETERMINATION - CODE CHAPTER 268: The Board finds the proposed action CONSISTENT with LWRP review, based upon the following factors: 1. The existing home is approximately 20 feet from the bulkhead. The proposed home is . to be location at 50 feet from the same. a. The proposed location of the pool will be in the side yard, which will benefit the neighbor, and create a greater distance from the bulkhead than exists. b. The 280-A access condition granted as part of this decision will provide for the draining of water from the slope of the driveway. This is at the point of access on the public road of Indian Neck Lane. The Town is under a Federal mandate to contain water flow into creeks, and open bodies of water (Bays and the LI Sound). 2. The new location of the home will decrease the non-conformity, by increasing the distance from the bulkhead. a. The new location of the septic system and dry wells for roof runoff will be located well landward of the house. This will reduce the environmental impact of sewerage and rainwater into the open bay. b. A proposed pump out drain pool will provide for discharge of pool water, well landward from the bulkhead. 3. The setback at 50 feet from the bulkhead is more than double the existing setback with more conformity. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Town Law §267-b(3)(b)(3)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties because: A: The existing house will be demolished and a new house constructed further back from the bulkhead (landward of the existing structures). The new house will be in line with neighboring homes. The new owners considered a second floor addition to the existing residence but demolition and reconstruction further back is more environmentally appropriate. Page 3-July 24, 2008 C. and R.Riccio#6140 b CTM 98-6-1 (and 86-7-3.1) B: The propose location of the pool in the side yard will benefit the neighbor by keeping the distance from their front yard to the pool at the maximum distance possible. C: Access to this parcel was granted by the action this board under appeal 1535 on May 25, 1972 and is currently the legal access to this property. They do not propose to change this access. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicants cannot be achieved by some method, feasible for the applicants to pursue, other than an area variance because: A: The new location of the building will decrease the existing non-conformity and is dictated by the location of the septic and drywell system which are located landward of the house in an effort to reduce the environmental impact to the bay. B: The location of the pool in the side yard keeps the structure away from the bulkhead. 3. Town Law §267-b(3)(b)(3). The variance requested herein is not substantial. The setback requested(50 feet from the bulkhead) is 100% greater than that of the existing structure. 4. Town Law §267-b(3)(b)(5). The difficulty has not been self created. The existing house was constructed prior to regulations, the disturbed area will be planted and the house will be placed further back then the existing structure. 5. Town Law 267-b(3)(b)(4). There has been no evidence submitted to suggest that a variance in this residential neighborhood may have an adverse impact on the physical or environmental conditions in the neighborhood. The proposed house will comply with all energy codes and construction standards. A backwash drain will be provided for the pool to prevent draining into the bay. The property is stable, vegetated and contains both a full bulkhead and an additional timber wall. The new construction is further back than the existing structure. 6. Town Law §267. The grant of the requested relief for the new house and pool is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of this property while preserving and protecting the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Simon, seconded by Chairman Goehringer, to Grant the variances applied for, as shown on Site Plan Drawing A-1 revised July 3, 2008 by Frederick R. The road must be cut to the minimum width of 12 feet and improved a minimum width of 12 feet; 5. The ROW height and width clearance must be a minimum width of 13 feet, and 13 to 15 feet in height; 6. The surface as well as the width and height must be continuously maintained, for the purpose of fire and emergency access. 7..Drywells also to be completed as per Site Plan Drawing A-1 revised July 3, 2008 by Frederick R.
