SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred under the Suffolk County Administrative Code Section A 14-14 to 23. LWRP DETERMINATION: The relief,permit,or interpretation requested I this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. SOUTHOLD TOWN BUILDING DEPARTMENT: This application was referred to the Southold Town Building Department for verification of livable floor area. In a reply dated August 29, 2026, the Building Department determined that the proposed apartment in an accessory structure will contain 443 square feet and conforms to Section 280-13B(13)(a)of the code. BASIS OF APPLICATION: Applicant requests a Special Exception under Article III, Section 280-13B (13). The Applicant is owner of the subject property requesting authorization to construct and establish an Accessory Apartment in an accessory structure; at: 460 Marion Lane, East Marion NY. SCTM# 1000-31- 8-1.2 REQUEST MADE BY APPLICANT: The Applicant-Owner requests a Special Exception under Zoning Code Section 280-13(B)(13)to establish an Accessory Apartment in an existing accessory structure. PROPERTY FACTS/DESCRIPTION: The subject 40,208.38 square feet, 0.92 acre conforming parcel located in the R40 Zoning District measures 117.64 feet along a residentially developed lot to the north, then runs south 260.99 feet along a residentially developed lot to the east, then runs west 64.69 feet along a residentially developed lot to the south,and continues south 200.32 feet along the same neighboring home (where the last 50.00 feet is the termination of a private road known as Marion Lane allowing access to the site), runs west 50.19 feet along a vacant residential lot to the south and continues north 461.05 feet back Page 2, September 19,2026 48132SE, Geras SCTM No. 1000-31.-8-1.2 to the point of origin. The property is developed with a one-story modular dwelling with an attached deck and garage, an existing one story masonry `cottage' (converted to a storage shed and subject of this application), a dry-stone and gravel driveway and stockade fencing,all as shown on the survey prepared by Kenneth M. Woychuk, Licensed Land Surveyor and dated and last revised March 8,2021. ADDITIONAL INFORMATION: The applicant provided architectural plans including existing photos, project summary,site plan,demolition plans,floor plan,roof plans and elevations labeled A001,A.01,A.02 and A.03 prepared by Hideaki Ariizumi, Registered Architect, dated March 11, 2026. Improvements on the parcel are covered by the following Certificates of Occupancy: #Z-45371 dated July 21, 2024 covering the construction of a modular single-family dwelling with unfinished basement, front covered entry, side deck and an attached garage. #Z-45372 dated July 21,2024 covering an existing non-conforming cottage altered to a non-habitable storage building. The Suffolk County Board of Health stamp on the survey illustrates an approval for a 4-bedroom residence; the applicant proposes to tie-in the proposed Accessory Dwelling Unit (ADU) into the existing sanitary system. The applicant provided the following evidence supporting their application (illustrating ownership, residency, and familial relationship): • Bargain and Sale Deed,dated October 31, 2017 • Town of Southold Assessor's Office `Property Card' • PSE&G utility bill • Certificate of Birth for the owner's son Demetri James Geras • Lease between property owner(mother)and tenant(son) • Notarized statement by the property owner indicating who the tenant shall be in the accessory dwelling No member of the public or an immediate neighbor spoke in favor of or against this application. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on September 3,2026 at which time written and oral evidence were presented. Based upon all testimony,documentation, personal inspection of the property and the surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant. In considering this application,the Board has reviewed the code requirements set forth pursuant to Article 111, Section 280-13(B)(13) to establish an Accessory Apartment in an Accessory Structure and finds that the applicant does comply with all of the requirements for the reasons noted below: 1. The owner confirms that the accessory apartment shall contain no less than 220 square feet and shall not exceed 750 square feet of livable floor area and shall have no more than two bedrooms and one bathroom with the entirety of the livable floor area of the accessory apartment located on one floor of the accessory structure.The architectural plans prepared by Hideaki Ariizumi,Registered Architect dated March 11,2026 propose an accessory apartment with one full bathroom entirely on the primary floor of the accessory structure with a conforming 443 square feet of livable floor area, as verified by the Building Department's "Verification of Livable Floor Area"request by the ZBA dated August 29, 2026. The dwelling unit complies with the definition of same in §280-4 of the code. 3.The applicant herein owns and resides at the property as documented by personal testimony and evidence submitted with the application including deed, utility bill,personal testimony and confirms that: occupancy of the resident structures on the premises shall be subject to the issuance of an annual rental permit in accordance with 280-13D and the following requirements: one of the dwelling units shall be for the sole, exclusive occupancy of the owner or family member, as defined in chapter 280-4. The other dwelling unit shall be leased for year-round occupancy evidenced by a written lease for a term of one or more years to a family member or a resident who is currently on the Southold Town Affordable Housing Registry and eligible for placement. The applicant testified that the tenant of the accessory apartment will be the property owner's son, Dimitri James Geras, as evidenced by copy of his birth certificate provided in the application. 5. The owners' plans comply with the on-site parking requirements of three spaces, two for the principal dwelling and one for the accessory apartment, and provide for a total of 3 parking spaces, as shown on the site plan prepared by Hideaki Ariizumi, Registered Architect,dated March 11, 2026. 6. Only one accessory apartment will be on the subject property and no Bed and Breakfast facility, as authorized by Section 280-13(B)(14) hereof shall be permitted in or on premises for which an accessory apartment is authorized or exists. 7. This conversion shall be subject to a building permit, inspection by the Building Inspector, approval by the Suffolk County Department of Health Services of the water supply and sewage disposal system(s) and the issuance/renewal of an annual permit in accordance with Chapter 280-13D. 8. No special exception shall be granted unless the Zoning Board of Appeals, in addition to the considerations,determinations and findings required in Chapters 280-142 (General Standards)and 280-143 (Matters to be Considered) specifically finds and determines the following: 1. That the granting of the special exception will not adversely impact the privacy and use and enjoyment of any adjoining parcel. 2. That the granting of the special exception will not adversely impact the character of the neighborhood in which it is located. 3. That the cumulative effect of approving the present application along with previously approved applications will not have a cumulative adverse impact on the surrounding neighborhood. 4. That the cumulative effect of approving the present application along with previously approved applications will not have a cumulative adverse impact on the school district in which the property is located. 5. That sufficient off-street parking exists on the subject property to accommodate the proposed accessory apartment. 6. Whether adequate buffer yards and screening can and will be provided to protect adjacent properties from possible detrimental impacts of the proposed use. RESOLUTION OF THE BOARD: In considering the entire record and the applicable code requirements, motion was offered by Member Planamento, seconded by Member Acampora, and duly carried,to: Page 4, September 19,2026 #8132SE, Geras SCTM No. 1000-31.-8-1.2 GRANT the Special Exception Permit as applied for SUBJECT TO THE FOLLOWING CONDITIONS: 1. This Special Exception Permit requires an annual renewal by a Code Enforcement Officer. It is the applicant's responsibility to apply to the Building Department each year to renew the accessory apartment permit. Failure to do so may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein. 2. This Special Exception permit cannot be transferred. 3. The property owner is to register the Accessory Dwelling Unit (ADU) with the Town of Southold Community Development and Housing Department. 4. At no time may the primary residence or the ADU be rented outside of the terms of this determination. 5. The on-site sanitary system must comply with the Suffolk County Board of Health Department. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision, may result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. In the event that this is a special permit subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. Any violations of the conditions, occupancy or other requirements described herein, may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein.
