No. #8137 This application is a request for a variance from Article XXIII Section §280-124 and Article XXXVI Section §280-207. The Building Inspector's May 4, 2026 Notice of Disapproval is based on an application to construct additions and alterations to an existing single-family residence at 545 Glen Court, Cutchogue, NY. The proposed action has been reviewed under Chapter §268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the policies of the LWRP as follows: Policy 1. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. Policy 4 Minimize loss of life, structures, and natural resources from flooding and erosion. 4.1 Minimize losses of human life and structures from flooding and erosion hazards. The following management measures to minimize losses of human life and structures from flooding and erosion hazards are suggested. A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. Policy 6 Protect and restore the quality and function of the Town of Southold ecosystem. 6.1 Protect and restore ecological quality throughout the Town of Southold. C. Reduce adverse impacts on ecological quality due to development. 1. Reduce adverse effects of existing development. 6.3. Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction. The proposed action is a waterfront parcel with a nonconforming existing residence that is less than 100 ft. from the top of the bluff on the Long Island Sound. The proposed action is inconsistent with Policy 1 because the proposed action does not enhance community character or minimize the adverse effects of development. The building footprint of the new residence is beyond the Board of Trustees' pier line of the surrounding neighbors. And additions proposed beyond the existing home's footprint (existing home is proposed to be demolished), are located on the seaward side. These include the proposed covered porch and patio and hot tub. This adds to the building footprint beyond the pier line and closer to the bluff. The proposed action expands the building footprint by 924 sq. ft., which is 40% larger than the existing residence of 2,306 sq. ft. This expansion puts the lot coverage over the maximum lot coverage requirement by 13.3%. The proposed covered porch is inconsistent with Policy 4.1.A, which states to minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. The proposed covered porch is located seaward of the existing building footprint, adding development closer to the Coastal Erosion Hazardous Area (CEHA) and the high-risk FEMA VE flood zone at the toe of the bluff. The proposed action is inconsistent with Policy 6.1.C.1, which calls for the reduction of adverse effects of existing development. The proposed overdevelopment of this waterfront parcel increases the adverse effects of existing development by increasing the floor area by 60% over the allowable amount (3,331 sq. ft. proposed where only 2,100 sq. ft. are allowed) on this very small parcel. 2 The proposed action is inconsistent with Policy 6.3.A, which states actions must comply with the Southold Town Board of Trustees' laws and regulations. The pre-existing residence is nonconforming and does not comply with Town Code Chapter §275- 3(D)(1)(b)[1], which states the setback for a residence is 100ft from the top of the bluff. The proposed redevelopment and addition of a covered porch on the seaward side makes the building footprint more nonconforming toward the wetland boundary. The proposed covered porch and proposed hot tub also bring development closer to the Coastal Erosion Hazardous Area and the FEMAAE flood zone. If the new house was proposed to be located farther from the bluff and the CEHA, it would become less nonconforming in that respect. A front yard variance that locates the new house farther from the bluff would be more consistent with the LWRP policies than the proposed location. Most importantly, the existing home is proposed to be demolished, providing an opportunity to create a less non-conforming development rather than one that is more non-conforming than the existing. If the proposed action excluded the seaward additions, moved the new house farther from the bluff, and reduced the proposed size of the house to meet the Town Code for maximum building size, the proposed project could be deemed consistent. A significant vegetated buffer along the bluff to slow erosion is also recommended. In addition to the Zoning Board of Appeals variances, please note that the proposed action is in the jurisdiction of the Board of Trustees and requires the approval of a wetland permit. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: The property is significantly constrained by it's unique geography, specifically a steep bluff and the coastal erosion hazard boundary. Of the total lot area, only 9,690 sq.ft. is considered "build-able If once the CEHS area is subtracted. Relocating the structure further landward would result in a sever violation of front yard requirements. 3. The amount of relief requested is not substantial because: The primary setbacks for which relief is sought are largely pre-existing conditions: the 35.9-foot rear yard(where 100 feet is required)and the 28.1-foot combined side yard(where 35 feet is required) already exist with the current 1968 structure. The proposed front yard reduction to 35 feet is a minor deviation from the 40-foot requirement. While the lot coverage exceeds the 20% Ili-nit, this is due to limited "build-able" area landward of the bluff. 4. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: All proposed construction is located landward of the Top of Bluff and the Coastal Erosion Hazard Boundary, preserving the integrity of the shoreline.
