This application is for the existing 2,229 sq. ft. (gross floor area), two-story dwelling,
construct additions and alterations for a 2,503 sq. ft. two-story dwelling consisting of
removing the existing two-story west wing and one-story sections, and construct a two-
story addition with a slight footprint expansion; construct a 236 sq. ft. screened porch on
west side of dwelling; construct a 36 sq. ft. covered front porch; existing 22.3'x2o.9'
deck to remain; and to remove the existing seaward screened-in porch.
The proposed action has been reviewed under chapter §268, Waterfront consistency
Review of the Town of Southold Town code and the Local waterfront Revitalization
Program (LWRP) Policy Standards.
Based upon the information provided on the LWR.P consistency Assessment Form
submitted to this department, as well as the records available to me, it is my
recommendation that the proposed action is CONSISTENT with the policies of the
LIIIRP as follows:
Policy 1. Foster a pattern of development in the Town of Southold that enhances
community character, preserves open space, makes efficient use of infrastructure,
mares beneficial use of a coastal location, and minimizes adverse effects of
development.
Policy 5. Protect and improve water quality and supply in the Town of Southold.
5.1 Prohibit direct or indirect discharges that would cause or contribute to contravention
of water quality standards.
C. Ensure effective treatment of sanitary sewage and industrial discharges by:
3. modifying existing sewage treatment facilities to provide improved
nitrogen removal capacity
Policy 6. Protect and restore the quality and function of the Town of Southold
ecosystem.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town
Board of Trustees laws and regulations for all Andros Patent and other lands
under their jurisdiction
This proposed action is on a nonconforming lot with an existing residence that is less
than 100 ft. from the pond in the backyard.
The proposed action is consistent with Policy 1, which calls for the minimization of the
adverse effects of development. The removal of the porch near the pond and the
construction of a porch on the westward side of the residence minimizes the adverse
effects of development by placing the porch further from the wetland boundary.
The proposed installation of an 11A OWTS is consistent with Policy 5.1.C.3, which calls
for the replacement of existing sewage treatment facilities with ones that improve
nitrogen removal capacity. The proposed IIA OWTS will reduce nitrogen inputs into
adjacent waters.
Although the parcel is nonconforming with a residence that is within 100 ft. of the
wetland boundary, the proposed action is consistent with Policy 6.3.A, which states that
actions must comply with the Southold Town Board of Trustees' laws and regulations.
Due to the size of the parcel, the proposed leaching pools and IIA OWTS system do not
meet wetland setbacks (33.6 ft. and 55.6 ft. from the wetland boundary). However, they
are proposed landward of the residence in an attempt to place them farther from the
wetland.
The removal of the seaward porch pulls the building footprint back from the wetland
boundary. The proposed additions of the westward porch, landward front porch, and
second floor increase the existing building footprint by 12.3%.
With the proposed additions being landward and not causing an increase in building
height, the proposed additions comply with Town Code Chapter §275-5B(2)(c) below..
Construction of additions to the landward side of an existing functional single-
family dwelling, where such dwelling generally lies parallel to the wetland

boundary and provided that all new and existing runoff is captured on site. Such
addition must be less than or equal to 25% of the area (footprint) of the existing
structure.
In addition to the Wetland Permit, please note that the setbacks are in the jurisdiction of
the Zoning Board of Appeals and require the approval of a variance.
The proposed action has been reviewed under Chapter §268, Waterfront Consistency
Review of the Town of Southold Town Code and the Local Waterfront Revitalization
Program (I-WRP) Policy Standards.
