The Permittee

Camp Mineola Rd. Mattituck N. Y., as
part..of the consideration for the issuance of the Permit does understand and presm'be to the fol-
lowrug
1. That the said Board of Trustees and the Town of Southold are released from any and
all damages, or claims for damages, of suits arising directly or indirectly as a result of a� oper-
ation performed pursuant to this permit, and the said Permittee will, at his or her own expenses
defend any and all such suits-initiated by third paatiCS, and the aid Permittee assumes full liabllitl
with respect thereto, to the complete'ezdusion of the Board of Trustees of the Town of Southold
2. That this Permit is valid fora period of 24 com which is considered to be the
estimated time,required to complete the work involved, but'should.cidurbstances warrant, request
for an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes
to.maintain the structure or project involved, to provide evidence to anyone concerned that aath-
orization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or
its agents, and noa-compliance with.the provisions of the originating application, may be cause for
revocation of this permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall bg no interference with the right of the public to pus and repass along
the beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations .
in the locution of the work herein authorized, or if, in the opinion of the Board of Trustees, the.
work shall cause unreasonable obstruction to free navigation, the said P'emiWee will be required,

Dear Mr. Herrmann:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday,November 20, 2002 regarding the above matter:
WHEREAS, En-Consultants, Inc. on behalf of STRONG'S MARINE applied to the Southold
Town Trustees for a permit under the provisions of Chapter 97 of the Southold Town Code,the
Wetland Ordinance of the Town of Southold, application dated October 25, 2002, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and,
WHEREAS, a Public Maring was held by the Town Trustees with respect to said application on
November 20, 2002, at which time all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS,the structure complies with the standards set forth in Chapter 97 of the Southold
Town Code,

WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of STRONG'S MARINE to
remove and replace(in-place) approx. 288 linear ft. of existing timber bulkhead with vinyl
bulkhead and backfill with approx. 200 cy. of clean sand to be trucked in from an upland source.
Maintenance dredge an area up to 20' off bulkheads to a maximum depth of—5' ALW and truck
approx. 150 cy. of resultant spoil to an approved upland site, all with the condition that silt
retention fencing is installed before the project begins.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Permit to construct and complete project will expire two years from the date the permit is signed.
Fees must be paid, if applicable, and permit issued within six months of the date of this
notification.
Inspections are required at a fee of$5.00 per inspection. (See attached schedule.)

As discussed during the last public hearing, we wish for the Board to continue its review of the
application for bulkhead replacement and maintenance dredging, which was originally submitted in
July 2000.
As I have been informed by your office that a second application fee will be necessary to restart this
process, please find enclosed a check for $205 and (3) copies of a project plan revised in response to
the concerns the Board raised two years ago. Specifically, the proposal to place the dredged spoil on
the adjacent property owned by William Tufano has been abandoned in favor of trucking the material
offsite to an approved upland source.
Together with other minor modifications/corrections to the original project description, the current
project description should read as follows:
"Remove and replace (in-place) approximately 288 linear feet of existing timber bulkhead with
vinyl bulkhead and backfill with approximately 200 cubic yards of clean sand to be trucked in
