State Environmental Quality Review
FULL ENVIRONMENTAL ASSESSMENT FORM
Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a project
or action may be significant. The question of whether an action may be significant is not always easy to answer. Frequent-
ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determine
significance may have little or no formal knowledge of the environment or may not be technically expert in environmental
analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting
the question of significance.
The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination
process has been orderly, comprehensive in nature,yet flexible enough to allow introduction of information to fit a project
or action.
Full EAF Components: The full EAF is comprised of three parts:
Part 1: Provides objective data and information about a given project and its site. By identifying basic project
data, it assists a reviewer in the analysis that takes place in Parts 2 and 3.
Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides
guidance as to whether an impact is likely to be considered small to moderate or whether it is a potentially-
large impact. The form also identifies whether an impact can be mitigated or reduced.
Part 3: If any impact in Part 2 is identified as potentially-large, then Part 3 is used to evaluate whether or not the
impact is actually important.

PROJECT DESCRIPTION
Applicant proposes to construct a swimming pool , terrace.
stairs decking and pool backwash all at a point greater than
75' from existing tidal wetlands line. C -
approximately 200c .y. of clean fill for regrading and the Qnonc op SPLY)
installation of a stone ( pervious) parking area on what is
now a dirt parking area approximately 40' from existing tidal
wetlands line proposed parking area shall be in the same
footprint as existing parking area, existing catch basin
shall be utilized or reconstructed . Entire limits of
construction shall be enveoped by a continuous line of staked
hay bales which shall be installed prior to and maintained
during all periods of construction activity. All work in
accordance with plans prepared by Chanlder Palmer & King last
dated 12/14/93.

Dear Sirs :
As a property owner and resident since 1982 whose
address is on Clay Point Road, Fishers Island, but more
specifically, whose property is located on Chocomount Cove, I
was distressed to learn that the Town of Southold Trustees
have approved an application by Robert and Jean N. Calhoun to
construct a 6 ft . x 180 ft . fixed dock on their property on
Chocomount Cove . According to a copy of Mr. & Mrs . Calhoun' s
application, it was submitted on November 20, 1995, 'received
an . inspection on December 11, 1995 and had a public hearing
on -December 21, 1995 . At no ' time was I, or any of the
adjoining neighbors on Chocomount Cove, contacted by the Town
or by the applicants regarding this project .
Chocomount Cove is one of the few undisturbed natural
areas along the north shore of Fishers Island. It is
markedly active in bird life and relatively undisturbed by
boating activity. Occasionally in the summer, a sailboat
anchors in the middle of the Cove and there are one or two
lobster traps, but it is a relatively quiet part of the
shoreline . I believe a dock of the size proposed by Mr. &
Mrs . Calhoun would dramatically change the character of the
area and seriously alter its appearance. It is very
upsetting that this project may have been approved without
any notification of those who will be most affected by it .
It is also my understanding that Mr. & Mrs . Calhoun' s
application for this project was submitted in the form of an
amendment to a swimming pool application. If this is
correct, is this an appropriate format for the Town to
consider a project of this scope?

received a request -for Department of the Army authorization for
the following activity:
APPLICANT: Robert and Jean Calhoun

ACTIVITY: Construct an "L"-shaped fixed pier consisting of 6
foot by 180 foot and 8 foot by 46 foot sections,
elevated a minimum of 4 feet above the grade of
the wetlands. Install an 8 foot by 40 foot float
and a 4 foot by 20 foot hinged walk ramp
approximately 30 feet landward of the end of the
pier. The purpose of the proposed activity is to
provide a recreational mooring facility.

of Permission. This is in accordance with current Federal

State Environmental Quality Review
FULL ENVIRONMENTAL ASSESSMENT FORM
Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a project
or action may be significant. The question of whether an action may be significant is not always easy to answer. Frequent-
ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determine
significance may have little or no formal knowledge of the environment or may not be technically expert in environmental
analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting
the question of significance.
The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination
process has been orderly, comprehensive in nature,yet flexible enough to allow introduction of information to fit a project
or action.
Full EAF Components: The full EAF is comprised of three parts:
Part 1: Provides objective data and information about a given project and its site. By identifying basic project
data, it assists a reviewer in the analysis that takes place in Parts 2 and 3.
Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides
guidance as to whether an impact is likely to be considered small to moderate or whether it is a potentially-
large impact. The form also identifies whether an impact can be mitigated or reduced.
Part 3: If any impact in Part 2 is identified as potentially-large, then Part 3 is used to evaluate whether or not the
impact is actually important.

WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and

respect to said application on April 26, 1994 at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises -in question and the surrounding area,

documentation submitted concerning this application.- and,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the

stone parking areas on what is now dirt, approx. 40' from
existing tidal wetlands line. Reconstruct existing catch basin

2. The Department reserves the right to modify, suspend or revoke this permit Men:

condition of the permit or provisions of the ECL and pertinent regula-
tions is found;

c) new material information is discovered; or
d) enviromiental conditions, relevant technology, or applicable lanr or
regulation have materially changed since the permit v%es issued.

any forms, fees : or supplemental information the Department requires. Any
renenal , modification or transfer granted by the Department must be in writing.
4. The permittee must submit a renentel application at least:
a) 180 days before expiration of permits for State Pollutant Discharge
Elimination System (SPDES) , Flazardous ftste IVbnagement Facilities

Facilities (Slff) ; and
b) 30 days before expiration of all other permit types.

not modify, supersede or rescind any order or determination previously issued by
the Department or any of the terms, conditions or requirerents contained in such

6. The permittee has accepted expressly, by the execution of the application, the
full legal responsibility for all damages, direct or indirect, of Matever
nature and by Mumver suffered, arising out of the project described in this
permit and has agreed to inde-mify and save harmless the State from suits,

commencement of regulated activities and remain in place
until project is completed and all disturbed areas

maintained and trapped sediments removed to a suitable
upland site before the bales themselves are removed.
13 . There shall be no disturbance to vegetation seaward of the
existing edge of lawn.
14. All rocks removed as a result of installation of the rose
garden shall be removed to a suitable upland site.

SUPPLEMENTARY SPECIAL CONDITIONS
The following conditions apply to all perxits:
A. • A copy of this permit, including all conditions and approved
plans, shall be available at the project site whenever authorized
work is in progress. The permit sign enclosed with the permit
shall be protected from the weather and posted in a conspicuous
location at the work site until all authorized work has been
completed.
B: The permittee shall require that any contractor, project engineer,
or other person responsible for the overall supervision of this
project reads, understands, and complies with this permit and all
its general, special, and supplementary special conditions. Any
failure to comply precisely with all of the terms and conditions
of this permit, unless authorized in writing, shall be treated as
a violation of the Environmental Conservation Law. If any of the
permit conditions are unclear, the permittee shall contact the
Division of Regulatory Affairs at the address on page one or
telephone (516) 444-0365.
C. If project design modifications become necessary after permit
issuance, the permittee shall submit the appropriate plan changes
for approval by the Regional Permit Administrator prior to
undertaking any such modifications. The permittee is advised that
substantial modification may require submission of a new
application for permit.
D. At least 48 hours prior to commencement of the project, the
permittee and contractor shall sign and return the top portion of
the enclosed notification form certifying that they are fully
aware of and understand all terms and conditions of this permit.
Within 30 days of completion of the permitted work, the bottom
portion of that form shall also be signed and returned, along with
photographs of the completed work and, if required, a survey.
E. For projects involving activities to be undertaken in phases over
a period of more than one year, the permittee shall notify the
Regional Permit Administrator in writing at least 48 hours prior
to recommencing work in subsequent years.
F. The granting of this permit does not relieve the permittee of the
responsibility of obtaining a grant, easement, or other necessary
approval from the Division of Land Utilization, Office of General
Services, Tower Building, Empire State Plaza, Albany, NY 12242

State-owned lands underwater.

Board of Trustees currently have under review for this
property. For your review I ' ve enclosed the revised site
plan as prepared by Chandler, Palmer & King last dated
4/18/94. The modification is that the shape of the proposed
pool has been changed from Lima bean shaped to rectangular.
This has been the only modification made to the plan . There
has been no changes made to the original footprint of the
proposed decking .

application packet for this project. With this submission I
am also formally requesting under chapter 97-22 that certain
requirements be waived at this time. Presently we wish to
have requirements 97-21 G and J be waived . We are requesting
that for this application we be allowed to utilize 2'
topographical contours. We also wish to have requirements
97-21 J waived . The project as described will require a
Tidal Wetlands Permit (Article 25) from the N.Y.S.D.E.C.
Said permit has been applied for, the site has been inspected
by the staff of the N.Y.S.D.E.C. and a permit will be issued
for this activity very shortly. The only other regulatory
approval required is for the S.C.D.H.S. who at this time
have an application under review for the sanitary system,
which is the only aspect of the project under their
jurisdiction . The project as proposed exceeds all minimum
setbacks and measurements required by this agency for the
installation of a sanitary system.

The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination
process has been orderly, comprehensive in nature,yet flexible to allow introduction of information to fit a project or action.
Full EAF Components: The full EAF is comprised of three parts:
Part 1: Provides objective data and information about a given project and its site. By identifying basic project
data, it assists a reviewer in the analysis that takes place in Parts 2 and 3.
Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides
guidance as to whether an impact is likely to be considered small to moderate or whether it is a potentially-
large impact. The form also identifies whether an impact can be mitigated or reduced.
Part 3: If any impact in Part 2 is identified as potentially-large, then Part 3 is used to evaluate whether or not the
impact is actually important.
