all damages, or claims for damages, of suits arising directly or indirectly as a result of any oiler- unde
i3don performed pursuant to this permit, and the said Permittee will, at his or her own expense, the

with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold

sufficient time required to complete the work involved, but should,circumstances warrant, request
for an extension may/be made to the Board at a later date.
4.. That this Permit should be retained indefinitely, or as long as the said Permittee wishes
to provide evidence to anyone concerned that
to maintain the structure or project involved,

orization was originally obtained. .
5� That the work-involved will be subject to the inspection and approval of the Board or
its agents, and non-compliance with the provisions of the originating application, may be cause for
revocation of this Permit by resolution of the said Board.
6. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
T. That there shall be no interference with the right of the public to pass and repass along
'the beach between high and low water masks.
8. That if future'operations of the Town of Southold require the removal and/or alterations
in .the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the
work shall cause unreasonable obstruction to free navigation, the said Permittee will be required,
upon due notice, to remove or alter this work or project herein stated without expenses to the Town
of Southold.
9 That the said Board will be notified by the Permittee of the completion of the work auth-
onzed. (See tear off sheet. ) .
10. That the Permittee will obtain all other permits and consents that may be required sup.

Dear Mr. Haje:
The following action was taken by the Board of Town Trustees
during their regular meeting held on May 31, 1989 regarding the
above matter:
WHEREAS, En Consultants on behalf of Lynne Chanin applied to the
Southold Town Trustees for a permit under the provisions of the
Wetland Ordinance of the Town of Southold, application dated March
15, 1989 and
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on May 31, 1989 at which time all interested
persons were given an opportunity to be heard, and
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area, and
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
-the town,
NOW, THEREFORE BE IT
RESOLVED that En Consultants ON BEHALF OF Lynne Chanin BE AND HEREBY
IS GRANTED PERMISSION UNDER THE WETLAND ORDINANCE TO: Construct 4 ' x
120 ' fixed dock, 4 ' x 12 ' ramp, 6.' x 16 ' float, install 28 pilings,
on property located on Haywaters Road, Cutchogue, N.Y.
This permit will expire two years from the date it is signed if -
work has not commenced by said date. Fees must be paid and permit
issued within six months of the date of this notification. Two
inspections are required and the Trustees are to be notified upon
completion of said project.
Please return to the Building Department for a determination on
the need for any other permits which may be required for this project.
Permit will be issued upon payment of the following fees for
work to be done below Mean High Water Mark:

Dear
The Trustees are surveying the marine structures of
Cutchogue' s creeks for the purpose of establishing the
accuracy of the town records. Now in our third season,
we have completed the inventories of Laurel and Mattituck
creeks.
Because your structure is not on land within the
Trustees' jurisdiction, you are not required to obtain a
permit. However, filing a grandfather permit application
with the Trustees can be to your advantage.
If your structure is damaged in a storm, and you want
to rebuild it, a filed grandfather permit proves that you
only need a simple rebuild permit from the town. Without
this proof of the structure' s prior existence, the town
may require a new permit, which is expensive and time-
consuming.
If you have any questions, contact the Trustees' ;,
office in Town Hall.

The following conditions apply to all permits:
A. If any of the permit conditions are unclear , the permittee shall con-
tact the Division of Regulatory Affairs at the address and telephone
noted below.
B. A copy of this permit with supplementary conditions and approved
plans shall be available at the project site whenever authorized
work is in progress.
C. The permit sign enclosed with the permit or a copy of letter of
approval shall be protected from the weather and posted in a con-
spicuous location at the work site until completion of authorized work .
D. At least 48 hours prior to commencement of the project , the permittee
shall complete and return the top portion of the enclosed receipt form
certifying that he is fully aware of and understands all provisions and
conditions of this permit. Within one week of completion of the
permitted work, the bottom portion of that form shall also be com-
pleted and returned.
E. For projects involving activities to be accomplished over a period of
more than one year, the permittee shall notify the Regional Permit
Administrator in writing at least 48 hours prior to the commencement
of resumption of work each year .
F. If project design modifications take place after permit issuance, the
permittee shall submit the appropriate plan changes for approval by
the Regional Permit Administrator prior to undertaking any such modi-
fications. The permittee is advised that substantial modification
may require submission of a new application for permit.
G. All necessary precautions shall be taken to preclude contamination of
any wetlands or waterway by suspended solids, sediment , fuels,
solvents, lubricants, . epoxy coatings, paints, concrete, leachate or
any other environmentally deleterious materials associated with the
project work .
H. Any failure to comply precisely with all of the terms and conditions
of this permit , unless authorized in writing, shall be treated as a
violation of the Environmental Conservation Law.
I . The permittee is advised to obtain any permits or approvals that may
be required from the U.S. Department of Army Corps of Engineers, NY
District, 26 Federal Plaza, New York, NY 10278, (Attention: Regulatory
Functions Branch) , prior to commencement of work authorized herein.
J. The granting of this permit does not relieve the permittee of the
responsibility of obtaining a grant, easement, or other necessary
approval from the Division of Land Utilization, Office of General
Services, Tower Building, Empire State Plaza, Albany, NY 12242, which
may be required for any encroachment upon State-owned lands underwater .

Gentlemen:
On August 31 , 1984 a Grandfather Permit was issued to my wife,
Lynne S. Chanin, who has owned waterfront property in Cutchogue
since 1976. Since that time the existing dock and connecting cat-
walk have deteriorated and recently suffered serious damage from
storms . Immediate repairs are necessary and I am writing to
inquire as to whether this work can be accomplished -without the
necessity of reapplying for a new permit .
I have attached hereto a sketch of the proposed replacement of
both the catwalk and float each to be located in the exact space
presently occupied by the existing structures . It is our prefer-
ence to replace the stationary dock with a floating dock which
would be approximately one (1 ) foot larger in each dimension.
In speaking with Ilene Pfifferling, I am advised that the Board
will on occasion waive the requirement of a new permit where the
property owner merely wishes to repair or replace an existing
damaged structure with new material in the same approximate size
and location.
Accordingly, we hereby request that a waiver be issued by your
Board . Your courtesies and favorable consideration are much
appreciated.
