Dear Sirs We desire permission to clear the channel into Peeonic Bay of the gutter running along the boundary of our property as shown on the map, dated September 14, 19269 which we recently forwarded to the Board of Trustees. We .understand the Board of Town Trustees has jurisdiction over the land below high water along the -bay.. To keep Hippodrome Pond from becoming stagnant a good flow of water to and from Peconic Bay is essential, To pro- vide for a sufficient flow of water both ways it will be necessary to clear the channel from the high water line to the low water line. Goldsmith, clerk of the Board of Town Trustees, regarding a "request to dredge a new channel into Hippodrome Creek, Southold." I have never requested an such permission nor have I authorized anyone to make any application on my behalf. Please read the enclosed boundary agreement made by my father, Thomas F. Daly and Mr. Bennett De Bfi�Aedon, which I request that you keep and file as part of your permanent record, As Mr, De BQixedon failed to exercise the option before May 1953, the boundary between the- properties was settled as shown on the enclosed survey. This agreement binds all "heirs and assigns as such". Mr. Sabine, who has recently bought the adjoining property to ours, moved his house back and raised it up, as it often was flooded during storms. He bulkheaded the property and needed fill to protect his bulkhead - I told him he could take sand from the gutter on my property and that I wanted his contractor to finish clearing the. channel of the gutter to the bay. The gutter was dug about 1856 by Messrs. Tuthill and 'ferry. It was deepened and straightened to the bay by Mr. OtGorman, who owned the property about 1910. In recent years the channel to the bay has begun to be closed by shifting sand. We have been considering clearing the entrance to the gutter for the past two years. As the contractor, working for Mr. Sabine, had the equipment to do the job on the adjoining property I gave him permission,as stated above$ to dig the gutter to the bay. To do a good job he would have to work at low tide - that is probably why he asked for permission from the Trustees. Please advise me of the next meeting pf the Board of Trustees at which this matter will be considered and settled, I called the boundary agreement to the attention. of Mrs. Grace Nickles but it appears she did not have a copy. Peconic Hay _ _ _ into Hippodrome_ Creek, I_ -wish.-to _ cdi�l^to'-your =_ - attention the _fact that my - has- gradually- _ built up on -the -west by accretion- and that-_I - _ shall vigorously -oppose any attempt by anyone to in any way change or alter-:the- course of the- _ - _-- - - gutter- as--it-- now exists. - I will appreciate_-you -_ advising-Pe of any -action -you may -take.-- -Respectfully yours, DE BEIXEDON Versus I DAI,Y The above action is to be marked settled and discontinued without cost to either party as against the other, upon the following understandiryg It is agreed that Mr. Otto VanTuyl, surveyor, shell determine the true gutter b$undary line betwigen the lands of Mr. Daly and Mr. De Bei ido• .A If the boundary line is substantially as shown on the map of property of Mr. Daly, surveyed by Van Tuyl on September 14th, 1926, Mr. Daly agrees to give to Mr. De Beixedon an option to acquire so much of the meadow land as shown on said survey running south from Hippodrome Creek to the beach not exceeding 160 feet west of and parallel with such gutter boundary line. If Mr. Vann Tuyl shall determine the gutter boundary line to be further nest than the line shown on the said Daly map south 42 degrees 56 minutes 50 seconds east the area of land concerning which the option shall apply shall be abated by the difference between the said line (sout 42 degrees 56 minutes 50 seconds east) and the line determined by him as the true gutter boundary line. Mr. Van Tuyl shall be at liberty to consider all of the facts pertaining to such boundary line including the boundary line agreement between Terry and Tuthill, dated in 1856, in arriving at the true gutter boundary line, As to so much of the land as Mr. De Beixedon 'shall decide to purchase under the option, the geed price is $16.66-2/3 per front foot. The option is to run for a period of five years from the date of the execution of formal agreements which are to be signed not later than May 25th, 1933. The expenses of Van Tuyl in the fixation of the present gutter boundary line *hall be botrne equal, b.etween the parties. The line as finally determined by Van Tuyl shall be properly monumented and shall be the true boundary line between the lands of the parties hereto. In case Mr. De Beixedon shall not execute the option, f J I• it the present gutter boundary line as so determined by Van Tuyl shall forever be the boundary line between the parties and shall be recogniAb =, each and their heirs and assigns as such. The deed which Mr. Daly is to deliver on the execution of the option shall contain the covenant that during Mr. Daly's lifetime and so long as he continues to own the adjoining land, no buildings of any kind shall be erected upon the land conveyed unless Mr. Daly shall erect any building or buildings on his side of meadow land. The said deed shall also obligate Mr. Do Beixedon to construct, within six months from he 44� -fig date of the delivery of the deed, a new gutter. at least three^feet in width on the new boundary line, one-half on the land of each party. sufficient to permit tidal waters to ebb and flow through the new gutter to and from Hippodrome Creek or pond. and upon the completion of the construction of the new gutter, the old gutter may be permanently closed. The parties shall both perpetually enjoy the right in common to use the new gutter for ingress to and egress from Peconic Bay to Hippodrome Creek or Pond. After the new gutter shall have been constructed there shall be no oDbigation on the part of Mr. De Beixedon to maintain it.
