Y., as part of the consideration for the issuance-of the Permit does understand and prescribe to the fol- lowing: 1. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any oper- ation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, .to the complete exclusion of the Board of Trustees of the Town of Southold 2. That this Permit is valid for .a period of mos. which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at'.a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permit-tee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that auth- orization was originally obtained. 4. That .the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application, may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work or project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee or the completion of the work auth- orized. 9. That the Permittee will obtain all other permits and consents that may be required sup- plemental to this permit which may be subject to revoke upon failure to obtain same. D*Antonio maintains on her neighbor's (Mrs. Eleanor Schriefer) property. Though I object to the Board's having issued 'Mrs. D'Antonio a permit for this dock under circumstances you now know to be false, I have little choice but to accept the situation. As it stands now, I believe, the only fashion in which the permit will be revoked is by Mrs. Schriefer's direction. Enough said. The purpose of this certified letter is to formally lodge an official complaint against Mrs. .Arva M. D'Antonio in that she is now storing this dock completely out of the water and on land in violation of town ordinances and regulations that state quite specifically that no boat or dock may be stored in one's yard closer than 15' to any property border. Since Mrs. D*Antonio has deliberately misinformed you previously regarding her property borders, please refer to the enclosed copy of a very recent survey of Mrs. D'Antonio's property. Mrs. D'Antonio only owns a 10' strip of land that leads to the edge of Great Pond. Since this floa`t.ing dock is practically 15' long in and of itself, it wouid seem to me that there is 'NO legal manner in which this dock can be stored out of the water. If that is the case, then so be it. I categorically and emphatically refuse to issue permission to Mrs. D�Antonio to utilize ANY portion of my property in order to transport this dock up into her back yard. Such useof my land is 'legal trespass, and Mrs. D'Antonio has been instructed by my attorneys to cease doing so. The floating. dock is currently situated on both -Mrs. D'Antonio's and Mrs. Schriefer's property. If Mrs. Schriefer has given Mrs. D'Antonio permission to utilize her property in .this manner, then I wish to lodge this official complaint against her as well . I have tried unsuccessfully to rent my home for the past two seasons and have been unsuccessful due ONLY to the existence of this dock. I have several Real Estate Agencies. and their respective salespeople willing to swear to this fact in court if necessary. Whereas I do not know whether or not I will be listing my property this winter for rental , or for sale, I will not sit idly by and allow this stored dock to so adversely affect my personal welfare. Lost rental dollar$ are indeed substantial .
