By such acceptance, the applicant also agrees to indemni- fy and save harmless the Town, and its officers, agents and employees from any and all claims arising from operations under this permit and any and all acts or omissions of applicant, his agent and employees. The applicant and the owner and occupants of the premises upon which the operations authorized by this permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and its officers and employees to enter upon the premises where such operations are being conducted to make such inspections as the Town may deem necessary to insure that such operations are being con- ducted in conformity with this permit. This operation will not substantially: A. Adversely affect the wetlands of the town. B. Cause damage from erosion,turbidity or siltation. C. Cause saltwater intrusion into the fresh water resources of the town. D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege- tation or the natural habitat thereof. E. Increase the danger of flood and storm-tide damage. :_F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town. G. Change the course of any channel or the natural movement or flow of any waters. This application is to be completely filled in by typewriter or ink and submitted to the Town Clerk in quadruplicate, accompanied by written permission from the owner of the property if not the some as the applicant. _ B. Pilot Plan must be drawn to scale on the reverse side of this application showing the location of property, the names and locations of owners of adjoining properties, and a detailed description of prcposed project. (Note: Copies of the Pilot Plan may be made by a copy machine and attached, to the 'Permit Application:) C. No operation shall be initiated by the applicant until all.permits that are required are issued. D. A detailed statement of the. rehabilitation and proposed condition of the -premises after the' work is completed must be given, including a survey if required. E. If permit is being sought for a more sizeable excavation than the construction of. a private single dock or jetty, then this application must be accompanied by a survey and topographical map certified by a ''registered land survey or Professional Engineer. The horizontal .control of survey shall be based upon.an approval local coordinate system. The vertical control for elevation and sound- ings shall be based upon United States Coast and- Geodetic Survey and/or United States Geological Survey datum. F. A statement must accompany the application describing any known prior operations conducted on the premises in question and whether any prior licenses or permits have been issued to erect structures or to dredge or deposit fill, on said.premises and whether any such permits or licenses were ever revoked or suspended by a ,governmental agency. G. A filing fee of $25.00 shall accompany the application. This filing fee includes one inspection; there is a $5.00 fee for each additional inspection. H. The Town Board upon request �f applicant for a permit, may waive in whole or in part, I. provisions of Article I I, Section9 subdivisions (b) and (�'where it finds that nature of the proposed operations are such that -the requirements of such provisions are not necessary for a proper consideration of a permit application. The Trustees own a narrow strip down the middle of the channel, the rest of the bottom is private ownership. This is like a little boat slip that was dug years age., TRUSTEE SMITH: At this time I would like to take comments from the audience. MRS. EHLERS: I would like to ask a question. First, I live on New Suffolk Avenue off James Creek in Mattituck. I would like to know where the fill will be dumped from this dredging? MR. CHARLES BOWMAN: It is a very small proposal. MRS. EHLERS: I 'm on James Creek also, boats are constantly coming in and doing this and doing that. I 'm gradually loosing water to us, and we do not have a boat in the creek.. I like as much water as I can. . . TRUSTEE SMITH: I don't get what you say when you say you're loosing water? MRS. EHLERS: It seems to be drying up. There are times when the water comes .up to the back of our property. Now I don't know if this is from this dredging?: What. is happening? TRUSTEE KUJAWSKI: I don't think that would be the case. What is happening, you are getting siltation, the creek is filling in from the. heavy rain. Alot of material gets deposited in there. Someone taking out 100 cu. yds. of sand up on the other end of the creek is not going to change by one inch, the amount of water that reaches you. Down on the other end, your on the North end really. I don't really think this is happening I don't think any of htese projects would have an effect on the level of the water. But you will probably notice over the years that it will appear to be lower because the land is actually coming up. MRS. EHLERS: Yes. We have noticed changes in the last five years. Approximately 107 feet 'of. timber bulkhead would be constructed with backfill. at or landward of the line of mean high water (MHW) along an eroded bank. The dock would extend from the bulkhead approximately 13 feet seaward of the line of MHW and would consist of an 8-foot by 3-foot ramp and a 10-foot by -6-foot float. The work would also entail dredging a trapezoidal-shaped area measuring 40 to 50 feet in length and 20 to 40 feet in width to 3 feet below mean low water (MLW) . A 2 . on 1 slope would be provided between the dredge area and the ' line of MLW along the northern and western banks. Approximately 100 cubic yards of sand would be removed by crane and would be placed in the water along the entire length of the eastern bank in order to stabilize the bank from erosion. Approximately 107 feet of. timber bulkhead would be constructed with backfill. at or landward of the: line of mean high water (MHW) along an eroded bank. The dock would extend. from the bulkhead approximately '13 feet seaward of the line of MHW and would consist of an 8-foot by 3-foot ramp and a 10-foot by 6-foot float. The work would also entail dredging a trapezoidal-shaped area measuring 40 to 50 feet in Length and 20 to 40 feet in width to 3 feet below mean low water (MLW) . A 2 on 1 slope would be provided between the dredge area and the line of MLW along the northern and western banks. Approximately 100 cubic yards of sand would be removed by crane and would be placed in the water along the entire length of the eastern bank in order to stabilize the bank from erosion. Marsh plantings would -be established on the fill and also on the intertidal zone along the southwest bank outside of the canal . Approximately 25 cubic yards of material' would be removed once during a 10-year period, and disposed of on the adjacent upland property.
