RESOLVED that the Town Trustees Approve the request of J.M.O. Consulting to amend permit number 302 to reflect construction. of 150 , timber bulkhead with a 15 ' return at the eastern terminus, and to backfill with approximately 400 cu. yds. clean sand to be trucked in from an upland source. Kujawski, Jr. Re: Wetlands Permit No. 302, Mary DeMartino, Orient Dear Mr. Kujawskia At the present time I am requesting a modification to the above noted permit. The applicant had originally been permitted to install approximately 150' of rip-rap above the MHW line at her property fronting Orient Harbor. The problem that has arisen is that one of the covenants in the deed of the property from the original landowner is that the original owner has final say in what type of erosion control device may be constructed or installed at said property. The original owner will not however approve the installation of rip-rap at the site but will give the approval for construction of bulkheading. With this we are now seeking a ,modification to allow the applicant -to cons truct `approxi mate ly`15[p- of- �i th-e-���-------' . ' Atern ������return at the terminus and to backfill the propos=" structure with a' proximately 400c .y. of clean sand which shall be trucked in from an ' upland source. The proposed timber bulkhead shall be constructed above the .MHW line in accordance with the enclosed plans. Although the permit was approved by you on July 3, 1986, I wish to advise that I just received it this month from Land Use Co. , as they waited for the DEC permit which took a whole year for them to approve it. The DEC permit expires on 6/88, but.. the Town Trustee 's permit expires on 6/87, and this presents a serious problem to our family. My hxtsband was hospitalized in October 1986, and is still ill and under medical care at present. Surgery is being contemplated, and he now has an appointment with a surgeon, to plan surgery in June. This condition will require a long recuperation, and we are therefore asking you to extend the permit to June 1988. It will be impossible for us to be actively involved in building before that. We have looked forward to building our retirement home for many years, and did not expect this crisis to occur. We trust that by next year, these problems will be resolved and we can go on with our lives and plans. We both thank you for your consideration at this trying time.
