She asked if the Town Permit would allow her to leave the shed there? I advised her that she would be in violation of the D.E.C. if she did that. They review their own applications. She asked me about a sun room that they want to construct on top of their patio on the property. She said that she has a building permit, for this work. I asked her if it was within 75 ft. from the Wetlands or water? She said she thought that it was about 150 ft. from the water. I told her that the Building Dept. would have sent them here if they needed a wetland permit, however, if she wanted to submit a letter, she could and request a determination on the need of a permit. Our Attorney, between now and the next meeting, is contemplating retaining an appropriate professional to run an environmental impact study to see what effect the stairs, shed and deck have upon the face of the bluff, and therefore we need additional time. We respectfully request that this matter be put over to the next meeting. This will in noway effect Mr. Diakos current usage of the stairs. Trustee Smith: Thank you. Halikias Town Board BOX '264 EAST MARION, LONG ISLAND, NEW YORK 11939 July 11 , 1986 Judith T. Terry, Town Clerk RECEIV Southold Town Hall :&0 P&^ Southold, N.Y. 11971 J UZL ,n Dear Ms. Terry, 'ewn Clark or./ It has come to our attention that a property owner living at Aquaview Extension off Stars Road in East Marion has built a staircase and shed, and has installed electricity and a water supply to the bluff which is adjacent to the East Marion Stars Beach (a private beach). We believe that this constitutes a violation of building regulations, environmental regulations and the rights of all members of the East Marion Stars Beach Association. As of July 7, 1986, no application has been made or .building permit issued re- garding the aforementioned structure. In addition, no application has been made to the Town Trustees to build within 75 feet of the shorefront. Also, a variance has not been grpntedto build the structure so proximal to the property line of the beach. The owners of the property are Effie and Zan Diakos of East Marion, and the builder, we believe, of the structure is Tom Crowley of East Marion. Furthermore, we have been informed that a Bay Constable has been sent to inspect the premises and to determine in whose jurisdiction this issue belongs. We would like this issue to be considered at the town meeting of July 29, 1986. Kindly forward all correspondence to Kay Halikias, P.O. Box 264, East Marion, N.Y. Respectfully cc, galliope S. LaGamma President - East Marion Stars Beach Association Ka Halikias Secretary 4 To: Bay Constable From: Trustee Office Re: Structure put in without a permit Date: July 7, 1986 Please make an inspection of the property owned by Zan & Effie Diakos on Stars Road, East Marion for a set of stairs that were put in on the property without a wetland permit. Ilene Pfifferling 7/I yz& ALSO: Please make an inspection on Arshomamoque Pond, Southold we have had a call that someone has placed eel traps in the middle of the pond. There is a problem with water skiing. The only information submitted is a license plate number of the person who sets out these pots and collects them is 8807-NF. Neer York., To: Kalliope LaGamma, President of East Marion, Stars Road Beach Association From: Carmen Vazquez-Matthews , Association Member Subject: Resident Diakos - Beach Stairway At the request of the Association, I went to the, Southold Town Hall to inquire about the alleged permits applied for by the Diakos family for the stairway, electrical and water installation during Spring of 1986. . As per the secretary to the Board of Trustees , Eileen Pfifferling, absoluetly no permit application has been filed 'with the .Town of Southold. The process will then be as follows : 1. The Bay Constable will inspect the site by Wednesday, July 9th. (Bay Constable will determine whose jurisdiction) . 2. A warning will then be issued to Mr. and Mrs. Diakos as they have not followed appropriate procedure previously indicated to us . 3. Should they not comply with the town directives, (if under town jurisdication) , further legal action might be forthcoming. 4 . The next step (if the board wishes) is to contact the Department of Environment and Conservation regarding property violations or permits. I am forwarding a copy of this memo to Town officials for their records.. I hope this information is helpful. If you have any questions feel free to call me at my home in Port Jefferson at 473-1808.
