The validity of this permit is or may be subject to the approval of other governmental or municipal
authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the
event that such approval is necessary, the holder of this permit shall not commence operations here-
(,a under until such approval has been obtained in writing. The failure to obtain such other approval when
required shall subject this permit to immediate revocation by the Trustees upon receipt by the
"? Trustees. of written notice from such other governmental or municipal authorities of its refusal or
fd disapproval.
The applicant does by the acceptance of this permit, assume all responsibility for operations under-
taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons
- and property resulting from such operations. By such acceptance, the applicant also agrees to indemni-
fy and save harmless the Town, and its officers, agents and employees from any and all claims arising
from operations under this permit and any and all acts or omissions of applicant, his agent and
employees.
The applicant and the owner and occupants of the premises upon which the operations authorized by
this.permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and
its officers and employees to enter upon the premises where such operations are being conducted to
make such inspections as the Town may deem necessary to insure that such operations are being con-
ducted in conformity with this permit.
ThiS operation will not substantially:
A. Adversely affect the wetlands of the town.
B. Cause damage from erosion, turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town.
D. Adversely affect fish, shellfish or.other beneficial marine organisms, aquatic wildlife and vege-
tation or the natural habitat thereof.
E. -Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town.
G. Change the course of any channel or the natural movement or flow of any waters.H. Weaken or undermine the lateral support of other lands in the vicinity.
I. Otherwise adversely affect the health, safety and general welfare of the people of the town.

Dear Roy:
-The following action was taken by the Board of Trustees at
a regular meeting held on November 27, 1985 regarding the
wetland application no. 299 for Jack & Joan Donnelly:
Moved by Trustee Bednoski seconded by Trustee Bredemeyer it
WHEREAS, En-Consultants, Inc. on behalf of Jack and Joan Donnelly
applied- to the Southold Town Trustees for a permit under the
provisions of the Wetland Ordinance of the Town of Southold,
application dated September 4, 1985 and,
WHEREAS, a public hearing was 'held by the Town Trustees with respect
to said application on November 27, 1985 at which time all interested
persons were given an opportunity to be heard,
WHEREAS, the Board members have personally viewed and are. familiar
with the premises in question and the surrounding area; and
WHEREAS, the Board considered all testimony and documentation' _
submitted concerning this application; and it is noted for the
record that there has been no public opposition; and
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW, THEREFORE, BE IT
RESOLVED that En-Consultants, Inc. on behalf of Jack & Joan Donnelly
be granted permission under the provisions of the Wetland Ordinance
of the Town of Southold, New York, all in accordance with the
application. This permit will expire on November 27, 1986 if work
has not commenced by said date. There shall be two inspections
required; and the Trustees shall: be notified when the project
is complete.
A $5. 00 Wetland Inspection feeds now due and payable. Upon
remittance, your permit will- be forwarded by mail. Thank you for—
your continued -cooperation in regard to this matter.

This notice is issued pursuant to the provisions of Article 8
of the Environmental Conservation Law State Environmental Quality
Review and 6NYCRR Part 617, Section 617 .10 and Chapter 44 of the
Code of the Town of Southold, notice is hereby given that the Southold
Town Trustees, as lead agency for the action described below, has
determined that the project will not have a significant effect on
the environment.
TYPE OF ACTION: Unlisted
DESCRIPTION OF ACTION: To construct 200 lin. ft. of timber retaining
wall plus (2) 10 ' returns. ' Backfill with 350 cu. yds. of clean
sand and loam to be trucked in from commercial uplans source.
LOCATION OF PROJECT: Town of Southold, County of Suffolk,. more
particularly known as: Private road -off of Park Avenue, Mattituck,
County Tax Map No. 1000-123-7-7 .
REASONS SUPPORTING THIS DETERMINATION:
1. An environmental assessment has been submitted which
indicated that no significant adverse effect to the
environment are likely to occur should the project be
implemented as planned.
2 . Because there has been a response from the Southold Town
Conservation Advisory Council indicating that this project
would not have a significant effect to the environment.
3. Because there has .been. .no response in .the allotted t.ime .from
the New York State Department of Environmental Conservation
and the Southold Town Building Department, it is assumed
that there are no objections nor comments from those agencies .

PROJECT DESCRIPTION AND LOCATION :
Town of Southold , Countv of Suffolk.
Construct a 200 linear foot retaining wall (bulkhead.)
with a 10-foot return at each end . Back-fill with
350 cubic vards of clean fill to be trucked in from
an upland source .
Proiect site is on Great Peconic Bay , south of Park
Avenue between the lands of C .H. Wickham and Holman ,
Mattituck, New York.
PERMITS APPLIED FOR: Tidal Wetlands (ECL Article 25)
SF.QR: The staff of the Department of Environmental
Conservation , as lead agency, determined that the
magnitude of the environmental impact of the proposed
project does not warrant the preparation of a Draft
Environmental Impact Statement , and issued its
determination pursuant to 6 NYCRR Part 617 .
The provisions of the State Environmental Ouality
Review Act are not applicable to this project.
A Draft Environmental Impact Statement ("DF,IS") has
been prepared for this proposed project by the
Applicant pursuant to the State Environmental Quality
Review Act ("SEOR.A") and has been accepted as
sufficient for the purpose of conducting this
hearing . The Department of Environmental
Conservation (or name of municipality) is the lead
agency. (If DEC is lead agency add : ) Comments on the
DEIS will be received at the hearing and may be filed
in writing with the Department until 10 days after
the last day of hearing .
The requirements for the preparation of an
Environmental Impact Statement have been. f.ulfilled by
a Federal NEPA Statement .

(Permit Hearing Procedures) .
